      @@deannagrrl there have been several lawsuits about describing cut up chicken breast as chicken “wings”, but I think most courts have found that basically we use a lot of made up or inaccurate terms to refer to dishes. Ladyfingers are not actually made by cutting up women’s hands, and Rocky Mountain oysters definitely have no shellfish.

      The SCOTUS decision is quite an interesting one because underneath it lies something troubling., and I am sure the comedy hosts will be on it as some point.
      What is being dealt with is if a product can be sold at a specific level of quality but not be of that quality and the company be legally safe from any repercussions for selling inferior quality products.
      So to get this done a nonsensical boneless wings case is pushed forward to set the stage/precedent and then later and possibly on a quieter fashion, other cases would be put forward using the boneless wings as the got to case in order to reduce the quality of other products being sold.
      For instance a water supplier company could then claim that they should be able to be protected for supplying unfiltered water to areas where they are paid to provided filtered water and their justification being that not all filtered water is expected to be fully filtered therefore the quality of their water products can be lower then what they are paid to provide and be protected by the law to do so.
      There would then be a slow expanding of other adjacent companies looking to lower the bar for their products and in each of them the end consumer is the one paying the biggest price, as the consumer would still be forking over the money but would no longer be guaranteed the product of a quality comparable to that which they paid for and were expected to receive.
      So to anyone confused if this is a bad thing for the consumers, it most definitely is a bad turn of events!

      Some guy choked on a bone when he was scarfing down boneless chicken served to him at a restaurant. The bone was huge, like an inch and a half long. Hard to miss if you chew, but it's false advertising calling them boneless. This must be a ruling in that case.

      Rubbish. You might reasonably expect that bones have been removed. To expect that process to be 100% failure proof is unreasonable. Were' talking about the US food industry here, not a Swiss watch manufacturer. However, saying "Boneless is not bonelsess" is not the best way of communicating this.

      @@SebBrosig I think some people are confused because there have been at least 2 chicken wing cases that I am aware of. One is this case in Ohio where someone found bones in their "boneless chicken wings", and another in Chicago where "boneless chicken wings" were made out of chicken breast meat. Welcome to the USA, the land of endless lawsuits.

      So to anyone confused if this is a bad thing for the consumers, it most definitely is a bad turn of events!

    That's as bad as the Michigan SC ruling that a tire rotation was "performed" by switching the tires. Finger tightening the lug nuts was just an ooopsie, and in no way is the business liable for the wreck, with injuries, that resulted.

      OMG That's so wrong! I bet there's a federal remedy available. Who regulates that stuff federally? The NHTSA? People have the right to expect a qualified tire service technician will tighten their lug nits, and tighten them to the correct torque. Maybe under state law that's not the case, I dunno. Just wrong. The chicken stuff in OH is all covered by federal law, so the state ruling has little meaning. State supreme court justices are often elected, so their rulings can be a little squirrely.

    Did the Ohio court not wonder why bother putting boneless on the package if there's neither requirement nor expectation (according to the court) that the contents of the package actually be boneless? Whole thing could easily be solved by instructing companies not to mislead consumers (rather than basically saying that consumers who believe packaging are stupid, which is essentially what the court did)

      Fortunately all of that is federally regulated. I'm not sure what that case was even doing in state court. The FDA regulates most food products sold in stores, but I think the USDA regulates beef, pork, and eggs, but not chicken? (Or is it chicken but not eggs? It's something silly.) Something like that. I also think the USDA regulates restaurants, though state health boards are the primary regulators there. It's all divided up like that, even if I got a few (or most) facts backwards, and I'm sure I did. (Embarrassing from someone with a PhD in nutrition!) It's all federal. And it's the Federal Trade Commission that regulates truth in advertising, so all the important stuff is federal. I don't think we're in imminent danger of this silliness escaping Ohio, nor do I think (just a hunch) the feds will allow their state supreme court's ruling to stand - if it's challenged in federal court, and if the case really comes down to the silliness Stephen described. (C'mon, he gets some license for comic effect. Even if it's a bit slanted, it's still funny! That's what the Meanwhile bits are for!)

      Some problems:
      1) The Subprime Court has eviscerated the Chevron deference, meaning the experts are now suddenly less expert than judges, and the necessary wiggle room in laws establishing federal regulatory departments has been redefined as "If they didn't say it explicitly in the law, then the department has no jurisdiction in the matter."
      2) The penalties for corporations violating federal rules are a joke in this age of mega-corporations and hyper-monopolization.
      3) The FDA and most other inspection agencies have been chronically undercut, understaffed, and underfunded by "special interests" and "donors".

    The only way that chicken wing case makes sense is if it's a ruling on degree, e.g. you can still market dates as "pitted" even if one date per container still has a pit inside.
    The only other option is that this case exemplifies the state of art in legal rulings, which SCOTUS has so aptly demonstrated over the past few years.

      I believe this to be a manufactured legal precedent, in which other industries and then lower the expectations and get legal protection for products that fail to reach the standard at which they are sold as or are commissioned to deliver to the end consumer.
      It has an offset in which safety regulations could easily start being crunched one after another and the end consumer find themselves unable to take action for any damages of injuries suffered from being sold a product not of the quality they paid for.

      Based on other news sites, the actual Ohio case involved a bone fragment that was left behind during the 'deboning process'. Much the same that you can still find some small bones in fish that have been deboned, or in my own personal experience a fragment of a fish hook that I cracked a tooth on. Anyone remember back in the 80's when a person was expected to chew carefully?

    The vegetarian line is accurate. My only night in Chicago, all I wanted was a deep dish pizza, and I ordered a margherita, which I'm pretty sure is meant to be the same ingredients no matter where you go. But this one came with pepperoni.
