You left it facing upwards. If you rotated the spline to be on it's side like the first example then you would have exactaly the same issue.

Эта проблема существует еще со времен kinetix 3d studio max. Меня тупо удивляет как за 20+ лет развития макса эти вещи ни на грамм не изменились. Что мешало добавить в настройки ик сплайна опции upnode по типу как в look at controller (как это сделано в maya). Загадка природы...

Dude, you dont solve the problem)) sorry, but if you rotate spline in same way, but after you done all your "fixes" - you will have same problem. you can really fix that by adding dummy in center of your spline and use it as upnode for all bones.
