I’m a bit confused why does a separate byelaw have to be created to make people pick up after fouling dogs (for example) why can that not be a blanket law which applies everywhere at all times?
The whole purpose of by laws is to allow local councils or companies to set the law in a way that works in their community. So the Enabling Act is the sort of “Blanket law” that sets out the powers and parameters. For example Parliament will say in the enabling act that local councils can fine people for not picking up after their dogs but Parliament will not say how much they can charge or which streets will be effected by this as that would be too much detail. The fines in Chelsea may be very different to the fines in other parts of the country. So a bylaw will allow for modifications to be made in each local area. Does that help?
