      Its how they offer such "deals" with new builds, and they try and rope you into using their solicitors etc etc. I looked at new build houses, decided not to bother and bought a 1960s house in the southeast.

      It's not just new builds. There are some people who have bought their council flats on leasehold and were expected to pay for improvements of other flats on the estates they were living on who were only renting them. It's disgraceful that it's not just Housing Associations that do this. It's to save the council from paying out themselves for properties which need repairing in Brent North.

    I purchased a flat in 2017 as a 24 year old first time buyer. I was told that I'd have to pay a service charge of £917 a year....my first bill was over £2000! How can it be legal to mislead people like that

      It's unfair, it's predatory, but it's the law.

      People should always read the small print and also those charging such a service charge should be able to justify the size of it and tell you what to expect for it. I believe it's possible to take them to court or a tribunal if they seem to be overcharging. Flat owners would probably need to club together to do that.

      sadly its not being mislead, charges increase and more health and safety requirements come in. The solicitor should have very clear about the obligations you were taking on, and no guarantee what costs would have been in the future.

      Jesus. When I bought a leasehold I was paying 1600 in service charges and 150 on ground rent. It's absolutely nuts. ​@@teryd5672n

    Someone working in financial services buys a leasehold flat and takes on all the liability. Leasehold is a scam, always go freehold, and never buy a flat, service charges, and renewing the lease just isnt worth it.

      @@fluffy-puffy-puppyI live in the south east. 3 bed house. I moved from the north due to lack of jobs in my industry (Software developer). The country is a small place these days, personally I would move if I could not buy a house, or job's salary didnt keep up with living costs

      I think you mean "not everybody can buy..." first things first, I never said everybody should buy, but wouldn't these people be better of renting, rather than buying leasehold? Which just seems like renting forvtge long term with all that liability that normally a landlord would take on?

      Independent quality control was removed by the Tories when they took it away from building control in local councils and allowed developers to hire their own building inspectors.

    So many of the leasehold stories take place in places like london and involve professional people you would expect to have more common sense than to take on a leasehold property.
    I was taught by my parents growing up, long before i ever considered getting my own home what a scam leasehold property is. That was back in the late 80s and when i was a teenager.
    It's shocking that even today there are lots of people out there who are completely unaware of what leasehold property is or that it even exists.

    The cost of repairing a roof leak should not cost £170k. That would be a complete new roof covering and if relatively new should be under the guarantee. They should obtain a quotation for repair and challenge the owner of the original price. I suspect then you could report the difference to the Police as extortion and fraud. That’s what I would do.

      The company who owned my muming laws flat did exactly the same kept changing..for an example I got a price for a complete new flat roof he quoted eleven thousand pounds..and the owner said we have our own builders and it went to court but we lost several times for different jobs but just losing money..anyway the company got the flat roof done on the flats..and cost sixty grand...my poor muming law was so upset we have to help her to pay she only had fifty thousand pounds life savings..absolutely diabolical disgrace..all lease property it there for people stealing money from you...its time up for lease holders..its gotta stop...

    It's not just the Leasehold system that's a scam, many Freehold buyers also find themselves bound by Restrictive Covenants on communally owned areas of the estate, in effect, tying them into a Leasehold agreement where the law gives zero protections. Both these areas need to be dealt with in any legal reforms.

      Conveyancing solicitors should be looking into such things and advising their clients (the buyers) before they buy. I suspect the above scenario happens in properties that were once owned by public bodies such as locals councils and are a legacy of the 'right to buy' legislation.

      I will vote Labour as of today as they are the only ones committed to abolishing the leasehold scam, but I am keeping an open mind. What is Reform's plan on the leasehold scam? I've heard nothing from them.

    Very few super rich individuals own most of the flats and houses and nowhere is left to live. Those super rich rent them out under leasehold title. Ordinary people buy them as leasehold properties since they need somewhere to live and the super rich continue to benefit from the system. This is my understanding. If I am wrong please someone should explain to me...

    I live in a flat which was my first property to get my on the ladder and pay nearly 2k a year on service chargers - these prices went up twice last year!!! i dont mind paying a small fee but not nearly £200 a month as well as paying nearly £100 as well on building insurance this is on top of my mortgage and most likely the price will go up this year and not down!!!

    Another thing that catches people out is if part of the block of flats is owned by the council. If they decide to do repairs, like a new facia for the building you get hit with a bill for part of the work.

      Because it is a tangible asset, one that is quite viable provided one knows what is doing, and because it can be way cheaper than renting. I love my flat! Made loads of money on it. Read the documents!

      Naive millenials like myself, desperate to get on the property ladder in the South east. I bought my flat on the assumption that service charges were ~£1k a year, only for this to spiral to £3k in just a few years. Almost all flats are leaseholds and houses in the South East are just completely out of reach. 😟😟

    The part buy, part rent was also a scam. Originally it was supposed to be a way to gradually increase your share until you owned it but the housing associations kept putting the rents up and were only allowing a maximum percentage of 50% to 75% ownership so you never got to own it in full. As big a con as "Time Share" properties.

    Britain in 2024: flammable cladding was allowed on buildings, and is STILL up on buildings, because the developers and owners are arguing over who should pay for it's removal. Even though a fire in one of those buildings killed 72 people, tenants around the UK continue to live in deathtraps (and pay handsomely for the priviledge).
    I won't even touch leasehold. I'd rather rent. We also need to discuss shared ownership, as there are pitfalls to that too. Many schemes have small print designed to catch people out, and keep them trapped in the home they signed up for.

      If you rent a leasehold property, who do you think those costs are borne by; the landlord? Hardly! He/she passes on those costs to tenants in terms of higher rent to cover their payments to the leasehold company.

    Simple solution. The company that sold the lease, pays the bill for repairs on demand of the lease holder. He then seeks compensation from the builder/developer.

    Leasehold will never be scrapped. Who is going to pay the billions in compensation to the 1000s of landlords, will it be the tax payer? if so it amounts to a benefit for the lease holders! Why should the tax payer be expected to pay off a landlord of a block of flats at £6,000,000 each flat in Phillimore Gardens Kensington? and that's just one address. The Duke of Westminster will be making an appearance at the House of Lords whose lease hold property value is £9.9 billion. Don't be daft lad! Electioneering!       actually Andrew you are spot on no one in their right mind would ever bring it in ..because at the end of the day when the landlord sells of his hers property's I.e houses flats..evan mobile homes...once he she did this they like to line their pockets with a regular income I.E buy making the leasehold pay..and that is the only reason this will always get a no from our courts..

      No compensation is needed for landlords. If we establish that leasehold is illegal and we abolish it, they have to be thankful that law is not retroactive. They make money selling the flats, nobody is taking that away, we are just scraping the racket of selling the renewal after 50 years.

    Leaseholders can get the Right To Manage RTM if the majority of the leaseholders agree they can then arrange their own buildings insurance and carry out the maintenance and repairs to the house or block themselves.

    Replacement windows for flats on the Hallfield Estate W2 well over £100,000 pounds. And about 15 to 20 years ago was around £20,000 which was meant to be carried out years ago.

    For anyone who believes this will change by Labour, the same question as the MP said, who is gonna pay for changing the contracts of 5M people? Nobody. Best case scenario is the newer buildings will not be leasehold. Existing owners, good luck to you!

    What i dont understand is how the work/ build got signed off in the first place. Theres been a massive drop in post work inspections. The system is flawed, the devs get away with murder.

      Because the Tory government put an end to independent building control inspections of the work (by local councils) and allowed developers to hire their own building inspectors. Developer hired building inspectors want more work from the developers so let through sub standard work.

    I have a leasehold property not a flat but what is classed as a residential Park Home and these are being made exempt from this new legislation simple because it not recognised by the government as property because it is of non-standard construction. However I live there, pay full council tax, water rates and so on like any normal house yet its not property.. Straight away there is the loophole for developers simple build sites with park homes instead of normal homes and they can carry on leasing them what's more is they are allowed much shorter leases like just 15 years

    I am a leaseholder - flat in Manchester. A couple of years ago I thought that I would find out about the head leaseholder. After going on the Net and finding out how other leaseholders reviewed them. I was shocked, page after page of very disgruntled people. ( certainly dozens, could be in the hundreds) I now find / feel that those above me in the scheme of things are scoundrels. This is very worrying. I paid good money for my flat, and I want to keep it. Is there any help out there?

    Contrary to what Gardiner says here, there are still examples of leasehold overseas. Mostly in Singapore, HK & Malaysia and there are similar systems in other countries in the region too.

    Another rediculous scheme in property sales is a seller wanting to place "overage" provisions in the contracts. Meaning they profit from any development you may make to your owned property.
    Other positive and negative covenents are also rediculous, where the seller can determine what has to be, or cant be done on your property.

    I heard this before and it fits most. The banks are gonna start to buy more homes building new builds. These homes will not be for sale only rent mortgages are risky why bother when they can just rent it and dine works better for the economy

    Parliament will never address this either red or blue, why, because you can bet that pretty much every MP in this country has at least one and in many cases several properties they own outright and the leases on those properties are another cash stream for them to exploit. I say this with a high degree of confidence because for a substantial tract of the British population of a certain age, with the means to do so (myself included) owning and letting out a second property was encouraged by the right to buy legislation passed by the Conservatives back in the eighties. Prior to that, the vast majority of Central London properties were council or Peabody trust flats, including those my grandparents lived in, these days they have all been traded through estate agents for what would once have been considered eye watering sums of money. My paternal grandmother lived in a state of the art for its day sixties built high rise block in Pimlico. A google search reveals that currently 42 of these flats are leased, I was surprised it was not more and the block was returned to the council in 2019. This block is barely 15 minutes walk from Parliament and I am confident that many of those 42 leased properties will be used by our MPs while they are in town.

    The problem is definitely selling short leasehold which is now common, it's nothing more than long term rental with the liabilities of a homeowner.
    Leasehold used to commonly be 999 year leases, and peppercorn rent, not 125 years or less, with extortionate groundrents and you could buy the freehold element seperately sometimes. It's an appalling device introduced by developers and bankers to take your money and leave you with no asset at the end. They would say it's because people need housing, and they cant afford it because house prices are about 10 times the average single person wages so they simply find ways to facilitate people having at least some security and not living year to year as a renter and terrified of what happens when they no longer work and cant pay rent.

    i bought my house under the right to buy then found out i have to pay £150 per year to have to grass cut from the housing association and i have still to ask them for permission to do anywork on my property ie extensions even if its permitted under planning rules they have the last say anyone who purchased there house from the council before the housing association took over are not under these restrictive covenants or grass cutting payment which was sneaked in a few years after they took over
    I'm just praying this is not going to put potential buyers off when i come to sell in the next couple of years just another form or control and lease which needs to be changed but the conveyancers claim is normal and wont cause problems in the future sales

      I think they would have to get the permission of the freeholder to make such changes or the freeholder would be the one who needs to do it. Consult the lawyers.

    Not sure how people can't seem to grasp that the freeholder is the owner of the land, the leaseholder is just leasing just as a tenant would, only thing is their lease period is guaranteed increasing their security of tenor. Don't buy without knowing all the details, don't cry about it and expect the Government to change the law to benefit your situation due to poor choices....all sounds a bit socialist.

      Did you know 45% of the rental homes owned by politicians? Leasehold etc is big profit maker for politicians, it will be interesting to see if the leasehold reform passes and becomes law so that i can extend my flat lease which is 73 years lease to 990 years!

      hes not wrong. even freehold property owners still have to pay property taxes because of the feudal split title system.
      Even Freeholders dont own the land they just own the title to the land. Its how they can force you to jail or take the property if you dont pay your feudal Lord his taxes.
