I have Mexican residency....to do this you have to go to a Mexican consulate....you stand in a long line....they primarily speak Spanish...you have to present all proper documents....you then fly to Mexico to get a spot....wait for hours...answer questions....pay a 300 fee...take a picture then get 1 year RESIDENCY....then go back to Mexico within that year and do the 2nd part again and one time after that then you get Permanent RESIDENCY...not citizenship....that is Mexico's own policy.....get it? Citizenship is not just given its a long arduous process.....

The children will still remain citizens. Once the Supreme Court reaffirms its ruling, those children will still remain citizen. You need a Constitutional ammendment for that.

    • @FLMegan
      @FLMegan 11 дней назад +7

@Not_fit_to_be_President As the only country to have this law and based on the reasons it was originally drawn up, I fully expect the Supreme Court to remove the right as it no longer serves the purpose originally set in the 1800s. I do not see the process taking long, either. It will have bi-partisan support, a conservative court, and the pros for ending it out weigh the cons with the new agenda that the majority of the American population voted for. We are a merit based immigration system now as well. The law can conclude without the Supreme Court that parents who are deported must take their children with them, and so either way, it's going to be fairly impossible to stay.

According to legal scholars and historical interpretations, the framers of the 14th Amendment did not intend for it to grant automatic citizenship to children born in the United States to illegal immigrants, meaning they did not intend for it to apply to "illegal aliens" as we understand the term today; this is a point of ongoing debate regarding the interpretation of the "subject to the jurisdiction thereof" clause in the amendment.
    Key points about this debate:
    Original intent argument:
Critics of birthright citizenship for children of undocumented immigrants argue that the framers of the 14th Amendment were focused on securing citizenship rights for formerly enslaved people and did not intend to extend citizenship to children born to individuals not fully subject to US jurisdiction, like illegal immigrants.
    "Subject to the jurisdiction thereof":
This phrase within the 14th Amendment is central to the debate, with some arguing that it excludes children born to illegal immigrants from automatic citizenship.
    Supreme Court rulings:
While the Supreme Court has not definitively ruled on this issue, past decisions like "United States v. Wong Kim Ark" have generally interpreted the 14th Amendment as granting birthright citizenship to children born in the US to legal non-citizen parents. Even AI knows that Trump is right. 😂

About birthright citizenship, legally, it is not correct to say that this executive order will put an end to the right of the soil. It is rather a restriction or a limitation since this right remains acquired for aliens with permanent residence. Children born on American territory, one of whose parents is a holder of the green card, automatically remain American citizens according to the executive order. Even in this case, this restriction seems contrary to the constitution (14th amendement) and it will create stateless children or children without legal status in the country, even if, in certain cases, their parents would have entered and reside lawfully, even temporarily, on American territory.

In order to change birth right citizenship as far as the 14th amendment:
In order for Trump to be successful: This process involves approval from two-thirds of Congress and ratification by three-quarters of state legislatures
The 119th Congress begins Friday with Republicans in full control of the House and Senate for the first time since 2019.
Sen. Lindsey Graham, R-S.C., introduced legislation in September that would limit the scope of the 14th Amendment to exclude the children of undocumented immigrants and said Sunday he was working on a constitutional amendment to end the practice. In June, Arkansas Sen. Tom Cotton introduced similar legislation, co-sponsored by Vice President-elect JD Vance and four other prominent Republican senators, including Texas Sen. Ted Cruz and Utah Sen. Mike Lee.

The intent of the executive order is to get it to the Supreme court who can interpret it differently, he is smart, the Supreme court is right leaning.

Also, if the child was born in the Philippines 🇵🇭 and the father wanted to bring the child in the US, he must provide proof to the US embassy that he is the US citizen birth certificate. Also, the US citizen father of the child can able to petition the mother of their child. I do understand what Mr Trump trying to accomplish by this rules. The US immigration should continue following rhis rules since decades. Because the United States 🇺🇸 immigration in the Philippines 🇵🇭 is still following these rules, nothing has changed.

He can sign all he wants the constitution is bigger than him and all his actions will be challenged by a Supreme Court. Many presidents sign all kinds of moronic things, it doesn’t mean they will stay or pass. There’s a reason why the constitution is written.

@talitafranco and this is why along with bi partisan support, voters clear demand in mass numbers, and a conservative supreme court in addition to the intentions of the law and why it was originally written, this most confidently will be overturned and no longer exist. It's common sense. I don't think it will take long to pass and go through the process.
