Social Security Disability videos 1 major tip. One must be very careful what they say to physical therapists and doctors . Read all your records before turning them in. I missed one PT report where they misinterpreted what I said and the judge asked me about it. The PT asked Me what type of work I did for a living and I said I had a landscaping business and construction, but have not worked for years. Later I was complying my pain had increased over the weekend because I tried to Prune my Rose bushes. She marked down that my pain increased because I was doing Some work over the weekend for my landscaping business. The judge saw this red flag that was written 2 months before my hearing. He asked if this was true and luckily it was only 1 month after my 2nd operation and I said no , she must of misunderstood me. It was a very short hearing and the judge said I’m ruling In Your favor back to your on set date . My lawyer also missed reading those notes . Again I truly appreciate all your videos that helped me win my case
@@bobleroy1924 They are bad even other Doctors even PT like you said writing down the wrong information that has happened to me. What makes me upset is when you actually tell them and write it down on paper the systoms that you're having and they either choose to over look it or as i call it 'fill in the blanks when they don't know the answer " and that is so wrong because how can they misinterpret what you actually tell them and write down on paper and when the dr puts it in you're report it actually goes on you're permanent record. The same thing happened to me but they wrote something down many many years before i was hurt. I've always lived in chronic pain due to the many problems that i have and what I've been through as well plus 6 surgeries and they're social security Dr. That they send you to wrote down things that they thought i could do now and i explained to him those were the things that i did many many years ago before i was hurt and could get around better. But I've even called the Dr.. and told them to change things they written down in my file ( and whether they did it or not i don't know( but i told the Dr.. or should i say specialist that i have told you these things and he said okay then why would they write whatever they feel down that's so wrong and can hurt someone's chances and like i said it goes on they're permanent medical record. I will stay in they're butts till they change it because now due to the covid most visits are done over the phone unless you're a new patient and all and i totally agree with what you said. I've had them write down before that they took my vital signs when they never did and temperature and i would think i would remember something like that and they don't wanna admit they're wrong doings some places and that's so unfair.
On May 5 2020 I had my hearing over the phone and on June 15, 2020 I found out I won my case and on June 17, 2020 j found out a lump sum of benefits was deposited in my bank account 😉😁😊😊
Congrats on winning your case!! My payments are supposed to start, but my backpay is being held up because of some things the judge put in her decision. Hoping to see something soon!
@Joel I had my hearing May 20th and received my decision in the mail about a month later. I actually knew before I even got the letter by checking my SSA account online. Don't forget to do that (if you haven't already). Crossing my fingers you get a favorable decision!

I have DDS, Spinal Stenosis, herniated disc with nerve root impingement. My long term disability has provided my lawyer for me. @@ssdattorney hello I actually ended up having a seizure literally 5 minutes before my hearing and my attorney called with the judge on the other line and my mom told them what was happening and they said it would be rescheduled. I’m just really sad that I waited two years for a hearing and this happens this is just my luck

Christopher Peters well let me tell you I was the oke in broke. I went to HRA and catholic charities and got what you call a one shot deal to pay my rent. 6500 dollars for back rent. I took in a room mate twice.... thank God they paid on time. Food stamps, you name it. A lot of crying and praying. Take it from me if you hang in there and don’t give up it will be worth it in the end. When I got that check I shouted hallelujah and my monthly payments and nothing to sneeze at. Take it from someone who knows. Blessings and stay the course
I did the same as Deirdre, food stamps, section 8 housing (but that took 3.5 years on the waiting list to get approved). Check out 211 for your area-they will tell you who can help with rent, where you can get food and even clothing if you need it. Other than that I borrowed from family and had support from my boyfriend the last year. Hang in there-it WILL happen. It just takes forever.
I was just denied this past Saturday with counsel mind you. Had a telephone hearing an she, (judge) didn't ask very many questions like she already had her mind made up. I didn't know the judge had to be persuaded by my psychiatrists findings..those were her exact words. And, what does me spending time with my daughter and granddaughter have to do with anything or that I was pleasant and made eye contact with my counselor and doctor...These judges are not doctors and shouldn't have that type of power to include their opinions and thoughts in a ruling for people's livelihood..I'm beyond ticked off..By the way I love watching your videos..thank you Atty. Ginsberg.
I had a phone hearing today 7/9/20. I have crohn's disease with severe bowel issues, I also suffer from chronic pain. I take medicine that suppress my immune system, depression medication, and pain medication. The ALJ asked me about my daily activities and I was honest and told her that my daily activities had diminished substantially due to my disease and the medication I take. She later asked the VE were the any jobs I could perform based my trade and she said no. She then asked her about the hypothetical jobs, the VE said there were three but then the ALJ asked about were there any jobs I could do that offered readily bathroom visits, the VE said there was two a person with my issues could perform. Then my lawyer asked the VE, out of those two jobs would I be off task more than 10 to 15 % of the time and the VE said they both were excluded. I don't know what that means, my lawyer said its a 50-5O chance of being approved.

I just had my hearing on the 11th of August. My lawyer said I did great. The judge did ask me a couple of questions, more about my job history and how it's changed. Other than that I answered his questions,but with my mental illness I got a little overwhelmed and emotional. I've been fighting this for about 3 years. I hope I get good news 🙏

I just had my hearing over the phone yesterday. Wish me luck. I hope i get it. My atterny asked me some questions and then the judge asked me a couple of questions. Then the judge talked to the vocational expert and gave an example for hypothetical perosn number one and the expert gave a few examples of possible work. Then judge gave example of hypothetical person number two who had all my issues to the vocational expert and asked them if there were jobs that person could do and they said No. When I had first applied May 28th of last year my denial letter said that they found that I did have disabilities but that they still believe there were some kinds of work I could do. But now after the hearing yesterday I hope everything goes good for me.
I was initially going to say that I would prefer to have my hearing over the phone; but since my lawyer cannot be there....my anxiety would likely trip me up, making me sound like a liar😫😥
Very informative and helpful. I wonder if you have seen a trend in how ALJs are deciding the phone hearings now vs. prior to the COVID19 crisis. Do the ALJs seem more inclined to side with the claimant when considering the limitations in today's economy, lack of medical access?

I am very nervous as I am only 45yrs old and claim PTSD as my primary disability, I am already rated a sole 100% for it by the VA..bit as you pointed out in a previous video...VA records must be a mess. Any advice how to approach the hearing?

I had a phone hearing this past April. It pretty much went the way as shown on your past videos. The biggest problem I had was that a chiropractor, and my Neurosurgeon didn't submit requested information. They decided to give them a month to submit the documents. I'm still in waiting. My Attorney feels I have a good chance for a favorable decision, however I have fears if the Doctors do not send the Information.
62 years old have solid work history, never missed a day except 20 years ago when I had pneumonia. I have aggressive stage 3 possible stage 4 prostate cancer that has spread to lymph nodes in the pelvic region, I have been on a clinical trail drug for three months after another three months they will perform a radical prostatectomy and remove lymph nodes from pelvis area. Then another six months of the clinical trail drug and six more months of Hormone Deprivation. The doctor said it not go away but this is to slow it down hopefully, I have no energy, losing weight, trouble with holding my bladder. I hurt when I walk or sit very long. I have been told prostate never wins disability by some people and others say it is cancer you should get it. My Gleason score was 17 out 17 biopsies 5 +4=9, epsien score 5, stage T3b meaning it has spread outside the prostate into nearby organs like the lymps is this enough? thank you
I had my hearing january 2019,I was not impressed at all with my lawyer.I got a "fully favorable" decision I think mainly because I watched and followed every video you did.Thank you again.2 1/2 years from start to finish.I"m sure it"s longer now-thank you again.My advice to anyone would be "Do your homework and your own leg work,get all your own medical records,go in there with your guns fully loaded!

Hello and thank you! you’ve helped a lot over the past as I’ve listened to your channel. I’m 62 and been waiting about 3 years. Got as far as my ALJ hearing (last July) and after denial, my case is currently in appellate court, I think. Law office dos not communicate much with me. My payout will probably be around the same that my Social Security will be, around $800 a month. At this point, I’m wondering if I should just take early retirement and forget about trying to win this case.I was just wondering what your thoughts on that are. Thank you
I had a hearing Nov ,2020 via phone with an ALJ from another state, due to backlog & Covid. It went really well. My lawyer was pleased. The judge asked about & wanted to clarify the date of on-set as soon as the hearing started & the vocational expert said there would not be any employers able to accommodate my needs. He did however ask for a copy of my most recent CT scan. My lawyer has since sent that in. Between Covid backlogs, the Holidays and the judge being from another state, could it take longer for his decision???
I just had a phone hearing with attorney judge stenographer and the vocational tech expert the judge told me I was approved asked for my address and said I will be receiving letters do you know how long that might take I am in South Carolina it is out of the Columbia court office but my social security office is in Florence I'm confused who tells me what and how long... The website said id have a decision in six months. I have an inoperable hernia on my abdomen the size of a salad plate, from having 15 surgeries in a two month period. I have no muscle there. They had to do a skin graft to cover the skin that was gone on my abdomen. I also have a ileostomy with a retracted stoma which causes constant pain. I also had an abcess due to the retracted stoma and now have a fistula that is a second hole. I cant stand walk or sit for extended periods. Its depressing having to wait for a decision.
My hearing was last Wednesday & my lawyer called & prepared me a week ahead of time. She asked me the questions that she thought they'd ask & she was right. I have a question the professional therapist they had on the phone said there were 2 jobs I could do but then my lawyer asked him if I could lay down at these jobs if need be & I also have HS & will miss a few days a month. She asked if I could keep these 2 jobs with those things & he said then no & the judge said that's all he needed to hear. Is that a good thing?? He has a 56% approval rate. What do you think my chances are?? Thank you for these videos. I forgot the 2 jobs was cleaning eye glass wear or watching security cameras at businesses or something. He said at the end I wouldn't be able to keep those jobs because of my HS & my spine is deteriorating same well. I'm only 38.
Interesting, the questions asked of the VE in my hearing went the exact same way. First she listed three jobs she thought I could do. Then my attorney countered and listed the things that would prevent me from keeping a job (time off task, amount of absences each month) and the VE said no jobs available. I won. Is there ALWAYS a hearing ? I applied in February, was sent paperwork regarding job descriptions etc that I quickly sent back . Last week I had a medical exam scheduled by SS . Will I get a decision based on this or will there ALWAYS be a hearing ?
I have my tele hearing in NJ .. and my attorney and I haven't even talked about anything literally.. luckily I do have MRIs that show substantial brain damage to the frontal lobe area.. and some other records but I'm not feeling very good about this sir
My thought is that your medical record is about 85% of whether you win or lose, your testimony about 10% and your lawyer's oratory brilliance about 5%. If you have a good medical record you should win.

I keep hearing that we're at a big disservice having the hearing on the phone and not even via video. If it's possible to wait for a live hearing or video hearing, understanding that it can take many months or longer for that to happen, would you generally recommend waiting? I'm hearing that the next phase might be moving telephone hearings to video hearings in your representative's office (if you have one and they have video capability). Thank you for your excellent videos.
Personally I have not had any issues with phone hearings and my sense is that judges are even more aware of difficult the job market is given the change to their procedures.
What about hyperhidrosis where your hands run water and when they dry they are very numb and locks up should I mention this while going through my disability for depression and anxiety also I'm waiting on a hearing date with lawyer

I was just offered a court date by phone, in August, I am choosing to wait till we can do it in person, I feel my doctors haven't been doing a good enough job with, well, pretty much anything.. By waiting, I am buying myself more time to better advocate for myself. I am worried though, on how I will be able to talk during my hearing, I have problems finding words, thinking clearly, my mind goes blank often, I talk slow etc. This causes my anxiety to go sky high when put in situations like that, even just thinking about being in situations like that. I'm not happy that this whole thing is getting put off longer, but I'm even more unhappy about the lack of care I am receiving from my doctors.
I experience the same exact conditions you described! I have felt for many years, like the only person that goes through this every single day. You just described exactly my thoughts and feelings about this process and speaking to the judge. I am available if you want to talk about this with someone that truly understands. I have a question my lawyer tells me that my case is going to take 18 months I was denied twice but I have a strong case my lawyer tells her and this time I will get a proof how long it will take me to see a judge will they see me before the 18 months thank you

We don't have any answers from SSA regarding live vs. telephone hearings beyond September or October of 2020. So what the state of hearings operations will be in 6, 12, or 18 months is anyone's guess.
It depends on the nature of your medical issues and whether you have support from your doctors regarding significant issues you would have trying to work a simple, entry-level job.

I had mine in june 18 2020 i think it whent well now i have to waite for the desseion how long does it take

@@ssdattorney hello I actually ended up having a seizure literally 5 minutes before my hearing and my attorney called with the judge on the other line and my mom told them what was happening and they said it would be rescheduled. I’m just really sad that I waited two years for a hearing and this happens this is just my luck

Christopher Peters well let me tell you I was the oke in broke. I went to HRA and catholic charities and got what you call a one shot deal to pay my rent. 6500 dollars for back rent. I took in a room mate twice.... thank God they paid on time. Food stamps, you name it. A lot of crying and praying. Take it from me if you hang in there and don’t give up it will be worth it in the end. When I got that check I shouted hallelujah and my monthly payments and nothing to sneeze at. Take it from someone who knows. Blessings and stay the course
I did the same as Deirdre, food stamps, section 8 housing (but that took 3.5 years on the waiting list to get approved). Check out 211 for your area-they will tell you who can help with rent, where you can get food and even clothing if you need it. Other than that I borrowed from family and had support from my boyfriend the last year. Hang in there-it WILL happen. It just takes forever.

I was just denied this past Saturday with counsel mind you. Had a telephone hearing an she, (judge) didn't ask very many questions like she already had her mind made up. I didn't know the judge had to be persuaded by my psychiatrists findings..those were her exact words. And, what does me spending time with my daughter and granddaughter have to do with anything or that I was pleasant and made eye contact with my counselor and doctor...These judges are not doctors and shouldn't have that type of power to include their opinions and thoughts in a ruling for people's livelihood..I'm beyond ticked off..By the way I love watching your videos..thank you Atty. I had a phone hearing today 7/9/20. I have crohn's disease with severe bowel issues, I also suffer from chronic pain. I take medicine that suppress my immune system, depression medication, and pain medication. The ALJ asked me about my daily activities and I was honest and told her that my daily activities had diminished substantially due to my disease and the medication I take. She later asked the VE were the any jobs I could perform based my trade and she said no. She then asked her about the hypothetical jobs, the VE said there were three but then the ALJ asked about were there any jobs I could do that offered readily bathroom visits, the VE said there was two a person with my issues could perform. Then my lawyer asked the VE, out of those two jobs would I be off task more than 10 to 15 % of the time and the VE said they both were excluded. I don't know what that means, my lawyer said its a 50-5O chance of being approved.

I just had my hearing on the 11th of August. My lawyer said I did great. The judge did ask me a couple of questions, more about my job history and how it's changed. Other than that I answered his questions,but with my mental illness I got a little overwhelmed and emotional. I've been fighting this for about 3 years. I hope I get good news 🙏

I just had my hearing over the phone yesterday. Wish me luck. I hope i get it. My atterny asked me some questions and then the judge asked me a couple of questions. Then the judge talked to the vocational expert and gave an example for hypothetical perosn number one and the expert gave a few examples of possible work. Then judge gave example of hypothetical person number two who had all my issues to the vocational expert and asked them if there were jobs that person could do and they said No. When I had first applied May 28th of last year my denial letter said that they found that I did have disabilities but that they still believe there were some kinds of work I could do. But now after the hearing yesterday I hope everything goes good for me.

I was initially going to say that I would prefer to have my hearing over the phone; but since my lawyer cannot be there....my anxiety would likely trip me up, making me sound like a liar😫😥
It is a judgment call. Some of my clients are coming to my office so we are together even when the judge is in a different location.

Very informative and helpful. I wonder if you have seen a trend in how ALJs are deciding the phone hearings now vs. prior to the COVID19 crisis. Do the ALJs seem more inclined to side with the claimant when considering the limitations in today's economy, lack of medical access?

I am very nervous as I am only 45yrs old and claim PTSD as my primary disability, I am already rated a sole 100% for it by the VA..bit as you pointed out in a previous video...VA records must be a mess. Any advice how to approach the hearing?

I had a phone hearing this past April. It pretty much went the way as shown on your past videos. The biggest problem I had was that a chiropractor, and my Neurosurgeon didn't submit requested information. They decided to give them a month to submit the documents. I'm still in waiting. My Attorney feels I have a good chance for a favorable decision, however I have fears if the Doctors do not send the Information.
Generally SSA does not give much weight to chiropractic records. I would put more effort into getting the neurosurgeon's records.

Just heard a rumor this morning that this new normal will go through 2020 and that the agency is going to push towards telephonic being permanent.
62 years old have solid work history, never missed a day except 20 years ago when I had pneumonia. I have aggressive stage 3 possible stage 4 prostate cancer that has spread to lymph nodes in the pelvic region, I have been on a clinical trail drug for three months after another three months they will perform a radical prostatectomy and remove lymph nodes from pelvis area. Then another six months of the clinical trail drug and six more months of Hormone Deprivation. The doctor said it not go away but this is to slow it down hopefully, I have no energy, losing weight, trouble with holding my bladder. I hurt when I walk or sit very long. I have been told prostate never wins disability by some people and others say it is cancer you should get it. My Gleason score was 17 out 17 biopsies 5 +4=9, epsien score 5, stage T3b meaning it has spread outside the prostate into nearby organs like the lymps is this enough? thank you
I had my hearing january 2019,I was not impressed at all with my lawyer.I got a "fully favorable" decision I think mainly because I watched and followed every video you did.Thank you again.2 1/2 years from start to finish.I"m sure it"s longer now-thank you again.My advice to anyone would be "Do your homework and your own leg work,get all your own medical records,go in there with your guns fully loaded!

To my understanding, it would not matter if the medical evidence is strong and they lie under the medical guidelines and you are honest.
Hello and thank you! you’ve helped a lot over the past as I’ve listened to your channel. I’m 62 and been waiting about 3 years. Got as far as my ALJ hearing (last July) and after denial, my case is currently in appellate court, I think. Law office dos not communicate much with me. My payout will probably be around the same that my Social Security will be, around $800 a month. At this point, I’m wondering if I should just take early retirement and forget about trying to win this case.I was just wondering what your thoughts on that are. Thank you

I had a hearing Nov ,2020 via phone with an ALJ from another state, due to backlog & Covid. It went really well. My lawyer was pleased. The judge asked about & wanted to clarify the date of on-set as soon as the hearing started & the vocational expert said there would not be any employers able to accommodate my needs. He did however ask for a copy of my most recent CT scan. My lawyer has since sent that in. Between Covid backlogs, the Holidays and the judge being from another state, could it take longer for his decision???

The website said id have a decision in six months. I have an inoperable hernia on my abdomen the size of a salad plate, from having 15 surgeries in a two month period. I have no muscle there. They had to do a skin graft to cover the skin that was gone on my abdomen. I also have a ileostomy with a retracted stoma which causes constant pain. I also had an abcess due to the retracted stoma and now have a fistula that is a second hole. I cant stand walk or sit for extended periods. Its depressing having to wait for a decision.

I was denied without any hearing, not in person or over the phone. I received a “Notice of disapproved claim.” Why did I not have a hearing?
My hearing was last Wednesday & my lawyer called & prepared me a week ahead of time. She asked me the questions that she thought they'd ask & she was right. I have a question the professional therapist they had on the phone said there were 2 jobs I could do but then my lawyer asked him if I could lay down at these jobs if need be & I also have HS & will miss a few days a month. She asked if I could keep these 2 jobs with those things & he said then no & the judge said that's all he needed to hear. Is that a good thing?? He has a 56% approval rate. What do you think my chances are?? Thank you for these videos.
I forgot the 2 jobs was cleaning eye glass wear or watching security cameras at businesses or something. He said at the end I wouldn't be able to keep those jobs because of my HS & my spine is deteriorating same well. I'm only 38.

Interesting, the questions asked of the VE in my hearing went the exact same way. First she listed three jobs she thought I could do. Then my attorney countered and listed the things that would prevent me from keeping a job (time off task, amount of absences each month) and the VE said no jobs available. I won. Not being able to sit in front of a judge and beside your lawyer is in my opinion a huge disadvantage.
I won't argue with you. The question is whether you are better off with a phone hearing now, or would you rather wait 6 to 12 months for a live one?

My thought is that your medical record is about 85% of whether you win or lose, your testimony about 10% and your lawyer's oratory brilliance about 5%. If you have a good medical record you should win.

I keep hearing that we're at a big disservice having the hearing on the phone and not even via video. If it's possible to wait for a live hearing or video hearing, understanding that it can take many months or longer for that to happen, would you generally recommend waiting? I'm hearing that the next phase might be moving telephone hearings to video hearings in your representative's office (if you have one and they have video capability). Thank you for your excellent videos.
Personally I have not had any issues with phone hearings and my sense is that judges are even more aware of difficult the job market is given the change to their procedures.
What about hyperhidrosis where your hands run water and when they dry they are very numb and locks up should I mention this while going through my disability for depression and anxiety also I'm waiting on a hearing date with lawyer
I would mention every impairment that impacts your capacity for work.
I’ve developed Anxiety and upper respiratory issues from exposure from gas and CO2 and in and out of work. I was turned down previous can I reapply.

I was just offered a court date by phone, in August, I am choosing to wait till we can do it in person, I feel my doctors haven't been doing a good enough job with, well, pretty much anything.. By waiting, I am buying myself more time to better advocate for myself. I am worried though, on how I will be able to talk during my hearing, I have problems finding words, thinking clearly, my mind goes blank often, I talk slow etc. This causes my anxiety to go sky high when put in situations like that, even just thinking about being in situations like that. I'm not happy that this whole thing is getting put off longer, but I'm even more unhappy about the lack of care I am receiving from my doctors.
I experience the same exact conditions you described! I have felt for many years, like the only person that goes through this every single day. If the VE says "no jobs" to every question then there is a very good chance that you will be approved.
I have a question I know that you have to wait 18 months for To see a judge but when they say that with a see you before the 18 months is that possible
I don't understand your question. The 18 months is an estimate - the actual time it may take to get a hearing could be less than 18 months.

I have a telephone hearing coming up in October 2020. My question: If the judge doesn't approve my claim, and my attorney makes an appeal, will the second hearing be by telephone also? Or will they require me to do an in person hearing?
We don't have any answers from SSA regarding live vs. telephone hearings beyond September or October of 2020. So what the state of hearings operations will be in 6, 12, or 18 months is anyone's guess.

It depends on the nature of your medical issues and whether you have support from your doctors regarding significant issues you would have trying to work a simple, entry-level job.
You won't know until you try and with the SSA, the sooner you apply the better.
