    The attorney won by abandoning all of the garbage arguments the Chille makes in his "legal education" in favor of actual precedence and rule of law.
    Competent counsel is always worth the hourly rate when the alternative is jail.

    I have never been more disappointed with a judge. There is not enough money to be an officer when you have to deal with these people. Just wrong and he will change, but not for the good.

    We have created a new job, one of chasing traffic stops, arguing for the offender and if necessary hiring a lawyer,(additional work for lawyers). Causing those wanting to become policemen to think “why should I want a job that buys me grief” and ties up our courts in frivolous clogging. I pray the Law scuttles this. We can do much better.

    I'm amazed you believe the judge was wrong to overturn the conviction.. what did chille do to warrant 6 months in Jail.. ??       It was insane how many people thought the judge was right... saying we need more brave judges like her... etc.. Wow... I watched the incident in full numerous times... Chili said about 3 sentences and backed up... Just because Chili comes off as an arrogant prick don't change the laws...

    This is so frustrating. How does this judge get to rule on this without seeing the evidence. "Because he didn't back up enough?" No. She makes it sound like the officer asked him a single time to back up, he backed up a few feet, the officer didn't think that was far enough so he arrested him. The officer asked him to back up a dozen times after he first backed up and he refused to back up any further.

      Unfortunately, since he was acquitted and granted his appeal, the time in jail will be negated because this will justify to him that he was wrongfully jailed. So it wouldn't matter anyway that his sentence was almost over.

    OMG, the results! It's crazy to me that the judge was able to make this decision without actually watching the video. It's also crazy to me that the prosecutor seemed so terrible. Or that he didn't bring the video as evidence or something. I mean maybe I need to go back and rewatch it, but I remember chili being all over the place! he didn't just back up and stay in one place. He kept moving around circling around the scene, getting closer, backing up for a minute but then getting closer again. What a terrible decision!

      The Prosecutor tried to hurry the process along to protect his police and a week later was telling us the "Evidence" didn't support criminal charges.
      Why?
      Because he was dealing with someone who could afford to call the bluff

    This bothers me so much. The officer never said there was a 21 Foot Rule. The officer said he learned in training that a person can close a 21 foot gap faster than an officer can get out a weapon. He didn’t say if he gets within 21 feet I can shoot him.

    at 10 feet away , with a phone in his hand, Chile was completely capable of taking video/photo of the driver and her license and stuff like that.

    I'm glad an innocent man has been freed!! I feel the footage was objective and the cop lied when he said "Chile did not back up." It was a blatant lie on the stand and please don't start with the he didn't back up far enough bs because a distance was never specified. The road pirate was called a "little doggy" and that made him butt hurt enough to initiate physical contact by putting hands on Chile who was backing away from him. Chile's behavior may not have been polite, but it was not illegal. I feel like obstruction and resisting are such vague charges road pirates can use these charges as an excuse to harass and arrest nearly anybody who is resisting because they know their constitutional rights.

      He uses the standard SOVCIT/Frauditor MO. The intent is create confrontations with LEO's to either A: get controversial footage that can be leveraged on social media or B: potentially get evidence of police misconduct and use that for a lawsuit or settlement in lieu of law suit.

      I think it's also about how quickly someone could run at an officer with a knife or other weapon. It takes only a couple seconds to close a 20 foot gap, I think. The police have a very real reason for insisting upon such a cushion of space when dealing with an unknown, obviously aggressive and mentally unwell individual while they are conducting official business. Today's decision was a travesty, the judge and the prosecutor were both utter disgraces.

      I can't either. I tried a couple hours ago on Our Nevada Judges channel, but noped out after two minutes and visiting the comments. Came here because I thought Mike's presence would make it more palatable for me, but I haven't even been able to press play yet. Knowing already from the comments what a botched job this was and what a potato the prosecutor was just make my blood boil. This case was never about filming or free speech and the prosecutor allowed this mess. Should be fired. My 7 year old could have done a better job.

      You are sadly confused. That cop broke the law when he arrested somebody for not breaking the law. There isn't a 21 foot rule, period. Supreme court has already said we can address our public servants even with a middle finger, and it's our constitutional right to do so. Supreme court has ruled that we can record our police while in public from a public space. That's a fact. So tell me, wise one, what law did Jose break? I can't stand him either, but what law did he break? The first judge had it out for him before the case was brought to court. She made Jose give up his phone, and made his lawyer give up his phone, but didn't make the prosecution give theirs up. She was biased from the start, and that's a scary judge.

    The idea that LEOs can't have a 21-foot rule as a rule of thumb about when a person is a heightened threat - that is ridiculous. That a police officer can't end a traffic stop to deal with a bigger threat is ridiculous. That an LEO can't protect the PID of someone they are detaining, is ridiculous. "Ma'am, please tell me hand me your DL while this guy films and gets your license plate number and puts it all on youtube. You have no choice, it's the law." That is ridiculous. I've seen Leavitt before and respected her. She just lost some respect for me.
    The case is not about the 1st Amendment. They argued that because the real facts of the case are indefensible. They argued the 21-foot rule, pretending that they DA was saying it was some law, because the real facts of the case are indefensible. It's all just strawman attacks. And they got away with it.
    Get ready for a rash of people harassing cops in NV for profit. And maybe someone that wants to hurt a cop to use that as camouflage.

    From my understanding this judge is a known flake on the bench. She didn't want to deal with this case and just let it go. She is 100% wrong. The state could appeal her case if they wanted to i guess, but is it worth it.

      @@OttoByOgraffey Nope she believed the nonsense that he was arrested for filming. he wasn't arrested for filming. He kept yelling and interfering with the police officer.
      Pretty much almost every lawyer that has looked at this has said he obstructed.

    His defense lawyer said Chilli didn't resist. It shows on the officer's body cam that Chili did push his arm away. Oh, well...he still has trial for the Thanksgiving incident in Vegas.

      Courts have ruled that if an officer is working outside his sworn oath, and making an illegal arrest, citizens are allowed to protect themselves. Did you hear about the one where a citizen was found not guilty after shooting a cop under self defense? The cop was wrong.
