The part buy, part rent was also a scam. Originally it was supposed to be a way to gradually increase your share until you owned it but the housing associations kept putting the rents up and were only allowing a maximum percentage of 50% to 75% ownership so you never got to own it in full. As big a con as "Time Share" properties.
Britain in 2024: flammable cladding was allowed on buildings, and is STILL up on buildings, because the developers and owners are arguing over who should pay for it's removal. Even though a fire in one of those buildings killed 72 people, tenants around the UK continue to live in deathtraps (and pay handsomely for the priviledge). I won't even touch leasehold. I'd rather rent. We also need to discuss shared ownership, as there are pitfalls to that too. Many schemes have small print designed to catch people out, and keep them trapped in the home they signed up for.
If you rent a leasehold property, who do you think those costs are borne by; the landlord? Hardly! He/she passes on those costs to tenants in terms of higher rent to cover their payments to the leasehold company.
The cladding thing is a gigantic overreaction and should never have caused any problem at all. The knee jerk reaction and legal / insurance / "fire safety" bs response has caused more damage than grenfell itself
Simple solution. The company that sold the lease, pays the bill for repairs on demand of the lease holder. He then seeks compensation from the builder/developer.
Leasehold will never be scrapped. Who is going to pay the billions in compensation to the 1000s of landlords, will it be the tax payer? if so it amounts to a benefit for the lease holders! Why should the tax payer be expected to pay off a landlord of a block of flats at £6,000,000 each flat in Phillimore Gardens Kensington? and that's just one address. The Duke of Westminster will be making an appearance at the House of Lords whose lease hold property value is £9.9 billion. Don't be daft lad! Electioneering! Clowns to the Left of me Jokers to the Right!
actually Andrew you are spot on no one in their right mind would ever bring it in ..because at the end of the day when the landlord sells of his hers property's I.e houses flats..evan mobile homes...once he she did this they like to line their pockets with a regular income I.E buy making the leasehold pay..and that is the only reason this will always get a no from our courts..
No compensation is needed for landlords. If we establish that leasehold is illegal and we abolish it, they have to be thankful that law is not retroactive. They make money selling the flats, nobody is taking that away, we are just scraping the racket of selling the renewal after 50 years.
Leaseholders can get the Right To Manage RTM if the majority of the leaseholders agree they can then arrange their own buildings insurance and carry out the maintenance and repairs to the house or block themselves.
Replacement windows for flats on the Hallfield Estate W2 well over £100,000 pounds. And about 15 to 20 years ago was around £20,000 which was meant to be carried out years ago.
For anyone who believes this will change by Labour, the same question as the MP said, who is gonna pay for changing the contracts of 5M people? Nobody. Best case scenario is the newer buildings will not be leasehold. Existing owners, good luck to you!
What i dont understand is how the work/ build got signed off in the first place. Theres been a massive drop in post work inspections. The system is flawed, the devs get away with murder.
Because the Tory government put an end to independent building control inspections of the work (by local councils) and allowed developers to hire their own building inspectors. Developer hired building inspectors want more work from the developers so let through sub standard work.
I have a leasehold property not a flat but what is classed as a residential Park Home and these are being made exempt from this new legislation simple because it not recognised by the government as property because it is of non-standard construction. However I live there, pay full council tax, water rates and so on like any normal house yet its not property.. Straight away there is the loophole for developers simple build sites with park homes instead of normal homes and they can carry on leasing them what's more is they are allowed much shorter leases like just 15 years
I am a leaseholder - flat in Manchester. A couple of years ago I thought that I would find out about the head leaseholder. After going on the Net and finding out how other leaseholders reviewed them. I was shocked, page after page of very disgruntled people. ( certainly dozens, could be in the hundreds) I now find / feel that those above me in the scheme of things are scoundrels. This is very worrying. I paid good money for my flat, and I want to keep it. Is there any help out there?
Contrary to what Gardiner says here, there are still examples of leasehold overseas. Mostly in Singapore, HK & Malaysia and there are similar systems in other countries in the region too.
Another rediculous scheme in property sales is a seller wanting to place "overage" provisions in the contracts. Meaning they profit from any development you may make to your owned property. Other positive and negative covenents are also rediculous, where the seller can determine what has to be, or cant be done on your property.
I heard this before and it fits most. The banks are gonna start to buy more homes building new builds. These homes will not be for sale only rent mortgages are risky why bother when they can just rent it and dine works better for the economy
Parliament will never address this either red or blue, why, because you can bet that pretty much every MP in this country has at least one and in many cases several properties they own outright and the leases on those properties are another cash stream for them to exploit. I say this with a high degree of confidence because for a substantial tract of the British population of a certain age, with the means to do so (myself included) owning and letting out a second property was encouraged by the right to buy legislation passed by the Conservatives back in the eighties. Prior to that, the vast majority of Central London properties were council or Peabody trust flats, including those my grandparents lived in, these days they have all been traded through estate agents for what would once have been considered eye watering sums of money. My paternal grandmother lived in a state of the art for its day sixties built high rise block in Pimlico. A google search reveals that currently 42 of these flats are leased, I was surprised it was not more and the block was returned to the council in 2019. This block is barely 15 minutes walk from Parliament and I am confident that many of those 42 leased properties will be used by our MPs while they are in town.
The problem is definitely selling short leasehold which is now common, it's nothing more than long term rental with the liabilities of a homeowner. Leasehold used to commonly be 999 year leases, and peppercorn rent, not 125 years or less, with extortionate groundrents and you could buy the freehold element seperately sometimes. It's an appalling device introduced by developers and bankers to take your money and leave you with no asset at the end. They would say it's because people need housing, and they cant afford it because house prices are about 10 times the average single person wages so they simply find ways to facilitate people having at least some security and not living year to year as a renter and terrified of what happens when they no longer work and cant pay rent.
When property is treated primarily as an investment opportunity rather than one of life's essentials, the spivs and wide boys of the property industry take over. Making money is the only thing that matters. Get rid of leasehold and replace with Strata Title ASAP. 10:13
i bought my house under the right to buy then found out i have to pay £150 per year to have to grass cut from the housing association and i have still to ask them for permission to do anywork on my property ie extensions even if its permitted under planning rules they have the last say anyone who purchased there house from the council before the housing association took over are not under these restrictive covenants or grass cutting payment which was sneaked in a few years after they took over I'm just praying this is not going to put potential buyers off when i come to sell in the next couple of years just another form or control and lease which needs to be changed but the conveyancers claim is normal and wont cause problems in the future sales
Can someone explain what happens when someone who owns a lease hold decides to change the structure of the property that actually then weakens the structure of the property with potentially dangerous possibilities.
I think they would have to get the permission of the freeholder to make such changes or the freeholder would be the one who needs to do it. Consult the lawyers.

Nice red wallpaper Barry. If you rent a leasehold property, who do you think those costs are borne by; the landlord? Hardly! He/she passes on those costs to tenants in terms of higher rent to cover their payments to the leasehold company.
Deathtraps? You melt
Hold your conveyancing lawyer accountable for not advising you what you're signing your life into when buying a home.
They should always explain the small print.
Trouble with governments their two tier, they can and will overturn contracts as an when it benefits them, but state they can't do it for citizens..
It's in Earls Court and full of weird hotels, v seedy.
actually Andrew you are spot on no one in their right mind would ever bring it in ..because at the end of the day when the landlord sells of his hers property's I.e houses flats..evan mobile homes...once he she did this they like to line their pockets with a regular income I.E buy making the leasehold pay..and that is the only reason this will always get a no from our courts..
Only a non property lawyer would come out with this nonsense.
Replacement windows for flats on the Hallfield Estate W2 well over £100,000 pounds. And about 15 to 20 years ago was around £20,000 which was meant to be carried out years ago.
I used to live there! Manangement are horrible.
For anyone who believes this will change by Labour, the same question as the MP said, who is gonna pay for changing the contracts of 5M people? Nobody. Best case scenario is the newer buildings will not be leasehold. Existing owners, good luck to you!
Definitely a scam
I'm so sick of this Government! Rant over
Contrary to what Gardiner says here, there are still examples of leasehold overseas.
I wish they'd talk about issues of having to renew a lease. Like people have got 25 to 30k spare to renew or just to add on 60 years
The problem is definitely selling short leasehold which is now common, it's nothing more than long term rental with the liabilities of a homeowner.
Most new houses are just sash up, badly built ,poor workmanship, poor materials, they look nice ,till you look close
You buy a home and doesnt even belong to you and you are classed as a renter . The freeholder owns your property
Madness
When property is treated primarily as an investment opportunity rather than one of life's essentials, the spivs and wide boys of the property industry take over. Making money is the only thing that matters. Get rid of leasehold and replace with Strata Title ASAP. 10:13
All money for the lawyers…usurious to the core.
i bought my house under the right to buy then found out i have to pay £150 per year to have to grass cut from the housing association and i have still to ask them for permission to do anywork on my property ie extensions even if its permitted under planning rules they have the last say anyone who purchased there house from the council before the housing association took over are not under these restrictive covenants or grass cutting payment which was sneaked in a few years after they took over
I'm just praying this is not going to put potential buyers off when i come to sell in the next couple of years just another form or control and lease which needs to be changed but the conveyancers claim is normal and wont cause problems in the future sales
Just looking on rightmove and there is a freehold for for a 3bed semi for 60k. WTF
Yeah right, I'm sure the silky king will let that happen on all his property's . 🇬🇧
Singapore public housing is based on leasehold system , no strata title
Labour has already reneged on this cast iron guarantee..leasehold stays.lthanks starmer
I’m in the hell that is shared ownership and I’m trapped in it. Scam🤬🤯
It would be good if they scrapped it but I don't know if they will.
I'd be happy for the freeholder to withhold the services they provide by me suspending my ground rent payments.
The usurious modernity…everything solid melts into thin air.
I was warned off leasehold mortgages 30 years ago I am shocked this is not common knowledge now
Can someone explain what happens when someone who owns a lease hold decides to change the structure of the property that actually then weakens the structure of the property with potentially dangerous possibilities.
I think they would have to get the permission of the freeholder to make such changes or the freeholder would be the one who needs to do it. Consult the lawyers.
Oh ay Back Hand Barry how credible a voice.
This country does not need the Barry Gardners of the world.
What are you alleging about him? It sounds like a bit of libel.
Will labour release leaseholds for houses as well?
Service charge is the biggest rip off i pay 2600 a year
Head lease: The freeholder can take action if the windows are not internally cleaned at least once a month.
He's in no position to give a cast iron guarantee.
Did anything happened since this interview?
we will end leashold flats & houses One thing he never said is when we've been waiting for this leashold reform bill for years , has not furfilled what it was ment to , and by the time it goes through all the think tanks again through Labour it will be probebly another what four years yes my friends it keeps going the uniparty system....
I think Labour will be in government within this year. Lack of power has hindered progress on this.
I would be surprised if something stupid like this didn't exist.
The only answer is people should not buy a property with a lease hold then the owner will be forced to get a freehold put on the property think before you buy??
I doubt that would happen. Learn to correctly punctuate!
Isn’t this the guy who accepted £400k from a Chinese spy?
Surely they would no if it was a leasehold though .
When will this happen?
When Labour get into power again (later this year, depending on how people vote?) but how quickly depends on the priorities. There is so much mess and chaos for Labour to sort out.
Sure, Starmer will fix it immediately. Oh wait 😂
Sorry but with Starmer in charge nothing will change. It will be his chums making big bucks. So labour will not sort the leasehold system out. :(
what does commonhold actually mean?
Welsh flat leaseholders need your help!
Barry you're next in to bat. Please keep your promises to abolish leasehold after July 4th.
Nice red wallpaper Barry.
Not sure how people can't seem to grasp that the freeholder is the owner of the land, the leaseholder is just leasing just as a tenant would, only thing is their lease period is guaranteed increasing their security of tenor. Don't buy without knowing all the details, don't cry about it and expect the Government to change the law to benefit your situation due to poor choices....all sounds a bit socialist.
I own nothing but I’m not happy. Three years of cladding, unable to sell rent or live in. Repossession order after adding compound interest to £40k cladding Costs! A 3 bed penthouse next to the main line station and cbd. It’s a criminal cartel. No lawyer wil take it on! Why? There is no legislation in place for You peasantry
I thought Britain eliminated the class system...guess not!! The haves get to scr&w over the have nots. 😂😂
We got captured by Usury
@genigeni9335 indeed...
why wasn't this ended 20 or 30+ years ago?
Did you know 45% of the rental homes owned by politicians? Leasehold etc is big profit maker for politicians, it will be interesting to see if the leasehold reform passes and becomes law so that i can extend my flat lease which is 73 years lease to 990 years!
He was excited not he was exciting.
Nothing happened after this
Because there has not been a general election yet so Labour is not in government. People have to vote to make change happen.
How is it a scam? People knew what they were buying! No sympathy whatsoever for them, like PPI, claiming they never asked for it, but paid for it every month! Then want compo, end the leasehold system then oh compo to freeholders, simples
i daresay starmer will u-turn on this pretty quickly
Tories want to get their watered-down version through before the GE.
I doubt it because Labour will know (or quickly learn) that they can't behave like the Tories if they want to stay in power. I think housing problems will be quite a high priority for them.
Oh it's Chinese spy Barry again.
Probably the least of worries.
"Somebody else has control over your home, it's not you but you end up paying for it."
I presume, based on that logic, that Mr. Gardiner also voted Brexit.
hes not wrong. even freehold property owners still have to pay property taxes because of the feudal split title system.
Even Freeholders dont own the land they just own the title to the land. Its how they can force you to jail or take the property if you dont pay your feudal Lord his taxes.
Its all a massive ponzi scheme.
Happy new financial year 2023-2024

Mastermind is a consult to business as well as body moves from brain is called Mastermind
There's always been this problem, and its half the reason we've been in this housing crisis.
However I'm more concerned that Barry Gardiner is a work labour MP.
Labour do not deserve this MP,Barry please speak to Richard Tice, and tell him you want to jump off that sinking Labour ship.!
Your skills Barry are wasted in that party, as of right now as much as i totally agree with what you say,i could never vote your party in.!!
And i hope my fellow brits think the same.
Now if you was a REFORM Candidate, then I'd be very interested in what you could potentially achieve for not only your constituents but also our Great great country. 🇬🇧🇫🇴🇬🇧🇫🇴🇬🇧🇫🇴🇬🇧🇫🇴🇬🇧🇫🇴🇬🇧🇫🇴🇬🇧🇫🇴🇬🇧
Reform won't tackle this. Their interests are the same as the wealthy elite (freeholders and landlords). They are to the right of the Tories ideologically. Besides we want work MPs don't we? We don't want ones that don't work but sit on their assets and directorships doing nothing while the money flows into them.
