    Here is my theory. The attorney charged the client for her time to write those 56 pages while knowing that the law suite was deeply flawed and her client was not going to win. She took advantage of an angry client which, I think, is unethical.

      Perhaps the opposing attorney felt threatened by this complaintant, her client so typed it up while he was sitting her in her office with his new shotgun and wrote it up cause she new it would get thrown out before it was started and just wanted to get this guy out of her hair before he went postal.

    • @mmille10
      @mmille10 5 лет назад +3

      I was wondering the same thing. How do people like this make it out of an accredited law school?? It strikes me what's lacking is not so much a brain (though, as Lehto pointed out, some of the language she used is stupid), but ethics. You can tell from her behavior that she knew when she filed this it was junk. She must've assumed he'd settle, rather than go to trial. He talked about it in a previous episode, that he's somebody who doesn't pay on frivolous claims. However, lots of people do, for whatever reason. It opens them up to junk like this, though, because they gain a reputation as someone who will settle at the drop of a hat. If you have money, that behavior makes you an easy target.

    • @dhammer6715
      @dhammer6715 5 лет назад +1

      @@mmille10 I doubt she is actually licensed. If she is, she is wholly incompetent and unethical. If the goal was to settle, it would have been smarter to contact the defendants and try to work something out with demand letters. No, I presume the attorney and the plaintiff are literally psychologically impaired and should be held fully accountable for their misdeeds and antics.

    • @user-io3hy4zb4s

      Maybe. It could be something else is at play, but unlikely. I wonder if she was somehow coerced into filing this. I love your analogy of the sinking ship.. in this story she thinks she's the rat but in fact she's the captain and the captain goes down with the ship.

    And even in this day and age, the modern US Navy STILL installs "rat guards" on every mooring line just after tying up to the pier. In fact, that's usually done before anyone leaves on liberty! They keep rats from climbing the lines as well as keeping sailors on restriction(to the ship) from sliding down to the pier. Yes...I've seen the later!lol!

    If a new attorney did take it over, would they have any personal liability for the prior mistakes? I mean... I'm envisioning a situation where this attorney passes away or something, and a new one comes in, looks it over, and (presumably) immediately moves to dismiss it as unfounded. It's an aspect of legal ethics with which I'm not familiar: is an attorney ethically obligated to examine a case-in-progress before taking it over, or is one just obligated to behave ethically once they "own" it?

    Steve, I received a summons with the name whited out and my name written over it. This has already been resolved but I want to hear your thoughts about it. What do you think? I gave the original to my lawyer but he lost it. Luckily, I scanned a copy of it that clearly showed the whiteout. My new lawyer resolved this for me.

    This is nothing compared to what I have been going through on my moms guardianship and estate. It is so crazy when my sister took a large amount of money out from under the judge when court had control of moms guardianship and kidnapped our mom and took her to another country. The judge put a warrant out for her arrest for grand theft and kidnapping on her. This is the crazy part is my sister hired a former judge to be her lawyer. This lawyer was so crazy during one of the hearings she walked up to the beach and told off the judge and he finds her $250 for contempt and then filed a petition to get her money back. This lawyer filed a petition 4 different times on ransom demands to the court which set off the judge big time. The last time the lawyer filed the petition and went to the court my mom was already dead and didn’t tell the judge she had died. And there were many crazy things that went on. Steve mine is worse and still going on over 6 years later!

    She thoroughly investigated before filing. What did that encompass? The client is breathing and can pay my retainer, enough investigation for her.
    What’s with the judge reissuing the subpoenas? Wouldn’t the lawsuit need to be refilled?

    Steve, in reading the case docket timeline, it looks like it was filed by one attorney, then later substituted by another attorney, and several motions were entered into the timeline. After your final video, can you describe the timeline in a separate video with explanations for the line items. It would be interesting for us "lay people" to see how a civil court process works. Thanks. Jeremy

      Not sad really, more excited. Given that there's only 1 more episode, I predict: The case was dismissed Nov 13, the other lawyer got a public scolding from the judge, and Steve filed the official dismissal order as evidence along with the 56-page complaint to the Bar. Episode 4 won't tell us the results of that because that's probably too soon for a decision to be made by the Bar. But hey, IANAL, and maybe the Bar really can censure her that fast.
