There are 2 laws to establish a special counsel. One says a principal officer (prosecutor or judge), already approved by the US Senate can serve. The other one expired. An independent non-government legal worker, appointed by the President and approved by the US Senate to serve. Garland foolishly though that since it expired, he didn't need Smith approved by the US Senate. But Garland has no authority to appoint a non-principal officer and non-government worker in charge of the special counsel.

The ruling might have some impact on the Immunity trial in Washington, D.C., but I don’t see it having any effect on the documents trial in Florida.
Smith should have to pay back everything he was paid as wages to prosecute his garbage cases.
You need to appeal that decision being it fell on party lines ( biased and prejudice decision)!
A president can always pardon himself before leaving office, so this makes no difference except for past presidents who did not take this precaution.
Thomas’s concurring opinion will be relied upon by judge Cannon in Florida as a basis to dismiss the documents case there.
I’m not a lawyer, but doesn’t the legality of the appointment of Jack Smith fall under the Chevron rule? The DOJ is a three letter agency. Jack Smith title gives him more authority than other DOJ prosecutors, is given almost an unlimited budget without congressional approval🤷♂️
