    I had the opportunity of appearing before Honble Justice P.D.Desai and seeing him during His Lordships tenure as the Chief Justice of the Honble Calcutta High Court and I fully agree with Mr Dushyant Dave that Justice Desai was one of the greatest judges. Justice Desai had absolute integrity, judicial temperament,true sense of justice, impartiality,humanity,strictness, courage and administrative ability. Had there been a majority of judges with such qualities in our courts,the people would have great faith in the administration of justice in India.

    Thanks to all four courageous experienced judicial minds for highlighting the concerns of their profession. This debate is the need of the day as the independence and integrity of our Judiciary is questionable because of political interference. I agree with Adv. Prashant Bhushan as Judiciary is a top Constitutional body public opinion should also be given importance in reforming the same. Hope it will regain it's independence so that people have faith in the governance system.

    Dear Mr Sibal , please consider to include the following if possible:
    1. The all perverse corruption in judicial system. The thing about few judges joining politics only affects people like you not common people.
    2. Online system of allotment of cases and judges alloted from another part of country.
    3. Removal / abolition of judicial vacation and holidays. They have to work like all other branches of govt.
    Pls pick above mattets that affect common folk

    What an enlightening discussion! The uninhibited, bold introspection of these legal luminaries on their sphere of professional action speaks volumes of their integrity and dedication towards one of the most important issues which directly influences the public. Madam Meenakshi hit the nail on the head and took the bull by the horns when she mentioned the importance and degradation of moral education at the school level. The first 15 years of life are indeed most impressionable years and if ethically sound values are imparted and imbibed during this phase of life then only we can hope for grand, positive and meaningful contribution by judges in particular and by citizens in general towards the noble cause of national regeneration.

    When lawyers can become political butterflies to become legislators (perhaps in exchange for fighting political cases pro bono and or reduced fees) and judges, why shouldn’t ex - judges be free to enter politics?

    - Greed ruins sacrifice required in citizens today.
    - Corruption and greed go hand in hand.
    - Honesty alone can eradicate correption.
    - Such discussions of learned and dignified professionals are simply waste of time if they don't conclude in concrete solution for the welfare of country.
    No political party talks about corruption eradication is the sole reason why India can never ever be a developed country.

    PASS RULES BY S. COURT,COOLING PERIOD.
    5 YEARS FOR S. COURT, 4YEARS FOR HIGH COURT, 3 YEARS FOR D. COURT, AND 2 YEARS FOR OTHERS, THAT THEY CANNOT WORK PAID OR UNPAID, IN ANY GOVT, OR JOIN ANY POLITICAL PARTIES.
    MUST BE PASSED IN PARLIAMENT AS WELL.

    Cooling off period to the Judges to join political parties can be the best way. The cooling off period should be Five years.

    A good topic of discussion by the respected Lawyers. There should be a fiercely independent judiciary in a democracy. At the time of their appointment the learned judges may be asked to issue declaration/oath/affidavit that they would not accept/join any executive post of the Government within five years of his retirement/resignation. It would serve as a cooling period for the retiring judges. The judges code of conduct needs to be ammended accordingly.

    I am watching your show " should Judges enter the politics".
    Sir, in this regard I will go one step ahead and will suggest that when person holding a position of Judge, he or she should not stick to any ideology of any political parties because that will affect the hearing of pending cases before them. We have seen this in so many cases in the past.

    In the US it is famous that a judge is an advocate who knows a politician. They come as judge through politics survive through politicking and it will be logical for them to enter politics.

    When dushyant dave said " when constitution was made the power to the president to appoint judges of the high court and supreme court in consultation with the chief justice of India it was never thought that the office of the chief justice of India or president of India would not envy of the height which was expected by the constitutional framers" he nailed it

    There should be an audit on the judgements delivered in the Supreme court, not all but at least some. Use a recognised sampling technique.

    Justice Gatikrushna Mishra,the then Chief Justice of Orissa Highcourt was always avoided attend social programes and avoided to mix with general public when he was in office. He always said it may affect the judgement.

    No doubt it's extraordinary conversation but my question remains same WHY SHOULD WE BELIEVE IN JUDICIARY? All we know we have so called independent Judiciary . Which questions have been discussed here, that were come into my mind earlier . Loopholes in our judiciary.
    1. Judges appointment system (collegium system) very opaque.
    2. Political appointments of judges very soon after their retirement.
    3. At leas 30-45 days provisions of Holidays occasion in Judiciary , where world largest numbers of cases pending.
    4. Nepotism
    5. Provision of CONTEMPT OF COURTS .

    मुझे सिर्फ़ दो बातें समझ में आईं। पहली, प्रशांत जी ने जो कहा कि सही बात पर अड़े रहने पर व्यक्ति को मनोवैज्ञानिक डर लगता है, और दूसरी, अरोड़ा मैडम ने जो कहा कि आने वाली पीढ़ी चरित्रहीन होगी, इसलिए देश और समाज की ज़िम्मेदारी महिलाओं को देने की ज़रूरत है। इन दो बातों को हर समस्या और हर परेशानी की जड़ मान लीजिए। न्याय व्यवस्था के असली मुद्दों पर तो चर्चा ही नहीं हुई।

    I agree that it's the Bar which makes and demage Judges. A " Good Bar and it's Good Independent and Competent Leaders or Members of Bar" can have some moral checks on working of Judges at all levels...But we must have Independent Honest Competent Leaders in the Bar...How many members are ready to sacrifice their luxurious life. Victimization fear is on both sides...

    When act judgements are same in all type case why judgement delayed spoiling standards of living
    When I went to honororium to Denmark the best standard living by the queen asked me how many days you get judgement in India I said Bharath changed as India it will take 25 years maybe all witness killed meanwhile we should have a computerised ai to take lakhs of case similar act under supervision of your advice to have a single path to be withheld from lower court to supreme court
