No, cannot be considered as acceptance. Read, Felthouse vs Bindley - Where Uncle through letter says to Nephew, if you don't reply to this letter by this day, consider you have sold your property to me for this amount. Although Uncle offered a good consideration, Court refused to consider Nephew's silence as acceptance. (What actually happened was, Nephew didn't reply and sold the property to someone else. So Uncle after that due date sued his Nephew for the Property). Uncle had no remedy here. Know that, the general rule is "Offer cannot be considered as accepted by silence (Silence cannot give acceptance)". Because if that would be the general rule, anyone can claim anybody's property as theirs. But there are exceptions to the general rule. Eg. My friend asks me, Will u keep this pack of crayons to yourself and give me 20 Rupees? I, without saying a word started using the crayons as if it was mine (which is called Implied acceptance). Now that I started using the pack of crayons as mine, I am legally bound to pay my friend 20 Rupees and if I don't pay him, he can enforce it against me in the court of law. Only this sort of silence amounts to acceptance which is legally enforceable and has been incorporated under section 8 of the Indian Contract Act, 1872. (Ref: Brogden vs. Metropolitan Rail Co.)
