A direct quote from the man who wrote the 2A. "Madison's ideas on philosophy and morality were strongly shaped by Witherspoon, who converted him to the philosophy, values, and modes of thinking of the Age of Enlightenment. Biographer Terence Ball wrote that at Princeton, Madison "was immersed in the liberalism of the Enlightenment, and converted to eighteenth-century political radicalism. From then on James Madison's theories would advance the rights of happiness of man, and his most active efforts would serve devotedly the cause of civil and political liberty." I and many others think its VERY clear the 2A was created to defend ourselves from tyranny domestic and abroad. The 2A doesn't state why it exists, making your claim that the judges interpretation is wrong, egregiously disingenuous.

      It makes me question the wisdom of the right to self-representation enshrined in the Constitution. There's plenty wrong with the document (gaping loophole in the 13th Amendment, anyone?), and that's something that I think should change. Some judges make it nearly impossible for defendants to qualify for self-representation by asking them a series of simple legal questions that they inevitably can't answer. There shouldn't be that disparity.

      You have the right to go to law school, pass the bar in whatever states you wish to practice in and, represent yourself. No one is preventing anyone from studying the law. Ignorance of the law is not a defense whether you're a layperson or a lawyer.

      That's because, in my estimation, everything the judge said went far above the defendant's kindergarten reading level. He was in over his head from the moment he said he was a living man and should've taken the L when the judge said "I can clearly see you are living ... most dead men don't talk"

      I understand what you are saying, but that isn't a legal argument, it's more of a conclusion (they are here, and therefore under our jurisdiction, so we may arrest them if we have reason). In theory, an entity that doesn't have legal jurisdiction can still submit a warrant for arrest (for example: ruclips.net/video/FReFA5HT-8g/видео.html ).

      It's not a wrong belief, if the court was temporally located somewhere between the original signing of the US constitution, and the ratification of the first 14 amendments. That would make the defendant either Bill or Ted, and the judge being the ghost of George Carlin. NOT.

      I believe anything the judge would have said, even if he spoke in layman's terms, would have went over his head because the entire time the Judge was tearing apart his arguments he was reading his sov cit literature and not really listening I don't think...or at least he wasn't giving the Judge his full, undivided attention!

      To further put this in perspective, the defendant got these charges on July 12th 2023, he’s had a total of 5 hearings on this matter so far, he’s finally gotten a scheduled jury trial date for June 25th (next month) 2024, which will be his 6th hearing. All this over a charge of driving while license is revoked.

    The judge did a good job by listening to his argument, then responding to it with case law and not just railroading him or cutting him off.
    This is a good tactic because it minimizes their success in appeals.

      Actually you are correct. I allow people to make a record while in my court. They may be right or wrong but they have a right. I took an oath to uphold the Constitution, I honor that by allowing people to trully have their day in court. I try to give people the benefit of the doubt, especially those in pro per. Maybe they have a good idea but just don't have the ability to present their argument well. So this is only a win for the Constitution and due process. Remember, that it is harder to hold an interrupting person in contempt if they are on Zoom miles away, just saying.

      An aside: I feel bad for a lot of people on Judge Middleton's "driving suspended merry-go-round" but this judge is right, driving is dangerous and some people just can't do it safely. I wish more US cities had better alternatives for people to still get to work and the grocery store etc, but sovcit BS is not the solution.

    As the mom of a 4 year old, he would fit right in at my house. But the more of these guys I watch, the more I think they’re all just immature, selfish people who feel entitled to do whatever they want without having to participate in actual society.     We all have a right to travel. Unfortunately this guy chose a method of travel that also requires him to have a driver's license. He can walk, he take a bus, catch a ride with a friend or stand on the side of the road with his thumb hanging out. He can even ride a bicycle or mount a horse....so long as he stays off the interstate. And of course he is free to travel in an airplane, once he passes through TSA inspections

      I agree, it is perfectly stated, but just to add, right to travel also means that a state can’t act like its own country and charge a fee for simply crossing its borders and also that each state acknowledges the validity of plates and tags from other states. Example being I’m from Virginia so I can freely drive in the state of Florida with my valid plates & tags, and Georgia can’t charge me $200 for crossing the border on the way there. If my VA drivers license is suspended and I get pulled over in Florida, a Florida court can still charge me with driving on a suspended license. These SovCit idiots think it somehow means they don’t have to obey the law.

    "A motor vehicle is something that's used for commerce" - No. A motor vehicle is a vehicle with a motor. A vehicle is a thing used to transport people or goods. Transport is the action of moving from 1 place to another. Therefore the definition of a motor vehicle in its most literal terms, is a thing that moves a person or item by means of a motor. Why can't sov-cits understand this?

      @@russellrider4565 In a sense, yes, though the threat is self-imposed (you waive those fourth amendment provisions by breaking the law, which is how you grant jurisdiction; remember that there is no jurisdiction without probable cause under any circumstances).
      Worth noting that, although not self-imposed, the same is also true of witnesses appearing under subpoena.

    I love the ‘I will fly an airplane without ever learning or training how to fly an aircraft. Do you want to be my passenger?’ Flying and driving require FIRST learning, SECOND passing a written test, and THIRDLY passing an actual driving or flying test BEFORE one can operate a plane or vehicle. Why? Because these are pieces of metal traveling at a high rate of speed that can KILL others!!!!!!!!!!! Like the judge says, you are free to travel on your FEET wherever you want to go.

      Because all the videos of it failing either means the person didn't stick to the script. Or, more importantly, the police/judge don't know the law, or are mis-interpreting the law and will be set straight by the appeals court/ state Supreme Court/US Supreme Court. And then they're set for life, being able to sue the police officers personally, the police department in general, the judge personally, AND the court system in general for the gross violation of their clearly stated rights.
      Now, you would think that the Supreme Court ruling that every state and municipality has been illegally requiring drivers licenses and license plates on motor vehicles for well over a century would have garnered some national attention, since they state that the Supreme Court has already ruled in their favor in this matter... but nope.
