Because the Supreme Court is the place where constitutionality is tested legally. This is exactly how the balance of powers in our constitutional republic is supposed to function. And legal opinion is legal opinion and you have your opinion that the constitution is clear. As you point out those who wish to rule over us constantly pass laws and regulations letter contrary to the Constitution. When they claim that their laws do not violate the constitution then someone has to file suit. It's very similar to if somebody builds a shed that overlaps onto your property and you want them to move it and you show them the survey it's just like the Constitution and it's really obvious that they are building a shed on your property. Unfortunately all they have to do is say no we're not on your property and file a lawsuit or you file a lawsuit and then a judge has to sit there and tell everyone what they already should know. It's aggravating bulshit but that's how it works.

If they interpreted it decades ago, it probably wouldn't have gone in our favor.

@@user-pr3ho5pz4m But you see his point, this is the first Supreme Court that is even remotely pro-2A that we've had in living memory. If these suits had been brought in the 1960s, 70s or 80s they'd have ruled that is isn't actually a right and rounded up the guns.
@@Anon54387 to change the Constitution there is a formula. SCOTUS can only rule on the cases before them. They can set precedent but they can't change the Constitution. All they have to do is rule that all American citizens enjoy the rights of the 2A period. They sort of tried to do that with Bruen but got carried away with too much legal genius.

The point is that until recently we've had a Supreme Court that isn't friendly to the 2A so a lawsuit would've been a lost cause, and they would've ruled that it isn't an individual right. Even as late as the Heller decision we had 4 judges voting that it isn't an individual right and 3 in Bruen despite it being in the Bill of Rights.
I live in California, where none of this matters. Gavin Newsom blatantly ignores the SCOTUS.

Here's the problem: What is an "assault weapon?" It's a made-up term, and some legislation works by naming specific firearms while others work by naming "features." The SCOTUS will NEVER say that NO semi-auto firearms can be banned -- because they NEVER write "sweeping" decisions (and those are what is needed, and those are the ONLY ones we gun owners will accept). Nor does SCOTUS ever make VAGUE decisions. The best they will be able to do is to say a specific law is invalid because you can't ban all types of firearm, etc. And THEN states will just modify their "bans" accordingly. Perhaps they will simply say "pistol grips" aren't allowed (which will essentially ban EVERYTHING we want) -- and they will say they have banned only a "minor" piece of furniture. And then it will take another five years to have THAT challenged, etc., and it will go on for DECADES like that.
Jared, thanks for the news, my friend. I really hope that SCOTUS accepts at least Bianchi v. Brown (MD) and at least 1 of the Illinois cases, giving the other 3 cases back down to the circuit, telling them how to do it "correctly!" These inferior courts and state tyrants are getting old!

We are not going to get a fair ruling. There is no way the Deep state is going to allow the Bruen ruling to stand as it is.
I bet the SC will screw it up. OR if they don't manage to screw it up (which they probably will), the states will ignore the ruling, or appeal it. Ad nauseum. I'm tired of this.
Until jurists who not only violate the Constitution and do not abide by SCOTUS rulings are criminally prosecuted, convicted, sentenced and removed from office, they will continue their criminal activities. They need to be criminally held responsible for their actions.

If any of these cases is taken up, and the SCOTUS decides the case according to Heller and Bruen, all 50 states must comply.

They did that with the magazine ban to Benitez, but the 9th overturned Benitez again, totally ignoring Bruen. The 9th is playing all kinds of sneaky delay games to keep it from going back to the Supreme. The Supreme needs to start doing summary reversals on these cases.

I see options two and three in order to drag it out even longer.
The problem is that most of them are interlocutory appeals, and SCOTUS doesn't usually take interlocutory appeals. PLEASE EDUCATE PEOPLE AS TO WHAT THAT MEANS. Eventually they will WHEN THE CASES ARE FULLY PROCESSED BY THE LOWER COURTS.
And yes, PLEASE SUPPORT THE LAWSUITS!
That said, the fact that they distributed all 5 and do have a circuit split may increase the possibility that they take the cases.

You forgot the 4th option: Do nothing.
There are currently at least 3 cases before the Supreme Court (23-374 Garland v Range, 23-683 Vincent v Garland and 23-6170 Jackson v United States) that are all challenges to the constitutionality of 18 USC 922(g)(1).
All 3 cases have been to conference.
None of the 3 cases have been granted certiorari.
None of the 3 cases have been denied certiorari.
None of the 3 cases have been GVR'd.
All 3 cases are in limbo with no action of any kind being taken.
It may be premature, but I'm getting my hopes up.
If they didn't want to settle this for freedom, they could have simply ignored the cases.
The other way to look at it is that they are timid now because of the loud disapproval of the left over Bruen and are looking for a way to water that decision down. John Roberts is actually rather spineless, look at his "reasoning" in the ObamaCare case, that's some serious wishy washy mental gymnastics.

I don't expect any RKBA allowances the police, public/private security personnel and armed government agents don't have; but neither will I accept restrictions they are not required to follow. "We the people" face the same threats they do and "we" face them first. If "we" don't "need" it, neither do they and if they must have it...

I live in Maryland. The irony is we can still buy certain “assault rifles”. We can buy an AK-74 because it isn’t specifically mentioned in the law, but we can’t buy a 7.62x39mm AK. Does anyone really feel safer because law abiding citizens are restricted from buying some rifles but can buy other rifles that are equally lethal? It makes no one safer. It only prevents collectors from buying the exact rifles listed in the law.
