Border making is not always a straightforward business - and to some extent this is, and also is not, the case in East Africa between Somalia and Kenya.
Over the past couple of years, the two states have had a rocky relationship, with Somalia cutting off diplomatic ties between the two in December of 2020, accusing Kenya of violating its sovereignty, while citing concerns over alleged Kenyan interference in the state’s internal affairs ahead of its election.
In late 2019, Somalia accused Kenya of destroying mobile network towers on its territory as part of its counterinsurgency effort, and in January of 2020, it also accused Kenya of arming guerilla forces and sending them over the border into its Jubbaland province, where clashes took place around a border village. In March last year, Kenya also accused Somalia of an “unwarranted attack” on a town on its side of the border, during heavy fighting between the Somali government and regional forces, something the state has since denied.
Despite frosty relations in recent times over many issues, at the heart of this East African split has been the two state’s disagreement over where their maritime boundary lays.
The answer is they knew they were wrong and didn't have any reason for their claim,

Kenya had settled maritime boundary with Tanzania 2009 on parallel latitude just after MOU with oblivious Somalia. They also encouraged Tanzania to do the same with Mozambique to give an impression of regional practice. They never imagined ICJ whereby treaties of third parties considered irrelevant.
1979 proclaimed is red hearings they just too embarrassed for 2005 unilateral boundary demarcation while they were hosting peace conference for Somalia. Deception never succeed.

Good question! I studied this case briefly at university, and this was the conclusion I came to based on other similar cases. My lecturer who has worked extensively for the ICJ agreed with me.

Kenya doesn't really have a card to play here, even the Somaliland card does not take precedent over permanently securing 100 thousand km of maritime resources worth trillions in the eyes of Somalia, because the latter can use that wealth along with the rest of its Indian Ocean coastal oil/gas zones to rapidly develop the country, and eventually massively invest in Somaliland, Djibouti, etc through ports, railways, airlines, real-estate etc and then set up the Somali equivalent of the UAE in the form of a Somali Federation.

Somalia filed the case to ICJ when kenya was not showing up meetings and issuing licences to oil companies. Kenya underestimated Somalia's ability to defend the maritime case. Somalia won the case, now it is both sides best interest to move on and try not to call for a war if that happens we will all lose no one will benefit for a war no matter how strong you think you are.

As Somali person we owe Kenya a lot they hosted our refugees in the civil war and luckly they benifited from us very much in every aspect. They benifited from the world embassies and UN Somali offices presence in Kenya, the Somali diaspora those invested billions in Kenya, the Mira (Khatt) which they use to gain more than $250 million per year and all that couldn't satisfied our Kenyan brothers, they wanted more, they wanted to swallow us alive. So, they get what they deserved, we ban the Mira, brought all Embassies to Mogadishu and they said they will close Dadaab, the biggest refugee camp in the world which holds 400k Somalis. It could be happy ending but you choose this way, let's keep going on.

Makes bogus allegations to undermine any efforts its neighbors have made in establishing a stable civil government. Somali should surrender and focus on its vast coast territories for treasure. It apparently has too much that it knows what to do with by annexing more because its not satisfied with its abundance of resources of coastline. It's ashame. ICJ has never been a pro Africa medium, divide and rule strategy is still very much apparent so they're very much enjoying stirring up the conflict. Its always their agenda and Somali knows that so I very much, given Somali's history question its intentions!

Very good content! Would be really interesting if you did a video analysis on Somaliland's geopolitical importance to the region. Seems to be a nation that is often forgotten and overlooked but seem to play a key role in the dynamic between all the Horn of Africa nations.

@@mani-rc2tv No disrespect, but you seem to have a very limited knowledge on the history and political implications of Somaliland. They do control majority of their airspace and waters and are serious unplaying the ramifications of Berbera Port's access to the Red Sea (busiest waterway on earth)

Kenya helped somalis/Somalia we appreciate that. Being nice to your neighbor does not mean that you can steal from them. Somalia filed the case to ICJ when kenya was not showing up meetings and issuing licences to oil companies. Kenya underestimated Somalia's ability to defend the maritime case. ICJ delivered its verdict. It is time to move on and try not to call for a war if that happens no one will benefit from it no matter how strong and well prepared you think you are.

What is your opinion on the outcome of the ICJ ruling? Kenya, unsurprisingly, is upset with the outcome. Many Somalis on the otherhand, are mixed in opinion. They accuse the ruling of judicial activism by refashioning geographical reality to give meaning to an adjusted line. A conclusion reached on a jurisprudentially flawed and contradictory principle.
Kenya has preemptively stated, and has now reiterating their decision to not acknowledge the outcome of the ruling. Would that render it economically unusable to both states? I imagine no country would risk being sued by the Somali state. Likewise, is it realistic for Kenyan to harass any economic activity in the region in favour of Somalia?
The outcome of court on 12 October has been exactly how AR Global Security has analyzed and predicted. Unbelievable, it goes to show that using facts and existing maritime laws the outcome was predictable before 12 October. This was brilliant analysis and most fact based geopolitical analyses so far.
