I’ve learned a fair amount watching these civil court shows. My daughter is moving out of an apartment that has a crappy landlord and we suspect he’s going to try to gouge her for the cleaning deposit. so I believe I’ve got her covered in terms of what she needs to do, take videos of the walk-through-she will demand;)-, have everything documented, come to court with all paperwork because dammit I want her to win. Kinda excited 😜

You need to prove that you are leaving in same condition you received it. I live in Australia and have dealt with many dodgy landlords or agents and I got to know the rule back to front. Never lost a bond. One did try to take it off me, so I took them to the tribunal (like court but specifically for that) and I had 5 stat decs from people who helped me clean up after I left and all they had was one from their cleaner (who the court determined not a viable witness as they are employed by the agents and can be considered to be under duress to say what they say) and the cleaner was related to my ex husband. I won, they lost and then their representative stormed out of the court room like a spoiled brat. She was the problem as she was only 20 and had absolutely no idea.

Here in Florida he can apply for a lost title or he can take the trailer to a truck stop and have it weighed. Then take the weight slip to DMV and get a title and tag for a homemade trailer.

However you do need the title as proof you are the owner so the person you sell it to can bring the title to register the boat in their name. If what you said is true, then anyone could sell anyone else's boat and pocket the money and walk off.
My boat had a title, and when it was purchased it was a pkg deal! Now it doesn't work that way! You have to have a title for both boat and trailer! Hence I still use mine on 5 previous owners tag! The only way to title the trailer is to remove the boat, weigh the trailer, and take that information into the dmv. But that still requires a serial#, mine has been gone for 25 years!
I don't understand how you can sell something for which you don't have the 'title', which means it's NOT yours to sell, for all we know it could be stolen. I think the plaintiff should have been refunded in full. So according to Harvey at the end, if she didn't own it, she can't sell it, so how come the judge didn't see that...

I have bought, and sold vehicles with lost/missing titles. You don't need a title to buy or sell a vehicle, you just need a bill of sale. If you want to use the vehicle (or trailer in this case), then you have to apply for a lost title. It's not complicated. Regardless of what the ad said, if the seller doesn't have the title you know right away you're going to have to deal with it yourself. If you're not prepared to deal with it, DON'T PURCHASE IT!
Judge let her off easy, she didn’t have titles because she never transferred titles, meaning she owes the dmv for back registration , taxes and late fees all which had to be done before she could legally sell boat and trailer. She knew that and breached her part of the deal by lying about title. Plaintiff was right he should have been compensated for half of what he spent because defendant made deal with dirty hands. I would like to see the POS of a trailer he gets for seven hundred dollars.
Boat trailers are tricky. Trailer are usually longer then boat and some are custom made to fit the boat. Finding one may be hard and more expensive then a standard one. Would be cheaper to take the trailer and have it inspected and title as home made. I don't know why nobody checked into it as if he does, he just walked away with some cash.

In California the DMV dose not issue a title on a boat trailer at least if it has permanent plates. All that is needed is a bill of sale for the trailer.
All he had to do was tell the state it is a homemade trailer doesn't need a Vin if it's under a certain weight. End of story. The only downside is you can't renew online you have to go in in person because a homemade trailer won't have a VIN.
Those trailers are actually not that expensive you can drive anywhere in a boating community and see them for sale $200-1000, my godbrother sold his yacht and the guy didn't want the trailer, he used his own, he sat the thing at the edge of his property and it sold fairly quickly.

What the judge doesn't understand is the life of the trailer is determined not by time but where it was used and what care was taken. The one she looked at on ebay may be nothing but rusted junk.
So? It's on the defendant to bring evidence of what it's worth, one way being examples of what they are being listed for on the open market. Not to mention pictures or a mechanic's report on the condition of his trailer. She did him a favour by at least looking up the value of one herself.
