I keep coming back to your videos because they are very useful. I really like how you explain the four elements of trespass to land. Enter, Intent, Land, and Possession. This really helped me understand the topic better. Very useful information! I appreciate all your hours that you put into preparing this and other videos. Thanks.
Thank you I have a further follow up question example there are 2 shops let’s name it shop A & B both share same common area of entry if shop A decides to put his boxes in front of his shop because he doesn’t have enough space inside his shop & in which his boxes are blocking access to shop B. Having said that does this act by shop A constitutes trespass to land ?

There are exceptions to this tort. For example, people delivering parcels do so by consent. Consent is given through custom. As a land owner or possessor you can revoke that consent by placing a sign at the edge of the property. Also, local law might allow them to enter your land.
My neighbors trespass my land every day to get their balls the police allege they can trespass my property every day to get their balls or store their balls in n my property a nightmare
👍brilliant thanks for you advice, I am just having some problems with bailiffs at the moment over a civil matter involving acts and statutes so not law happy days thanks again
@@Learnlawbetter but without exception every " police audit" I watch unless the owner actually presses charges, then the police can do nothing because the owner doesn't personally trespass them. There has to be a trespass warning by the actually owner BEFORE the police can even ask for I.D, let alone trespass you. So the police would actually have to solicit a trespass from the owner( if they're not present, then that can't be done), and that would be illegal for the police to do that. Am I correct?
Thank you so much for the great information provided in your video. For recent viewers regarding 01:46 on July 20, 2018 Congress has affirmed that the FAA has exclusive authority to regulate the air over all land. This invalidates the definition provided in the video for the land element: "Land is the ground, the airspace above the ground and the material beneath the ground." The "airspace above the land" needs to be striked out. The airspace above property/land is not owned by the owner of the land. It is considered a part of federal airspace. For example you can't trespass a drone flying 50 feet over your land the same way you can't trespass a helicopter flying 600 feet over your land. Tell me in the comment section what kind of tort law you would like to see on my channel. I can't cover everything, but will put your idea in my list of possible future topics. Thanks for watching!
Learn Law Better Sir as a advice....use a board...like in this video you told elements.....they come and they go.....points under (2) Enter just remained in brain for a second....but everything you teached is better than every other video I watched
That is good advice. In my more recent videos, I've added text boxes that appear on the bottom left of the screen. Keep sending your advice, as I grow through these suggestions.

Yes, if you don’t have permission to be there.

Would this apply to people delivering parcels, the post, etc...?

Really nice lecture
No, common sense please
My neighbors trespass my land every day to get their balls the police allege they can trespass my property every day to get their balls or store their balls in n my property a nightmare
So does that mean that if a bailiff comes to your door he has intent of getting possessions and is it legal?
There is implied consent for anyone to come to your door. A government official with appropriate authority may come to your door by operation of law.
Great thanks so by placing an implied rights of access removal notice outside the front door should counteract that?
For most people yes, that is all you need. But for those that can come to your door by operation of law, like a police officer, that won’t work.

@@LearnlawbetterGood morning sir. So is this an exception? Or a defence should say.
thank you so much your vids are so helpful
Glad to hear they are helping. Let me know if there are any other topics you want covered.
What if you want to camp on a property that is for sale? If the owner is not there to trespass you, then can the police tell you to leave?
If the land does not belong to you it is trespass. And the owner does not need to be present.

I suspect these technical requirements vary widely from jurisdiction to jurisdiction.
