  • In the middle of the #Okhotsk Sea, which is surrounded by #Russia, the Law of the Sea allowed vessels of any flag to plunder the sea's fish stock. Russia was not happy about it. It was called the Peanut Hole.

      The loophole comes from the fact that others can access a region fully enclosed by your EEZ despite having to enter your EEZ to do it. The idea is usually to preserve right of passage for commerce for countries that are boxed in, and the use of navigable waterways for international trade.
      The loophole is resultant from a plain literal reading of the laws, but doesn't quite follow the typical intended purpose of those laws, hence why russia was able to appeal to the UN to expand their EEZ to include the isolated region.

      You are allowed to pass through a countries EEZ, territorial waters where no foreign vessel is allowed is limited to 12 nautical miles off a shore.

    You notice that the fishing boats had to cross through Russian waters to fish there. But instead of confronting them with naval forces, they went to court.

    I would close that loophole in this particular case. Clearly the area is encircled by Russian territory and legally claimed ocean. Also there is no gap to connect the peanut hole to open waters, so it just doesn’t seem reasonable to have to share it.

    Another discrepancy is those islands south of the bering strait. Russia claims all of them (as is shown in the video) while Japan just claims 2 or 3 of the islands north of Hokkaido (North Japan) and Japanese people actually live on those islands those few islands that Russia also claims. It’s a major cause for controversy between the two nations.

      True, although to be fair to the islands themselves, Japanese and Russians are also not the only inhabitants of them, as they have their own colonized indigenous peoples as well, just as Hokkaido does. Maybe none of these nations deserve these regions, but geopolitics is rarely ever reflective of who deserves what unfortunately

      Kamchatka became part of Russia in 1697. The USA didn't even exist yet. Japan only annexed and renamed Hokkaido in 1869, four years after the end of the Civil War. Before that it was called Ezochi, populated by Ainu people not considered to be Japanese. Japan completed its northern expansion into Hokkaido very late. For contrast, California had became a state 19 years earlier.

      But it completely glossed over the fact that there has at least been one Shogun of Ainu ancestry, that English and other European powers had colonizing N. America for roughly 300 yrs before the establishment of the colonies and it would be nearly another century before they claimed their independence.
      It doesn’t matter WHEN these things happened. What matters is that they DID happen. And thats not something that should be taken for granted.

    EEZ does not mean no policing, no protection or no traversal, it means that national can only extract from that zone. Without other countries impeding on them. Do you know something else? Noone actually has to follow the “UN law of the sea” heres some UN members that dont follow. USA, France, Norway and Japan.
