      I'm sorry to hear about what you're going through! You can bring it, but it is up to the doctor as to whether they review it. Also, if SSA already has the report, they may have shared it with the consultative exam doctor.

    My attorney recently contacted me and told me they had reached out to the social security administration and they said they had not made a decision yet, my attorney said to keep an eye on the mail and to contact them if I get anything from the social security administration it's been about 11 months since my initial claim and my first denial came in August of 2024, I'm currently 52 years old do you think a decision on the appeal will come within the next few months? I live in Missouri where we're about half way on the scale of lengths of approval time compared to States where it takes longer or less time.

    So on the 6th month they don’t pay you for those 5 months of waiting in one lump sum?. Also, I’m a 100% p&t disabled veteran and was just awarded $1200 a months. I applied in June however, I become disabled in Feb 2022 which was the day I lost my job. Can I get retro pay from Feb 2022 or they only go back to the day I applied for the SSDi? Also, I was declared legally blind by one of the drs I saw as one of the ssdi appointments. I was told that if you’re legally blind, I should be getting a minimum of $2,000 per month? Any help is appreciated

      No, SSDI benefits are not payable for the first full five months of disability. SSA may go back to when you lost your job but if you waited until June 2024 to apply, the earliest you could receive SSDI benefits may be June 2023 (one year prior to the filing). As far as the amount, that is not dependent on the condition but it is based on what you paid in to Social Security while you were able to work.

    do you often see many cases of SSDI discontinued after age 60 but before 65 if person has been on SSDI "Medical condition not expected to improve" for years and multiple ongoing reviews consistant with that? Is there anything an SSDI recipient needs to do at age 65 to "convert" over to retirement from current SSDI?

      If it's entirely passive income, it generally would not have an impact on SSDI benefits, but would on SSI benefits.

    My husband was diagnosed with corticobasal degeneration. Once he submitted for social security disability he was admitted to the “compassionate consideration”. July 5, doctor in August. Payments start January. Took me almost three years 20 years ago.

      It is certainly a stressful process! You can try to reach out to your Congressperson to see if they are able to ensure SSA/DDS isn't waiting on anything additional. Unfortunately, there often isn't much that can be done to expedite the process.

      The doctor will likely not have time to review all medical records. You can certainly bring a copy of a medical statement from your doctor, but it may not have an impact on the CE report.

    I applied at age 59. The time frame for a decision is 400+ days in Texas. There is a good chance that when I decision is rendered I will be 60. Which grid rules would I fall under? Does it help or hurt me?

      It depends, SSA can always amend your onset date to your 60th birthday, and you would then fall under those grid rules. It is really only relevant if SSA says you can do medium type work, though.

      It's still the same! The cause of the condition isn't necessarily the tricky part, it's the medical records that support the limitations as a result of long COVID and/or chronic fatigue syndrome (and any other conditions that may be part of that!).

      He should reach out to SSA directly to apply! SSA will likely need to speak with him directly about his income and assets, as well as his conditions, to see if he may qualify. Also, if he has prior work he may be able to qualify for SSDI benefits, a call to SSA is often the best way to ensure he is applying for all programs he may be eligible for.

      It may not be applying for SSDI, it is likely applying for early retirement, which is a different claim as SSA doesn't need to confirm your disability - just your eligibility for retirement benefits. So yes, those applications are often processed quicker than the SSDI and SSI applications!

      It depends! They need to receive the report from the doctor and review it, then they may be able to issue the decision or they may still need additional information.

    Within the Grid rules processes, when education is evaluated, does the age of the education matter.       No, education is not necessarily used to determine skills, that is more the past work and skills gained from that. If an individual earned their engingeering PhD 10 years ago but hasn't used it in recent years, it may not have a significant impact on the case. If the individual performed work in the engineering field in the last 5 years, though, it is relevant. Does that make sense? And yes, the firm is able to assist individuals in NY and PA.

This led me to wonder if the same applied to education, because it is of importance to my particular situation. I am planning to apply for my workplace LTD maybe next year and then SSDI shortly thereafter. I have about 5 degrees of vision, am nightblind, and I think my better eye is 20/200.

      You can always check to confirm you paid in enough by logging into your mySSA account to see your current estimated SSDI benefit amount. SGA is used when SSA is evaluating a case where the Claimant is currently working. If you are earning more than $1550 per month, that "fails" the SGA test and you cannot be found disabled.

      It depends on what the medical records say. Medical records are a critical component to the claims, so depending on what they say, it may be helpful. Consistent treatment can be a factor but the fact that consistent treatment is sought is not alone enough to prove disability.

      At 72, he would not need to go through the SSDI process. It would be Social Security Retirement (if he has sufficient credits from his work history) or SSI (if he does not have sufficient credits and has limited income/assets).

      Yes, if it's easy for you to pull them. Otherwise, you can certainly just tell SSA about who you have seen during that time period and they should be able to pull those records (with a signed authorization from you!).

      They can! Surgery is not a requirement to be approved. It depends on the medical records and limitations.

      It depends! You will need medical records to show why you are unable to work. Sometimes cancer (even when in remission) can leave individuals with limitations. You may want an oncologist and psychiatrist/psychologist to support your claim.

      The link to the SSI application PDF is added. For the link to find an office (I think that's the second link you're asking about), it's often easier to just search that online!

      @@BeaconDisabilityPLLC Thank you for answering. No, I'm sorry I wasn't clear on that. I was talking about the url to apply online at their site. Can you post that? Also, are you sure that we can apply online only because everything I'm learning so far is that the online form is just a pre-application and then the SSA informs you of when your actually application interview will take place?

      The online application for SSI only is essentially a pre-application. This is (at least in part) because SSI has the financial restraints and the way SSA gathers that information is through an interview. Will add the current link to the SSI online application. It does change from time to time, so it may not permanently be at this location.

    Great video. I requested to have an appointment for the SSI application so I’ll be getting it done soon. I already started seeing a therapist and psychiatrist this past month. My question is how do you prove your conditions disable you? I mean I know the doctors records are for that, but is it as simple as just telling them how your symptoms keep you from working? Also, is it true you need 2 years of treatment to be able to get approved? I’ve heard so many different answers around. I’ve even heard of people getting approved during the first phase which is astounding considering how much I’ve heard about how mental health claims are hard to win.

      Thank you! Yes, it is in the doctor records and it's more than just you telling them how the symptoms keep you from working, but the medical professional often has to indicate what limitations you may have, and why. It isn't a rule that you must have two years of treatment, but the more treatment and records that support your disability, the better.

    I spent 5yrs "in the system" with an atty. But was never offered a federal court appeal. Is that offered to everyone?

      It's an option for most people but it is different from the agency appeals as it goes into the federal court system. Not all disability attorneys handle federal claims.

    I'm 63, due to increasing pain and weakness, it's harder to make contributions at work. Is getting disability at 64 easier, or anything over 60 the same bracket?

      Applying at 63 versus 64 will not make a difference in which grid rule may be applicable!

    I have had my ssdi ALJ hearing a couple of months back and am waiting for my decision, but in the meantime, I was thinking of applying for ssi to help pay my bills and keep me a float. Has anyone experienced this, and can you even apply for ssi while waiting for an ssdi decision?

      SSI goes through a very similar process as SSDI, it is generally not something you can apply for and immediately receive. There are some exceptions, but if you are under 65, it's a very similar process and is not likely going to be something that can help keep you afloat while waiting for the ALJ decision.

    if someone is collecting SSDI and will turn 50 in a couple of years could this help them keep benefits if they don't get knocked off by a CDR or something else in the meantime? I realize that even at age 50 there are still CDRs. I think of them as a curse really!

      It might! The grid rules apply to initial and CDR cases.

    I applied for ssdi 2019 2020 I was 64 I was denied 2 times then the pandemic started it was vary difficult and mid heating by a law judge. Can I still go back and resubmit my case

      You may be able to. It depends on where you were in the process, what happened to stop it, and how long it has been since it was closed. There are possibly other factors at play. You may want to reach out to SSA to re-start. If you are disabled and unable to work.
