That's an easy escape for the driver I suspect. Phone on a dash mount and there's no way of showing the driver was watching that, as opposed to the passenger.
Calling Mikey a "grass" is idiotic. These people are a menace! There may be some who would argue that "it's only a phone call", but watching a video causes a serious diversion of concentration. You could see the "Whatsapp" gap in front.
Warning letters will work with some people, they'll think "I was lucky, I'd better be careful in future", others even having been done for a phone offence won't stop them using one again whilst driving. As far as I know you only get one warning letter, after that it's an FPN or off to Court.
I doubt a warning letter has much effect for many- but it will for some. Personally I would have been happy with a warning letter outcome on that case. It was clear what was almost certainly happening but suspect there was room for a reasonable doubt to be fabricated in court. I certainly had a similar one in court where I felt it was pretty obvious what was being shown however there was a pesky reflection(not visible IRL) and the defendant gave so many differing accounts of what they were or may have possibly been doing that there was an element of doubt which the video couldn't override. So for me a warning letter in such a case would be a relief- some action taken and avoids a "wasted" trip to court with the potential for erroeneous equittal! Thankfully in most cases the video makes the use crystal clear.
He read the letter, He probably smiled , pulled his fisted hand down or up and let out a "YES" result ,. Or oh yes - or something similar- the bad habit now has cream on top & a cherry 🍒 as verified medal of incompetent smugness . : Just a guess
IIRC it's illegal for the driver to be able to view a video display while driving (with some exceptions such as sat nav, reversing camera etc) RUclips wouldn't be exempt. Use a browser to view RUclips that allows you to turn the screen off but the audio continues to play. I personally use Brave browser.
Hi Mike, I really appreciate you doing this, maybe raising awareness in a small way, but it's people like you that we need to cut through this madness to the core. I know your son is proud of you! This is why we need more AI cameras that can see through cars to the driver. Most phone drivers will hold the phone on their lap so they can check it once stopped in traffic, knowing they won't be caught unless someone peers into their car. Only the blatantly obvious ones will hold them up whilst driving.

If an offence is serious enough to warrant six penalty points, a mere warning letter is not serious enough.
The greater menace is the person on the scooter doing 20mph+. Could they stop for a child crossing the cycle path to cross the road
At least the scooter user is looking where they are going, and in a collision stands a good chance of being hurt as much as anyone they may hit.
