If the police want his phone they have to get a search warrant second they only claim resisting arrest because he wouldn't turn over the phone. As such all charges were dropped and now he will get a paycheck from tax payers for pain and suffering and false arrest. THE POLICE have a protocol to follow and the POLICE swore to uphold the constitution. Clearly the police are at fault on this one.

    "I had the utmost respect for law enforcement". I did too, until they raided my house, held a shotgun to my 12 year old daughter, harass/threaten my dogs, ransack my house and take whatever tf they wanted. For nothing other than an undercover thinking he saw something or just wanting to make a name for himself. They're nothing more than thugs with no accountability.

      Yeah, I had the police barge into my backyard screaming with guns drawn on the 4th of July, 2020. They forced me to lay down on my 9 months pregnant stomach at gunpoint. They did the same to my husband, elderly father, my pregnant sister in law, and the 6 kids that were present. The reason they were there? "Gunshots reported." Turns out, the "gunshots" were FIREWORKS (ya know, because it's the 4th of July!) and they weren't even from us! The neighbors even lit off a barrage of fireworks while the cops were standing in our yard detaining us. Once they searched everyone and every inch of our yard, found no guns or shell casings or even fireworks, they aggressively tried to get us to let them search our house. We told them no, not without a warrant, and also informed them that we have multiple cameras filming this entire encounter, and the footage is all automatically uploaded to the cloud (in case they tried to smash our cameras or something). They lectured us and basically told us we were all criminal lowlifes who were "insulting their intelligence", and that we were lucky they didn't call child services on us (for what?!) and then left without apology.
      Apparently having a backyard barbecue (alcohol free, btw) on the 4th of July with kids and pregnant ladies and old people makes us criminal gang members who deserved it? The police are doing a great job of making everyone hate them.

      @@cowboyx9380 The fact that they lost the lawsuit has nothing to do with qualified immunity. Qualified immunity prevents the victim from suing the officers directly, hence why Andersen had to sue the city/department in this case. This policy makes the taxpayers pay for the damage, rather than the officers themselves (who are actually at fault). So the comment about ending qualified immunity makes perfect sense. The officers should be the ones held responsible for the actions, not the taxpayers as a whole.

Most police related lawsuits are under the 1983 act, “Failure to Train/Failure to Supervise” thats where the big bucks are! Lawyers are looking for $$$ not justice, thats just the way it is.

      @@cowboyx9380 I know, and you’re totally right about the money, and that’s exactly the problem. That is precisely why qualified immunity should end and officers should be required to have liability insurance just like many other high stake professions (like doctors, lawyers, contractors) depending on the jurisdiction. This would take at least some of the burden off of tax payers and more importantly allow for individual repercussions for at fault officers such as these ones. It would allow for victims to sue the at fault officers and still make a reasonable amount of damage money. The officers would also at least have to pay a deductible as well as legal fees if at fault, making them less likely to abuse their power in the future since there might be serious consequences. It would even reduce the amount of frivolous lawsuits since the payouts would be less.

      My thoughts exactly! Why didn't they take some time and discuss things with him, instead of grabbing and tasing him as their first resort because he told them they needed a warrant. They could have waited with him while a warrant was obtained, if they were afraid he'd tamper with it. But they decided violence trumped patience! That's the kind of cops we don't need.

      Cause that is not how they are trained. A large percent of cops have no training or care about the proper way to interact with the community, and next to no training in mental health. Cop in North America need more train and mental health checks on them selves, monthly if the job is as stressful as they claim.
      Those who are payed to protect us need to be in good mental health as well. The cops can't be as bad as the criminals they claim to protect us from.

    This is what happens when you give someone that much authority , poor training on law and don’t hold them accountable for letting their emotions get the better of them. This type of violation in a civilian setting would be met with serious consequences. But instead they do an “internal audit” and most of the time nothing is done. This is such a common occurrence that they don’t even care that they are on camera!
    I respect the dad a lot not leaving his daughters side and standing up for his rights the rights he fought for! You can see who is taking the oath seriously out of this group!

      @@krisniznik3953 .. maybe in Colorado but I must disagree being a certified in law enforcement in Florida. I can't confirm it in any other state though. But one thing I can say is police reform nationwide needs to take place but not defunding. It is simple police reform training that needs to be done with all officers in a variety of areas and respecting citizens or be removed by the department and suspended certification untill all officers take the new courses and comply. By putting suspensions against certifications by the states is pretty much defunding the departments as it stands. I am highly disgusted with what has been happening actually.

A mandatory time line after new courses are available should be done and failure to take the course on time with passing scores and satisfactory work performance should indeed result in a suspension of their law enforcement certification by the respected state making it impossible to work until it is done.
      That would satisfy everyone and force officers to take the needed steps to continue their careers. But defunding is just not acceptable as instructors are always active law enforcement and they must be paid as well as other areas of the departments. So I agree with you totally. I have seen unethical situations in neighboring departments personally first hand on and off duty and I know of some within my department that was quickly addressed also but frankly not many within my chosen department.

    This reminds of the Utah Nurse incident where a nurse was arrested because she didn't want to follow the cop's orders to draw blood from an individual who was knocked out cold. The cops wanted blood for forensics test while the nurse refused until she can see a valid warrant. Cop arrested her and years later, that cop got fired because he didn't follow protocol and violated one's rights.

    The fact that they dropped the resisting arrest and obstruction charges says volumes. Especially when 0 charges were filed against the mother for hitting the girl with her car. And given that the girl was in the ICU and the father wasnt going anywhere they had time to get a warrant, they chose not to and then used force to confiscate his property. The cops should be fired and charged.

      They would never have gotten a warrant. A warrant requires probable cause of a crime supported by actual evidence. They had absolutely nothing to suggest that the daughter's accident was anything other than it appeared to be.

    This really bothers me . During my time in Colorado Springs living and training at the Olympic Training Center, I never had a bad experience with the officers there but was warned that they get out of control. This situation was clearly a crime as mentioned and a vet who served long term would not be breaking any law to justify their actions. These officers must be held accountable for their actions.

      He was a little older but had a heart condition and they tased him and said he died of a heart attack bit it was due to him being tased that is the only thing I have ever heard about somebody dying from that and they actually have that on video!

      I was in a situation where I was “swatted”. I did comply, thinking it would be fine because I had nothing to hide. I got beaten in front of my kids and humiliated for over an hour before they let me go. I have never been a criminal or a drug addict, just broke up with the wrong person one time.
      It’s easy for people to dismiss it by saying just comply, I used to think that way. Obviously I see things a little differently now.

According to 2019 data: Police only make up .21% of the entire US population and contact 17% of the population annually (55-56,000,000 interaction with the public). And only 0.047% of those interactions lead to an excessive force complaint, yet only 8% of those complaints we're a substained(.0039%). Your 49 times more likely to be a victim of a rape then of police brutality. I'm not saying police brutality doesn't exist but it's extremely rare. If you want to think "this stuff happens all the time" then please forget to call 911 when your in trouble.

    The phrase "arrested for resisting arrest" should never be used on American soil. If you are arrested for something else and you resist, then it's a charge added for court but not part of the arrest reasons. Otherwise it's non-sensical.

    Cops in Colorado Springs tazed a 49 yr old white man to death last summer. And shot a 19 yr old black man in the back 3 times.

      Don't let anyone hear you say this, they respond to these two incidents very differently because it's normal now. Both incidents are bad and suck but death is far worse than broken bones. The police have a problem if society continues to respond that black people shouldn't resist and in the same type of incident say a white person shouldn't have been treated in such a way then the problem isn't really the police is it? Police shot and killed a black veteran off duty security trying to disarm his suicidal son, police shot and killed another black veteran who was helping people flee a mall shooting in Georgia then lied and said he was the shooter until witnesses said they told dispatch the suspect was white. Police shot and killed another black veteran in bar in chicago who was a security guard who stopped a shooting and people had already told the police that security saved their life they just busted in and killed him because he was a big black man. These incidents are but distant memories and nobody seems to care. This is why white women with dementia are getting their arms broken now. Pretty soon white grandmas will be getting shot in the back 10 times and the RUclips response will be she shouldn't have resisted.

    My psych professor told me during the 70s,80s,&90s she conducted psych exam's on police recruits. 73% had failed. Local police unions ordered her to lower blood percentage to 20% or she wouldn't be paid.

      We need good police and fire in every city . The town that I live in has City Council members that were put in place and Campaigned by the Police and FF Unions and in turn these members vote in pay raises for these Union groups. It's a vicious circle . Pay raises at this point need to be a percentage across the board to all city workers because wage and benefit package for Police and Fireman are outrageous high.

    Thank you for your service. I’m soooo happy your little girl has made a full recovery. What a terrifying experience for your family. I hope your fiancé is doing better mentally too. Now for these cops.if not for body cams, bully cops would STILL be getting away with reckless behaviour. This was an assault straight up, and they do need to be held accountable! I too have respect for Law Enforcement, but not the officers who have such egos that they are bullies! I hope you win your case. Can you imagine if this man had a different coloured skin? These body cams WILL weed out the cops who shouldn’t be in these positions. ALL officers NEED to have a honest chat with themselves and see if they are part of the problems or part of the solutions, before it gets to this point or other points we have seen.

    You don't treat someone like that when their daughter is in ICU ! Those cops should be fired and sent to prison. That department should be looked into, BIG TIME !

    Better education, mental health, recruiting & training are seriously required! This is taking our "America the beautiful" to a real scary place to live!

      That's exactly what "defund the police" is saying. Take some of the 100's of 1000's of $$ in police budgets and put it toward better education, training, & mental health for the police.Most of these officers don't know the laws for their state; they don't know how to deal with ppl with health issues like mental illness or impairments, prosthetics; they don't know/care about the rights of the ppl they are supposed to protect and serve.

    I never heard anywhere in this film that they officers told him that he was under arrest, so how do you resist arrest? If you’re not under arrest one cop said just give us your phone and this will be over no warrant no justification just take it definitely grounds for a good lawsuit, the problem is the officers with qualified immunity will not be burdened by if the lawsuit wins it will be the counties taxpayers money not the cops
