If I've been working for 13 years as my vision degenerates but now I am not able to keep up, will I fail the SGA test? I am planning to apply for my workplace LTD maybe next year and then SSDI shortly thereafter. I have about 5 degrees of vision, am nightblind, and I think my better eye is 20/200.
You can always check to confirm you paid in enough by logging into your mySSA account to see your current estimated SSDI benefit amount. SGA is used when SSA is evaluating a case where the Claimant is currently working. If you are earning more than $1550 per month, that "fails" the SGA test and you cannot be found disabled.
I have a hearing in Tennessee this week on Friday but on Monday the ALJ contacted me about amending my on set date to the October 1 2022 the month of my 50th birthday my questions was would I receive Medicare & would I have a 5 moth waiting period they said I would get medicare and no 5 months waiting period and possibly get retro pay but no back pay I first applied February 1 2021 is this correct
Without knowing the specifics, I can't give an answer, unfortunately. However, I will say the 5 month waiting period is unable to be waived if your case involves SSDI benefits. If you have an SSI case, there may not be the 5 month waiting period. Medicare is associated with SSDI benefits, Medicaid is associated with SSI benefits. I hope that helps - good luck!
It's not necessarily a 12 month wait, it's that you must either be out of work OR be expected to be out of work for 12 months. However, the time it takes SSA to review a file can sometimes take 12 months (or longer). As you can see in the webinar, there are stringent rules regarding disability and vision loss, so SSA does need to ensure you meet those requirements. I hope that helps!

i just found out i am legally blind, is it still a 12 month wait? :(
