- In this episode of Dil Se With Kapil Sibal , Senior Advocate Kapil Sibal discusses with a panel of leading lawyers the problem of sitting judges developing political links. Recently, Justice Abhijit Gangopadhyay quit the Calcutta High Court and joined the Bharatiya Janata Party. While on the bench too, his judgments, obiter and interviews generated controversy. How should the legal community respond in such cases? And is it ever possible to insulate the judiciary from politics? Listen in to Sibal’s conversation with Meenakshi Arora, Prashant Bhushan and Dushyant Dave.

First time in my 75yrs life. I heard this type of good discussion by these good personality. God bless all of you.
Where are the lawyers and judges coming BK🎉from
We keep blaming others
We don't question what we are doing
Ourselves
What is the meaning of independence
Great session of upswing senior advocates of supreme court.❤❤❤
Well done sir Kapil ; this episode will be a class for common men and women. Keep up building our nation wide.
Yea indeed a fruitful conversation.
Cheers to Sibal.
Fruitful discussion indeed! Thanks.
Extraordinary discussion by extraordinary legal experts🎉
Grate move and Best wishes❤
The advices of all the above four dignified persons are most valuable.
Better late than never. May God bless them to have such discussions for their junior members to decide what is ethics in profession.
discussion is very much appreciable.
Minimum of 10 years cooling period should be there.
You are doing a good job
Should a Lawyer be allowed as politician? Lawyers should not be allowed in any condition.
Why not? What's the problem there? 🤔
@@sandeeproy1327sibbal is an example of problem😂😂
Brilliant. Why did sibal, khurshid Tiwari chidambaram etc become ministers in the central government?
😂😂😂😂😂 highest professionals who are politicians are lawyers.
I had the opportunity of appearing before Honble Justice P.D.Desai and seeing him during His Lordships tenure as the Chief Justice of the Honble Calcutta High Court and I fully agree with Mr Dushyant Dave that Justice Desai was one of the greatest judges. Justice Desai had absolute integrity, judicial temperament, true sense of justice, impartiality, humanity, strictness, courage and administrative ability. Had there been a majority of judges with such qualities in our courts, the people would have great faith in the administration of justice in India.
Absolutely in agreement. Sir, your comment is extremely relevant in today's world. Particularly how you describe the ideal judge is a clear indication of your personal integrity. You have my sincere regards.
Really a very informative and brilliant discussion by brilliant minds.
Congratulations
To have a fair judiciary, there should be parmanent ban on appointment of judges to any post after their retirement.
Happy to see all of you discussing the independence of Judiciary.
Thanks to all four courageous experienced judicial minds for highlighting the concerns of their profession. This debate is the need of the day as the independence and integrity of our Judiciary is questionable because of political interference. I agree with Adv. Prashant Bhushan as Judiciary is a top Constitutional body public opinion should also be given importance in reforming the same. Hope it will regain it's independence so that people have faith in the governance system.
I personally really have a appreciate about all of you about your discussion towards the judiciary of this country.we must have a faith on constitution of this country as poor people.please try to set up a remarkable intrigriti of this country.
Must needed conversation!!
Very fruitful discussion.
Carry on Mr. Sibal
Salute to sibal saheb for speaking so nicely and frankly. God bless u sir. Veena sibal
An enlightening ,highly educative and fruitful debate by the legal experts and we'll wisher of democracy.
Dear Mr Sibal , please consider to include the following if possible:
1. The all perverse corruption in judicial system. The thing about few judges joining politics only affects people like you not common people.
2. Online system of allotment of cases and judges alloted from another part of country.
3. Removal / abolition of judicial vacation and holidays. They have to work like all other branches of govt.
Pls pick above mattets that affect common folk
People watching such discussion are still minimal in this country. Only when these numbers increase, the people of this country can't be fooled by their politicians
Enlightening.
Great sir thanks.
Great talk.
Great discussion on important topic
This a very good topic.
Del se is doing wonderful work..... congratulations to all of you😊
Very good conversation👏👏👏. Salute you all🫡
Indeed , very fruitful
Very good discussion ❤
What an enlightening discussion! The uninhibited, bold introspection of these legal luminaries on their sphere of professional action speaks volumes of their integrity and dedication towards one of the most important issues which directly influences the public. Madam Meenakshi hit the nail on the head and took the bull by the horns when she mentioned the importance and degradation of moral education at the school level. The first 15 years of life are indeed most impressionable years and if ethically sound values are imparted and imbibed during this phase of life then only we can hope for grand, positive and meaningful contribution by judges in particular and by citizens in general towards the noble cause of national regeneration.
Great talk, must come in action
When lawyers can become political butterflies to become legislators (perhaps in exchange for fighting political cases pro bono and or reduced fees) and judges, why shouldn’t ex - judges be free to enter politics?
Great job! ❤
Honourable Panel, why case of some big shot got hearing their case very quickly whereas case of poor remain unheard over many years?
Very fruitful discussion in the intrest of publice not in the intrest of parties.
Great discussion for general population who does not come from law background but understand law in layman's language. Bravo 🎉 keep it up .
Dear Sir Sibal great job.
Nice
Very good
Greatly appreciate them for providing these insights and help create awareness regarding the current rends in the judiciary which is supposed to help provide good life to people by protecting them with the law!!!
Very interesting discussion, a lay man like me has a lot to learn from all of you , the highly learned lawyers .
Very Good. There should be also discussion on should any political leader take charge of supreme court bar council's presidentship?
Thank you Sir for this type discussion and enlightenment of judiciary you are great and gracious to us the Indian people.
kapil sibbal ji is a legal eagle
How could you say justice Ganguly has given judgment in favour of bjp .
Because he gave judgement against TMC govt .where bjp is not involved leftist thing you know.
Justice Chappel did not do justice to justice Ganguly
Good content
Because in case of abhijit was regularly taunted by TMC to fight in the field of politics ...he had the courage to leave his job and take on the challenge
Its because of This abhijit ganguly, today general public in Bengal think most of the judge of high court is politically biased.. He used the chair of judge to fullfill his political ambitions. For him only today high court judges become mockery...
@@souravsantra8292
Absolutely correct
In one word Abhijit Babu is Opportunities and malingned the position of judiciary.
Shameless person
Salute to all of you. Such malicious judges should be jailed.
Thank you the Lady and gentlemen for your very serious discussion on the present judiciary of our great nation. Yes, it's the duty of laypersons like us also to act in a fearless way and communicate to our politicians that we need a free and fair judiciary for our country.
- Greed ruins sacrifice required in citizens today.
- Corruption and greed go hand in hand.
- Honesty alone can eradicate correption.
- Such discussions of learned and dignified professionals are simply waste of time if they don't conclude in concrete solution for the welfare of country.
No political party talks about corruption eradication is the sole reason why India can never ever be a developed country.
Think what constitution has been doing since independence?
CHARACTER IS LOST is the one and only prominent one word I found most meaningful in today's discussion. I therefore appreciate the female participant.
💪🏼👍🏼🇮🇳Weldon ser❤️🌹❤️🌹❤️🌹❤️ and good talk's
We must salute sincere and brave Advocate Kapil sibal and judges who dare to speak truth with great sincerity in the context of judiciary sanctity.
Character building is must for school and colleges.
PASS RULES BY S. COURT,COOLING PERIOD.
5 YEARS FOR S. COURT, 4YEARS FOR HIGH COURT, 3 YEARS FOR D. COURT, AND 2 YEARS FOR OTHERS, THAT THEY CANNOT WORK PAID OR UNPAID, IN ANY GOVT, OR JOIN ANY POLITICAL PARTIES.
MUST BE PASSED IN PARLIAMENT AS WELL.
It is time that some one talked about judiciary too. Thanks
Mr.Sibal is asking a simple question,"what is happening in the country?".
A simple question has a simple answer.
"Gujratization, Adanization and saffronisation". Nothing more, Nothing less.
My dear fellow one thing missing to add in your wonderful phrase Ambanisation .....
@@shahbazsaroa2709 sorry. On this issue, I beg to differ. Ambanization started since the days of Indira Gandhi and Pranab Mukherjee. Now he is playing second fiddle. Only maintaining continuity
Wonderful great wisemen are discussing about law, judiciary and politics. Good. Please discuss about Justice Baharul Islam who changed himself from politics to HC judge to Rajya sabha and back to SC judge and attempted to loksabha failed, and made RS Member and Governor inbetween by Indira khan. Pl😢 discuss about him at length with full details.
All three could have become judges. The Power should realise. More capable than capables.
Best legal minds trying to create awareness on such important role to protect the judiciary standards is really the needful of the hour
Something more is required than mere discussion in this matter.
Cooling off period to the Judges to join political parties can be the best way. The cooling off period should be Five years.
The fact that this is discussed about the judiciary tells a story that many fear to proclaim
Rather a sad and depressing discussion yet the truth hits us all in the face.
😢
I support all of u.
Very valuable, meaningful and also more awareness creating subject to those who are blindly bent upon to accept the illegal measures taking by the BJP Govt.
Very True Sirs & Madam, the 🙏 Ex Judge from Bengal has really degraded his Profession and has set a wrong example in 🇮🇳🙏 the society.
A good topic of discussion by the respected Lawyers. There should be a fiercely independent judiciary in a democracy. At the time of their appointment the learned judges may be asked to issue declaration/oath/affidavit that they would not accept/join any executive post of the Government within five years of his retirement/resignation. It would serve as a cooling period for the retiring judges. The judges code of conduct needs to be ammended accordingly.
Good morning sir,
I am watching your show " should Judges enter the politics".
Sir, in this regard I will go one step ahead and will suggest that when person holding a position of Judge, he or she should not stick to any ideology of any political parties because that will affect the hearing of pending cases before them. We have seen this in so many cases in the past.
❤
Let’s appreciate that these prominent lawyers are the better VOICE of Indian people than the politicians.
The operating word and soul of this episode should be that we want a Judge whose "Heart beats for Justice"
👍👍
Where are we headed.
In the US it is famous that a judge is an advocate who knows a politician. They come as judge through politics survive through politicking and it will be logical for them to enter politics.
When dushyant dave said " when constitution was made the power to the president to appoint judges of the high court and supreme court in consultation with the chief justice of India it was never thought that the office of the chief justice of India or president of India would not envy of the height which was expected by the constitutional framers" he nailed it
Exactly. These two posts are important for the nation.
Brilliant of 4 members salute.after 75 years I have not seen to save democrasy
There should be an audit on the judgements delivered in the Supreme court, not all but at least some. Use a recognised sampling technique.
Kapil ji you have power to move application against judges and assigned politicians..even on president and or any political minister decided by Indian citizens.. its my prY
There should have cooling period to enter in polits for JUDGES
Justice Gatikrushna Mishra, the then Chief Justice of Orissa Highcourt was always avoided attend social programes and avoided to mix with general public when he was in office. He always said it may affect the judgement.
Judges or any person holding a constitutional post shouldn't enter politics and shouldn't be given any constitutional or government post after retirement.
No doubt it's extraordinary conversation but my question remains same WHY SHOULD WE BELIEVE IN JUDICIARY? All we know we have so called independent Judiciary . Which questions have been discussed here, that were come into my mind earlier . Loopholes in our judiciary.
1. Judges appointment system (collegium system) very opaque.
2. Political appointments of judges very soon after their retirement.
3. At leas 30-45 days provisions of Holidays occasion in Judiciary , where world largest numbers of cases pending.
4. Nepotism
5. Provision of CONTEMPT OF COURTS .
❤No problem at all but always work fearlessly for the people n keep Indians united in oneness ❤please control price rise ❤
There is urgent need to have three or four Supreme courts in west, east, south and center of the nation to give due representation to languages and cultures in the country.
Some people are above all
Advocate Shenoy had sent a complaint about Justice Mary Joseph of Kerala High court to the Chief Justice of India
I still do character building exercises in my course for ages. Peace times erode the society of its values
Please also discuss what happens when there is no rule of law in Bengal. And the CM says she doesn't abide by the hight court order.
I agree that it's the Bar which makes and demage Judges. A " Good Bar and it's Good Independent and Competent Leaders or Members of Bar" can have some moral checks on working of Judges at all levels...But we must have Independent Honest Competent Leaders in the Bar...How many members are ready to sacrifice their luxurious life. Victimization fear is on both sides...
Keep in mind case of ex cji Ranjan gogoi.currupt judges are given such post in return for favorable judgemet for govt. How do you deal with such currupt.?
ENTER All ❤❤❤😊
A minimum of 5 years cooling off period must elapse before a former judge can fight elections
Welcome to great hero’s
When act judgements are same in all type case why judgement delayed spoiling standards of living
When I went to honororium to Denmark the best standard living by the queen asked me how many days you get judgement in India I said Bharath changed as India it will take 25 years maybe all witness killed meanwhile we should have a computerised ai to take lakhs of case similar act under supervision of your advice to have a single path to be withheld from lower court to supreme court
this is re-upload mention it!
