With the abduction case, I think it’s kind of cruel to ask him to change his name. If he’s had that name all his life, through no fault of his own, it’s his identity. Personally, I would take the 401K match and put in the 6% to get the 10%. Contributing to your 401K in the earliest years adds up really fast with the compound interest, and that's a HUGE return given the 10% match. If you're otherwise "psychologically disciplined" and are still able to pay down he debt in terms of your income, there's no reason not to do the match. If you literally cannot pay down the debt without that 6% of your income, that's another story.

I would never hire someone who is not bonded and insured and who has references. And I think it's very irresponsible to take on jobs at people's houses without being insured. We hired someone to work in our garden and he did great work until he mistakenly cut the gas line while my husband and I were out to dinner. He had no insurance and that was an additional $800 bill for us because we hired him without checking everything out. Lesson learned.

Short answer, same outcome. Assuming a loan and refinancing are different things. Not all loans are assumable (someone else becomes responsible for the payments). While this could work, most if not all conventional loans do not allow it. So unless it’s a VA, FHA, or USDA loan, it’s probably not an option. Refinancing (same borrower, different terms) doesn’t change financial liability to the new owner. A person also wouldn’t be able to refinance if property ownership were changed.

Could Steve and the original home owner do a quit claim deed to transfer the house to him and assume the mortgage with a refinance? Would that avoid the mess with calling the loan note or would that still be the same outcome?

Assuming a loan and refinancing are different things.
Not all loans are assumable (someone else becomes responsible for the payments). While this could work, most if not all conventional loans do not allow it. So unless it’s a VA, FHA, or USDA loan, it’s probably not an option.
Refinancing (same borrower, different terms) doesn’t change financial liability to the new owner. A person also wouldn’t be able to refinance if property ownership were changed.
A quit claim deed removes someone from the deed. His name isn't on it at all, so this wouldn't be an option.

Well here's the kicker if the math doesn't work out involving taking the match while being able to attack that debt worth a crap meaning one is in an income crisis mode involving any and all debts versus actually being able to live and I don't mean eat out for food or having a Netflix subscription or even a middle tier class of Internet subscription each month at home I mean just basic life necessities, then no. That person cannot afford to take the match and that person needs to attack the debts like the debts owe him or her first

Nathan please do not listen to this.. if your employer matches your 6% with 10% that is a no brainer!! The reality is that you won’t see much difference in your take home pay as the money comes out pretax… it is so frustrating that Dave is stuck with his rules like they are written in stone. EVERY financial decision is unique and should be considered. It is unreal that Dave can still offer this advice when it is just unsound logic.
