    If you have to work 16 hours going back to home country might be a better option or go to other countries . But for families I would suggest consider home country esp Indians , trump or no trump we will not get green card in our life time

      If someone has to work for 16 hours a day to be more important for the employer, then they do not qualify for EB program in the first place. Let’s not pretend that there is no abuse of EB program whatsoever, right?

      Exactly, yes, there's definitely abuse of the program, and the government should/must fix and close all the loopholes. The problem is that due to a few people, a lot of people and families have to pay the price.

It is unbelievably hard right now to get H1b specialty occupation for someone with true skills who truly qualify for it in its original spirit. Because thanks to Obama - that person would compete with overwhelming amount of cheap labor in the lottery process, that petitioned by bad actors that are trying to circumvent the system. And the flood of NIW cases keeping the entire agency backlogged for years now doesn’t help either. Look at the USCIS sub Reddit and related NIW questions there and tell me in good faith all these people do qualify. Some of them can’t as much as read and interpret the form. Makes me sick.

      16 hours is bare minimum work that will be expected by the new administration from H1B visa holders. Unfortunately that is what it will take to stay in the US. But agreed going back to home country for us Indians is a much better option

    I wouldn’t encourage anyone to work twice as hard as colleagues who are PRs or citizens - that’s not a sustainable approach nor will it ensure visa approval by USCIS. Rather, ensure that the quality and value of your outputs are visible to management. That will give your employee a better I-140 or whatever case to present to the USCIS case officer and thereby ensure an interview. Do not adopt a desperation mindset - it won’t bring forth positive results.

    Once they get H1B and then they get H4-EAD for their spouses and with fake experiences and certificates and put their spouses for QA or into Project Management. Again one more deserving person's job gone to non-deserving person. I am wondering how companies failed to check their background verifications when they offer them Job.

    These law consultants often make baseless statements. I would never encourage anyone to work beyond their regular hours. If you work overtime without getting paid, it could be considered forced labor, which is a violation of labor laws and might even lead to deportation. Visa holders, please be cautious and aware of your rights.

    Excellent and timely video! H1B visa holders will see tougher days ahead. Next 4 years will come with a lot of scrutiny on H1B visas - renewals and new applications. Days of rubber stamp approvals are numbered.

    As a former working visa holder, what I recommend to qualified colleagues is to start a petition for a NIW waiver ASAP.
    A greencard is warranted If you get approved, what lifts all the burdens, restrictions and limitations you are subject as a non-resident alien in the US.

    If I have visa issue, my company will not layoff me but move my job with me to canada/London/India.. is this guy smoking something… work 16 hours to make company hire me than an American?       Shweta, Stop being bitter and work on enhancing your skills. U.S. is based on "perform or perish" and saying that the country would crumble without the H1B workforce is borderline delusional. The U.S will not put an end on H1B, rather just curb the numbers and will only process visas for highly skilled professionals.

    My son recently was picked to be laid off from a semiconductor company due the company has been making poor revenues in recent years!
    Basically, This company hired almost 95% of h1b and L1 engineers and mostly from India and China.
    My son has 7 years of semiconductor experience plus good education in electrical engineering. However, he has been looking for job over past 4 months and so far receiving 0 interview.
    Why American worker got laid off first and H1 b and L1 workers still have jobs?

    For H1B holders, there's no need to panic. Some people are spreading unnecessary fear. Speaking from personal experience as an H1B holder with a small consulting company during the Obama, Trump, and Biden administrations, the challenges varied.
    Under Obama, the situation for H1B holders was arguably tougher, with numerous visa rejections and people being sent back from airports. During Trump’s era, while there were rejections, the rates were more consistent with usual trends. I personally traveled multiple times, extended my visa, and progressed with my green card without significant issues. Under Biden, rejections have also occurred, but the key factors remain the same: associating with a reputable third-party employer with a clean track record and ensuring you have a valid project. That’s what truly matters.

    I posted before also i have many h1bs friends some are from 24 years one kid born in us another not another not born has to switch to f1 visa once he is in college and no more minor this is the truth and will never change
    H!B's from India long line long waiting will keep getting bigger and bigger (just look at the influx how many are coming and now illegals (Indians through southern border they also get EAD after 1 year though for limited time) they will be competing too}

    if any us citizen/GC complains that h4 is competing with him /her then h4 cannot be hired lot of h4 are fired on that too HR hires unless someone complains (Of course lot of big companies don't hire h4 at all ) You are saying new law new law new laws will come into effect it's a simple rule of thumb US citizen first green card second there is nothing called any third category h1b n h4 h4 is automatically terminated once h1b status gone lot of h1b lose their job h4 are working(that's illegal) and h1b pays the tax to gov sitting on bench that trump gov will clamp on H4 revocation will not be a surprise in trump administration

    Im not sure if nursing applies, but please, we need to stop bringing over registerer nurses. Its hard enough to find a good job and cerain peoples are running a systemic racism program and only promoting their own. Plenty of good nurses here in the USA.

      Outsourcing, yes. Offshoring, not really. That commercial arrangement doesn't align with privacy laws and "on shore" data retention policies. Add tariffs and American-only outsourcing requirements on top of that. Near-shoring and re-shoring is the immediate future.
