If you decide to continue seeking asylum after your immigration court case is dismissed, you can submit a new asylum application to U.S. Citizenship and Immigration Services (USCIS).     Our asylum case was dismissed before the immigration judge with PD, and we filed our employment authorization renewal application 3 months before the dismissal happened which is still being processed with the USCIS . Do you think we will still get our last work permit?

In that situation, USCIS will only approve your work permit renewal if you decide to continue seeking asylum by filing a new asylum application with USCIS, and also provide USCIS with proof that you have re-filed your asylum application.     My case was before immigration judge but I chose to continue with USCIS , now I found out that USCIS takes at least 6 years to schedule an interview,is there any way to get back to court proceeding again ?

    Dear attorney i would like to ask a question if you answer we would be happy because a lit of people facing this problem. Nta has not served to the immigration court problem, so i got nta while i was in asylum camp, there is a court date and place on nta but when i check eior system with my A number no case found messqge appear when i file my i 589 form to the immigration court they rejected and sent back my form to my home address !! So what should be the next step should i file online with uscis instead of immigration court ? How can i fix this problem ?

In that specific situation, where you have received an NTA but the EOIR (immigration court) system says that there is not yet any case for your A number, you can file your Form I-589 with USCIS, but you CANNOT file it online. To file form I-589, you must file paper Form I-589 with USCIS by mail.

    My mom had her immigration case dismissed by the immigration court on Aug. 01, 2023, but now she received a letter of deportation because she was a no-show, apparently, she had a hearing scheduled for April 17 of this year, but she never received a letter by mail. What can she do for her to not get deported?

That is a very unusual situation, because once an immigration court case is dismissed there should be no requirement to appear at future court hearings without being notified. We would strongly recommend seeking legal assistance from an experienced immigration lawyer. We have not seen specific information that applicants for asylum in Texas have lower success rates, although it could be true. The Houston Asylum Office would decide the asylum application of someone living in Austin, TX who files for asylum with USCIS. People applying for asylum immigration court might have court in several different places in Texas including Houston, Dallas, and San Antonio. Even within each office or court, some officers or judges may grant more asylum cases than others.

    So my girlfriends immigration case was dismissed she will no longer be deported. However she was told she would now be considered an illegal immigrant and could only change her immigrant status if she married an American resident or citizen.
