    What I don't get is why the DOJ has to wait for after the midterms. Trump is a private citizen. He holds no office. Why is he treated as such?

    Another person who was prosecuted and sent to jail for 3 months for improper handling of classified documents just this year is Asia Janay Lavarello. She was working for the military as an intel analyst and was authorized to have the documents. She just didn't return them properly. She went to prison for it.

      DOJ is in the "quiet period" dictated by long-standing department regulations. Starting September 10 and lasting until November 8, prosecutors are not allowed to take overt investigative steps or file charges during this time. While Trump is not on the ballot, he has endorsed candidates and charges could be construed as "political interference". Technically, DOJ could announce an indictment on Nov 8, but IMO opinion, we won't see anything until after the holidays.

      In America, there is a constitutional right for every citizen, including former presidents to have due process. Though Trump has not been afforded much in this area, they still just can’t just throw him in prison because they don’t like him. Starting September 10 and lasting until November 8, prosecutors are not allowed to take overt investigative steps or file charges during this time. While Trump is not on the ballot, he has endorsed candidates and charges could be construed as "political interference". Technically, DOJ could announce an indictment on Nov 8, but IMO opinion, we won't see anything until after the holidays.

      One more note (just to keep your spirits up hehe): While the quiet period prevents any PUBLIC action, there's nothing at all stopping DOJ from pursuing PRIVATE actions, which could include getting indictments under seal. If that should happen, they could unseal the indictment on Nov 9....now that would be an early Xmas present. But in my heart of hearts, I don't see it happening. There's no time pressure on DOJ, and I think they'll want Raskin to be firmly in control before proceeding....translation: January.

    The DoJ would not go to all this efforts with warrants, appeals, motions etc not to indict Trump. It is clear that Trump has broken Federal law but I understand that the DoJ move cautiously due all of the politics surrounding this case.

I think that this is going to be the biggest case of Merrick Garland's career and it would be silly to think that he would rush to justice... he's making sure that every I is crossed and every T is dotted. But people forget that Garland was the prosecutor for the Oklahoma Federal Building bombing that resulted in the death penalty so he is not afraid of Trump just wants to get it right air tight. But I also think the Civil fraud trial for the trump mafia family in New York State will be the beginning of the end. Trump mafia will lose without doubt and the corresponding civil penalty ( going for $250 million), barring any ownership in NY State corporations and no ability to get loans from any institution thar does business in NY State which is practically every bank in the world ( for 5 years). But here is where it hurts Trump is asset wealthy but cash poor they don't have that kind of cash on hand. So they will be forced to liquidate assets. Then comes the criminal trial in NY State and Georgia ( Fulton County). Heap on the coming Federal crimes currently under investigation and the Trump mafia will be like John Gotti long forgotten and none to soon.

    We should be looking at Gen. Petraeus's case as an example of what kind of sentence we can expect for this case against the former president. Given the likely lesser sentence for taking classified documents, I'm more interested in potential prosecution concerning the Jan. 6th crimes (treason).
    I don't understand why the crimes detailed in the Mueller Report are not pursued by the DOJ (if they are I never hear any word of it). Did Barr's decision to not pursue prosecution prevent the DOJ from doing so at a later date??

      For your education, DOJ prosecution deliberations are done in secret. Hence, the public will not know the exact details of any potential indictment until they are released. You won't see any actual proof regarding the prosecution team until it is announced by the Attorney General.

    I think we should take all news about "We've got Trump now" with a grain of salt. We've been hearing this day after day for month after month. Yes, I hope the DOJ gets him. But I'm not getting my hopes up.

      DOJ is in the "quiet period" dictated by long-standing department regulations. Starting September 10 and lasting until November 8, prosecutors are not allowed to take overt investigative steps or file charges during this time. While Trump is not on the ballot, he has endorsed candidates and charges could be construed as "political interference". Technically, DOJ could announce an indictment on Nov 8, but IMO opinion, we won't see anything until after the holidays.
