    The worst question was when they suggested that the abuse he suffered was all in his head and he actually wished they happened, that was the only time I saw Erik actually got briefly angry (rightfully so)

      The prosecutor was trying to argue that on the night of the shooting Erik was actually home all night, saw his parents ordering Chinese food, and waited for them to be comfortable in the den before completely surprising them by shooting them. The prosecutor is trying to make it seem like Erik & Lyle were “lying in wait” to commit the shooting; when in fact, Erik said multiple times that he wasn’t home that entire Sunday and only came back late and the shooting happened very shortly afterwards due to the argument they had with the parents. So he didn’t know at all what they had for dinner.

    Yeah, Erik lied and told the cop his parents we going to order Chinese food the night they were killed. That was his reason as to why the phone was left behind the pillow. Also, he was not supposed to be home that day. Therefore, he wouldn't have known what they ate anyway.

      Those lies show premeditation but the prosecutors at the first trial were weak and lacked the confidence to state to a jury point blank about BOTH brothers’ proven propensity to LIE and PREMEDITATION. Any defendant with a preconceived mafia hit story has already thought about the crime and WHO they want to blame the crime on BEFORE they called 911 and offered up the mafia as their escape goat. I understand where this prosecutor was going but he is BORING me and not confident in his prosecutionary abilities. Erik ran all over him by just being defensive and he bowed down instead of showing Erik’s high propensity to lie even when lies were not needed

    I hate where these attorneys add in their own narrative and demand a yes or no answer. Erik said that the sentence in question was a hypothetical answer when being asked about why the phone was where it was. It wasn't a lie.

      In this particular clip Erik was NOT lying. Erik testified for over a week. When Erik lies he always repeats the question to buy time to think of a lie. When Erik fake cried he never had any tears. THIS SMALL clip is one of the times Erik was being truthful

      Erik says he wasn’t home that Sunday and only came back shortly before 10pm, right before the argument with his parents occurred that led to the (spontaneous) shooting. The prosecutor, however, was trying to use the statement about “maybe they were ordering Chinese food” to imply that Erik must’ve been home that night and waiting for his parents to settle down in the den in front of the TV and plan to shoot them… and that’s how he supposedly knew that they ordered Chinese food. It’s a way for the prosecutor to imply that Erik was planning the whole shooting in advance.

      It wasn’t really about the Chinese food. The prosecutor’s point was that Erik told the police his parents were going to order food, and the prosecutor is trying to use that statement to show that Erik was home that night and waited for his parents to get comfortable on the couch before bursting in and completely surprising them with the shooting. When in fact, Erik testified the whole time that he wasn’t home all day, came back shortly before 10pm, him and Lyle had the argument with their parents, and the shooting then happened immediately & spontaneously. But the prosecutor is trying to make it seem to the jury like Erik was “lying in wait” to kill his parents and that’s how he knew what they were having for dinner.

    the prosecution really trying to imply the boys hid the phone so kitty or jose couldnt call for help but cone on.
    The murders were over in SECONDS .. thete wasnt time to react. Aside ftom Lyle's claim that jose said "no" before he was shot

      Girl I STOPPED reading as soon as you LIED that the murders were “over in seconds” because there is IRREFUTABLE proof that After breaking into the den and firing 13 to 15 shotgun blasts, with Lyle shooting his father in the back of the head, the mother, incredibly, was still alive. The brothers went outside, reloaded, and came back in.
      “I just reached over and I shot her close,” Lyle testified. An autopsy report indicated Kitty was blasted in the left cheek, the gun barrel on her skin.
      WHY do YOU feel compelled to LIE. I am certain EVERYTHING I stated and cited YOU already KNEW so why do YOU lie when there are irrefutable FACTS and the brothers’ OWN testimonies to disprove YOU?

    I don't understand this question. The prosecutor tried to catch him in a lie, but he immediately admitted to lying to the detective so what was the point of badgering him like that? Question asked and answered ... move on. This is the same prosecutor who wondered whether a ferret barked.

      Sweetie this is just a very small snippet of Erik’s week long testimony. WHEN Erik is lying he always repeats the question to give him time to think of an answer. When Erik is being truthful he answers right away. Whenever Erik fake cries there are no tears. Erik’s body language is defensive when he is about to lie and that is always preceded by Erik repeating the question. REMEMBER the eye glasses are NON-Prescribed and just for show just like his court outfits were just for show. Erik was an aspiring model and actor. What is most important in this small video is Erik’s ability to “make up a lie” for no reason. The prosecution was too weak in ability to make a jury alert to the aforementioned factors but that does NOT mean their intent was misguided.

      @@Swasgg13Well, arrogance is WHY Erik was UNABLE to convince an entire jury to vote in his favor at BOTH trials. A defendant’s JOB is to convince an ENTIRE jury to vote in their favor. That REQUIRES trust, honesty, believability l, AND corroboration

      @Umm in the first trial it was a hung jury meaning they couldn’t come to a unanimous decision and the reason for this was because the MEN on the jury weren’t convinced by Erik for 2 major reasons. 1. The men back then couldn’t understand or believe the concept of a father SA his sons and were very pro prosecution, one of the prosecutors on the case literally said “Men can’t be raped because they lack the equipment to be raped”, which is completely false and so cruel to say when I’m sure that there were many men back then who would have been secretly abused but never came out due to shame, which is why the brothers never told anyone to begin with. With that mentally it would be very difficult for anyone especially men to be believed.
      2. The Men on the Jury assumed that Erik was gay and because overtime Erik didn’t fully ‘resist’ his father’s acts on him they thought that Erik liked it and wanted it to happen due to his sexuality, which again is such a stupid assumption to make because sexuality has nothing to do with SA and it had nothing to do with the crime.
      As for corroboration, if you go back and watch the entire trial properly there is a lot of evidence which corroborates the abuse Erik and Lyle faced by Jose, by defence witnesses, n*de pictures of the boys when they were children, Erik’s unexplained throat injury when he was 7 years old from which is around the time the SA started happening and testimony from their cousins who they told as children and more.
      Although there was never a tape or recording of what Jose was doing because generally people (especially children/minors) who have gone through SA normally don’t always have direct evidence there is so much corroborating evidence from 50 defence witnesses, photographic evidence and the medical record to prove that it did happen.
      Erik did his best to testify how horrible everything was for him and be honest, he physically looked uncomfortable many times during the trial as he was recounting everything. He was also medicated with anti-anxiety medication so that his emotions could be regulated because he was known to break down emotionally more compared to Lyle so I understand how frustrated and tired he was at the questioning from Kuriyama because he wasted so much time asking the same questions over and over again.

      @@theyluv.luji21 Erik’s JOB was to was CONVINCE an entire jury he was in such imminent fear of BOTH parents when he killed them that he had NO other choice and this STANK attitude he is giving does not convince a jury he was this weak victim BOTH parents were abusing extremely every day. He is talking about not even being home as if he was not in captivity and chained up in the basement like he should be SAYING. This was a criminal case he was charged with TWO murders. He needed to be saying he was there, chained up, in captivity, etc EVERY DAY by BOTH victims so that the entire jury could vote in his favor.
