  • On March 22, 2024, Jerry Hernandez, a cement pump truck driver with a lengthy criminal history, was involved in a fatal crash with a Hays CISD school bus in Bastrop, Texas, resulting in two deaths and his arrest on charges of criminal negligent homicide.

      One reason why I avoid interstates anymore. They have to get that load there regardless of who gets killed. An ex-dispatcher once told me that if there are more than three late deliveries then they are fired. A lot of pressure in this day and age of "just in time delivery".

    A good guess is his company didn't do random drug testing. And post accident testing is required so no way Hernandez could legally refuse to provide a sample.
    I drove trucks for 38 years and probably every year, sometimes every other year we got picked for random testing and I was no exception.

    Why would they hire him? In Tennessee you have to be licensed for that truck. Evidently in Texas you don't! Company should be held liable also!

      None of the problems in his background history, prevented him from driving a concrete pump truck, as are the thousands of ex-inmates that get hired to drive 18 wheelers, they can get the job unless the crime they committed was due to the way they were driving.

      Many jobs are not allowed to perform background checks because of new discrimination laws. It puts many at a disadvantage.

      Maybe, but these are misdemeanor charges. Keep in mind even most Felonies do prevent you from getting a CDL unless you are or have done terrorism or a felony that involved a CMV.

    I have a hard enough time performing office duties on 3 hours of sleep, let alone operating heavy machinery. Jerry was taking assists instead of fixing the core issues in his life, and his luck of getting by cheating this way ran out.

    I'm not familiar with this company, but concrete companies are notorious for low wages for drivers. The concrete trucks are as heavy as a loaded tractor trailer and very top heavy. They need to be driven very skillfully. The concrete companies have to take whatever driver they can get because of the low compensation.

      It's America. Driving is a privilege but our travel infrastructure treats it like a right. You can thank the 1950s American Dream for that.
      Myself, my brother, and two of my friends have also driven on suspended licenses before by choice. Me because I changed insurance providers and didn't realize my new provider didn't notify the state, so the state suspended me for 6 months, my brother for letting his expire after moving out of state, one of my friends for doing 90 on a 45 backroad, and another for paying his speeding ticket but not paying the 11 dollar court fee (he lost his license for a year because of those 11 dollars, and he only found out because he got pulled over for performing a rolling stop and the cop said "did you know you have a warrant for unpaid legal fees?")
      If you keep your nose clean there's no issue, but slip up once and you see how horridly unbalanced the justice system is. 11 dollars can revoke your license for 365 days, and you can't legally bypass it. You HAVE to wait. Let that shit sink in.

    For one thing, the company is held responsible for the actions of their drivers when CDL's are required. Thats Federal rules. We have to take random drug screening and any infractions while driving , either off duty or on, are required to be reported to the company. The DOT does keep track! There is no way this guy could have passed any drug screen or continued to bluff his way to drive the rig if anyone in charge had been doing their required duty! My past employer used to be careless about their hiring of drivers till they had a few that the rest of us drivers reported our concerns about, that got in serious trouble that cost the company serious cash and lawsuits! They didn't let me do road test anymore when I refused to pass some of those idiots! I think it finally got through to them that if they were to continue to hire those losers that their DOT fleet permits and insurance eligibility would no longer be possible! They already had the ins carrier cancel them and finally got a high risk coverage for many times more than what they had. It's always about those drivers lack of caring or giving a Damn about anything but their own selfish attitude. Any one with a bit of sense can master driving skills, it's the attitude that destroys things!

      2006 was 18 years ago. Statute of limitations many places is 10 years. So long as you keep a clean record that long, places consider it a new leaf turned and grant you a second chance. I've worked with convicted felons on military sites who were machine operators who screwed their lives up in their 20s that were in their 50s by the time I met them. Some people do change. The tricky bitch is not relapsing.

    This is why school buses need seat belts. That has always been a big debate with pro's and con's. You got a bus load of kids with no way to avoid being flung around but yet trapped if to young to unbuckle. This is sad. Prayers to the families.

    The concrete company needs to be sued by the families of the deceased for not looking at the driver’s criminal record. They also need to face criminal charges for allowing him to drive.
