So many crimes, yet he was able to stay out of jail until he finally killed people.
The U.S. Justice system
Our justice system is 🤬 up.
Tell ME about it. I'm free after 18 years of appeals for dealing with the one who grabbed my 9 yr. old daughter from the bus stop. He grabbs no more!!!!
yes, sue the counties and judges involved, there was and open arrest warrant for him yet they didn't do enough to go looking for him.
@@lcfflc3887 God that's BS!!
Judges need to be held accountable.
How the hell is he driving a truck with a suspended license?
That charge was in May of 06.
Because laws aren't being enforced and everyone knows it
@@robertbarncord6341 should’ve never been hired he already had a bad driving record
That look on his face is almost like he is questioning why he had that job as well.
@@BG-qx2st Most driving records don't go back that far, and he only had ONE item on his driving record.
And they let him drive

They’ll just change the business name
@@lld9888 THIS. Sadly, you win the Internet today with that very common Industry tactic...
I see idiots in large trucks driving to fast and stupid every day.
I also see small vehicle driving too fast and like idiot too.
@@Trawoysky .yep.
One reason why I avoid interstates anymore. They have to get that load there regardless of who gets killed. An ex-dispatcher once told me that if there are more than three late deliveries then they are fired. A lot of pressure in this day and age of "just in time delivery".
@@Trawoyskythis world if full off idiots 😂😂well some
Should commercial vehicles have breath interlocks on them?
Weed and cocaine aren't going to show up on a breathalyzer... SMH.
How the hell did he have a cdl!!!!
A good guess is his company didn't do random drug testing. And post accident testing is required so no way Hernandez could legally refuse to provide a sample.
I drove trucks for 38 years and probably every year, sometimes every other year we got picked for random testing and I was no exception.
Why would they hire him? In Tennessee you have to be licensed for that truck. Evidently in Texas you don't! Company should be held liable also!
he probably had the licence when he got hired.
Because it costs more to hire quality drivers
None of the problems in his background history, prevented him from driving a concrete pump truck, as are the thousands of ex-inmates that get hired to drive 18 wheelers, they can get the job unless the crime they committed was due to the way they were driving.
Company should be held liable as well, so many traffic violations. He should never have been behind the wheel of a rolling death machine.
Based on WHAT evidence??? Other than drug use the day of, what would keep him from having a valid CDL????
FJM CONCRETE doesn’t do background checks?
Many jobs are not allowed to perform background checks because of new discrimination laws. It puts many at a disadvantage.
Maybe, but these are misdemeanor charges. Keep in mind even most Felonies do prevent you from getting a CDL unless you are or have done terrorism or a felony that involved a CMV.
No english
Many construction companies love felons. Best workers. But they fucked up on this guy.
Sounds like Austin and their local DA
I was going 74 in a 60 a few weeks ago when a school bus passed me on the right, I never thought they could go that fast.

I have a hard enough time performing office duties on 3 hours of sleep, let alone operating heavy machinery. Jerry was taking assists instead of fixing the core issues in his life, and his luck of getting by cheating this way ran out.
R.I.P baby angel fly high 😢🙏🕊
I'm surprised the company hired him considering his record... or maybe, they didn't check at all, nor perform antidoping testing
Don't hire that attorney.
What is this man doing on the streets and how did he get a job for a trucking company with his history!!!! Clearly, they did not do a background check!
sue the concrete company also they are negligent for hiring this criminal
How tf was this guy driving a concrete pump truck ???? How??????
Cheap diversity hires!
He looks quite pleased with himself in the photo.
Sounds like a perfect resume for a professional driver with 10 tonnes driving down the road...wait.
Unbelievable! 😡
A concrete mix driver with a criminal record? All concrete mix drivers have a criminal record.
Idiot, I don’t have any criminal record and not even one moving violation on my license for 30 years!!!
Did the cement company not do a background check?
I'm not familiar with this company, but concrete companies are notorious for low wages for drivers. The concrete trucks are as heavy as a loaded tractor trailer and very top heavy. They need to be driven very skillfully. The concrete companies have to take whatever driver they can get because of the low compensation.
Two questions, nothing to do with the perp, himself: The Company? How long has it existed? How long did it exist under a PREVIOUS NAME? If the property had to change names, worrying about the *Quality* of their employees are probably low on the company goals...
Insane…I bet 70% of drivers are in one way or another impaired! Sad…
What about suing the state of Texas for that old outdated bus with no seatbelts? SMDH
What happened to the background check the cement company was supposed to do?
What does his criminal history have to do with anything?
Why actually he was allowed to be on the road?
Why did he even have a license? 2006? Sad justice system.
It's America. Driving is a privilege but our travel infrastructure treats it like a right. You can thank the 1950s American Dream for that.
Myself, my brother, and two of my friends have also driven on suspended licenses before by choice. Me because I changed insurance providers and didn't realize my new provider didn't notify the state, so the state suspended me for 6 months, my brother for letting his expire after moving out of state, one of my friends for doing 90 on a 45 backroad, and another for paying his speeding ticket but not paying the 11 dollar court fee (he lost his license for a year because of those 11 dollars, and he only found out because he got pulled over for performing a rolling stop and the cop said "did you know you have a warrant for unpaid legal fees?")
If you keep your nose clean there's no issue, but slip up once and you see how horridly unbalanced the justice system is. 11 dollars can revoke your license for 365 days, and you can't legally bypass it. You HAVE to wait. Let that shit sink in.
Knowing him personally is very weird to see him on the news. Dang, bro we told you to stop doing this stuff years ago.
Do you work for the company he drive for?
@@MrWiseinheart No. But I do know him personally. Don't wanna say my relation, but I am sure you can figure it out. We told him, we all told him to stop the drugs and alcohol. He would not listen and blow us off. I just wish his actions didn't take two lives.
@@KallenMalefic Well I'm glad you actually warned him, many people don't even do that👍, now it's all on him he can't blame anyone else for his actions.
I truly don’t think the pot was the reason for going left of center but If I were to guess he was probably trying to do a line of coke when he went left of center
Did he have convictions? Would that add enhancements?
how did he hold a CDL with all those previous offenses?? State Board huh?..who..DMV.
“Life” , right ? 😠
If you have a CDL , it’s serious business
so he had a suspended licence in 2006 but sounds like something happened late last year this his 4th case in 9 months no matter what his choices ended 2 lives
When the Supreme Court sees an injustice do they have to sit there and wait for someone to bring it to them for judgment?
When all these willie nilly judges stop things at their beck and call.
This company drop the ball on background checks.
99 to life no exception
And do more about drug use by truckers on the road.
For one thing, the company is held responsible for the actions of their drivers when CDL's are required. Thats Federal rules. We have to take random drug screening and any infractions while driving , either off duty or on, are required to be reported to the company. The DOT does keep track! There is no way this guy could have passed any drug screen or continued to bluff his way to drive the rig if anyone in charge had been doing their required duty! My past employer used to be careless about their hiring of drivers till they had a few that the rest of us drivers reported our concerns about, that got in serious trouble that cost the company serious cash and lawsuits! They didn't let me do road test anymore when I refused to pass some of those idiots! I think it finally got through to them that if they were to continue to hire those losers that their DOT fleet permits and insurance eligibility would no longer be possible! They already had the ins carrier cancel them and finally got a high risk coverage for many times more than what they had. It's always about those drivers lack of caring or giving a Damn about anything but their own selfish attitude. Any one with a bit of sense can master driving skills, it's the attitude that destroys things!
Low paying jobs attract this type of people
Why the h#### was he driving a commercial truck???
2006 was 18 years ago. Statute of limitations many places is 10 years. So long as you keep a clean record that long, places consider it a new leaf turned and grant you a second chance. I've worked with convicted felons on military sites who were machine operators who screwed their lives up in their 20s that were in their 50s by the time I met them. Some people do change. The tricky bitch is not relapsing.
No drug test company.
Come work with us and do your drugs and no good driving record needed
Why would you care about OSHA? That driver and company are under the FMCSA. Do you even know what that is? That companies have recorded histories and grades? That they have a website to look it all up? Guess not...
Sounds like a perfect case for the death penalty.
HHHHHHHHHernandez - is H silent
The worst state in USA is Texas. No one follows the rules while driving.
No way.... couldn't be.......
If there is a felony on there somewhere , the person who hired him might be in the mixer....

I have a background too, but I don't drive like that.

This is why school buses need seat belts. That has always been a big debate with pro's and con's. You got a bus load of kids with no way to avoid being flung around but yet trapped if to young to unbuckle. This is sad. Prayers to the families.

Arrest the people from the trucking company. Also they had a hand in it
There is no reason they cannot make thies busses safer.
The bus is amazingly intact considering it rolled over.

How about make school busses safer an make the auto companies that make them fallow vehicle safety standards. So kids don't get killed in accidents involving school busses.

The concrete company needs to be sued by the families of the deceased for not looking at the driver’s criminal record. They also need to face criminal charges for allowing him to drive.
It's not illegal to hire a criminal genius. Venting may have been a better option.
Sue all you want. It is unlikely the company policy covers more than 2 million dollars in damages. 😢
I was going 74 in a 60 a few weeks ago when a school bus passed me on the right, I never thought they could go that fast.
If you were on the freeway/interstate when that happened......you were in the wrong lane.
