Here is Australia a lot of body corporate for multi-dwelling buildings are not allowing EV owners to charge in the underground carpark due to concerns of fires, insurance and possible requirements for installing a high volume fire suppression system. Question to GPT:
      "If A car owner in the U.K. received a letter from a carmaker about his car being a fire hazard and not to park it near this home, and made an anomalous call to his insurance company which without his permission used his number to identify him and cancel both his insurance policy and home owner's insurance, could that be a violation of GDPR laws or other U.K insurance or consumer law?
      ChatGPT said:
      Yes, the situation described could potentially involve violations of several laws, including the General Data Protection Regulation (GDPR), as well as aspects of U.K. insurance law and consumer protection law. Here's a breakdown of how each of these might be implicated:
      1. Violation of GDPR (General Data Protection Regulation)
      GDPR regulates the handling of personal data within the European Union and the U.K. (post-Brexit, the U.K. still follows similar standards under the UK GDPR). Several aspects of this scenario raise potential GDPR concerns:
      Unauthorized Use of Personal Data: If the insurance company used the car owner’s phone number to identify them and access their account without permission, this could constitute unauthorized processing of personal data. GDPR requires companies to process personal data lawfully, transparently, and for specific purposes. Using someone’s data without their consent or without a legitimate reason can be a violation.
      Lack of Consent: If the car owner did not give explicit consent for their phone number to be used for identification purposes by the insurance company, this could breach the GDPR’s consent requirements. The regulation emphasizes that consent must be informed, specific, and given freely.
      Data Subject's Rights: The car owner has rights under GDPR, including the right to object to the processing of their data (such as the unauthorized use of their phone number) and the right to rectification. If their insurance policy was canceled without their consent or knowledge, it could also raise issues about the right to object to decisions made based on automated processing (if this was the case).
      2. U.K. Insurance Law
      Cancellation of Insurance: If the insurance company canceled both the car insurance and the home insurance without the car owner's explicit consent, this could potentially be a breach of U.K. insurance law. Insurers are generally required to follow clear procedures before canceling a policy, especially when it comes to significant matters like home insurance and car insurance. They must provide adequate notice and a valid reason for the cancellation, and the insured person must have the opportunity to respond or object.
      Failure to Notify Properly: The insurance company may be in violation of its contractual obligations if it failed to follow proper cancellation procedures. In the U.K., insurers must also adhere to the rules of the Financial Conduct Authority (FCA), which govern fairness and transparency in insurance contracts.
      3. Consumer Protection Law
      Unfair or Deceptive Practices: Under the Consumer Protection from Unfair Trading Regulations and the Consumer Rights Act 2015, businesses (including insurers) are prohibited from engaging in unfair or misleading practices. Canceling both insurance policies without the consumer’s consent or without providing clear justification could be considered an unfair practice.
      Unsolicited Contact or Manipulation: If the anomalous call involved any misleading or deceptive information, or if the insurance company manipulated the car owner into making a decision without full understanding or without their permission, that could fall under unfair consumer practices.
      Conclusion
      The car owner might have grounds to file complaints with relevant regulatory bodies, such as the Information Commissioner’s Office (ICO) regarding GDPR violations, the Financial Conduct Authority (FCA) regarding insurance matters, and potentially with consumer protection organizations. If the insurance company used personal data in an unauthorized way or canceled policies improperly, this could be considered a violation of their rights under both GDPR and U.K. insurance laws. The car owner may also have grounds to seek compensation or other remedies, depending on the circumstances.

      This was the point I was making! Lee has had loads of recalls but he has never mentioned that he has phoned his insurer to notify them. The time he did call was off the back of someone else's letter, not his. Lee's letter made no reference to not charging near a building so I would say he had no reason to call them. I wonder how many of the people who did receive the letter called their insurer? The call operator didn't seem to have much idea but I suspect someone more senior decided to pursue it. Now he has been refused insurance a fact that will need to be disclosed as that is a standard question 'have you ever been refused insurance'
      It will be interesting to see how this develops. 🤔🫣

    I think you were wrong ringing your insurer before you received your recall letter. It appears to relate to the fact that you read out the bit about not charging near the house hence it being a fire hazard. Yours was just a recall but you decided to jump the gun! • @wayland7150
      @wayland7150 19 дней назад

      Not strictly refused, simply not renewed at the end of the contract. Insurance companies are careful not to refuse, usually they will just quote such a lot of money that you won't go ahead.

  • @Barbara-l2x
    @Barbara-l2x 18 дней назад +4

    Most new companies will ask you "Have you ever had insurance refused ?". So this may now cause you new issues with a new insurer potentially putting up your insurance costs. Also if you now know that your car is officially a fire hazard then knowingly parking it near someones house may leave you at a legal risk. Imagine if there was a fire and someone was injured as a result of its placement by you.

    Interesting video Lee that letter is just a renewal notice for your car which by the way it reads is,going up quite a lot or they are not going to renew it until you phone them,and you just telling everybody about a letter to somebody else’s cars,means you know about the problem and when your house insurance comes up for renewal,they might not let you have your car parked within 50-100 meters,of it because our next door neighbour charges their car on the road but as I said in the original video,you did by reading the letter out you have been informed you and your,videos have got yourself into a bit of a bind don’t worry I had something similar with my pickup,they wouldn’t renew my insurance and I just want with another company 🤣👍👍

    Wow. I seriously thought this would happen when you mentioned the letter. Insurance companies dont like that, a potential firebomb on their hands naturally. Somebody said you cant get a decent second hand car nowadays which is just a few years old. You can, I own one, snd am really glad for it. Really like your jacket. This is ultimately on Porche misselling you that car. They should allow you to trade it in for another car - even if its a hybrid. Great vid, and good look 👍
