    This case pertains to 1987. Nowadays while registering the will, witnesses have to be present in the registrar office their biometric is recorded, in such case if witness becomes hostile what happens

    Simply Laughable and saddening state of Judicial interpretations. Surprised to know the judgement by Courts at different levels and each Court interpreting in it's own way.
    The various steps that were recommended by the Learned Advocate (in the video)
    are both complex and cumbersome.
    There could be circumstances where names of relatives to be mentioned in Lists of First, Second or Third preferences etc,. may not, even, be known or available to a Testater of a *WILL* . What used be said earlier, about WILL was that, it should be in a Written Form witnessed, duly, by Two Witnesses, who can testify, at any stage, the authenticity of the said written Statement. Suggestion to have the WILL *registered* is merely to fortify the written content and as a precautionary measure, to rule out any likelyhood of the said document being disputed at any time, for it's being fake or forged or otherwise. What should be of importance, is the INTENT of Testater and CONTENT of the written Statement- *(WILL)*
    The Judiciary and it's judgement should be aimed to aid Common Man rather than making these labyrinthal and complicate a matter further. Very disappointing state of affairs.

      Laws must be in simple language, clearly understandable to general public.
      They mustn't be vague and there mustn't be any scope for imagination or interpretation according to level of ignorance of the authorised interpreters.

    Our laws and acts are a joke. Act of 1925 and act of 1857 Which were enforced by the British is being followed that means we are still under the British law. Why these laws were not up dated to 1947 act? It's so very unlawful to follow it as indian constitution. Its the mistake of our government to have not updated it. Secondly a will if registered and still can be invalid due to witnesses not seen the person signing the will is again breaking the law. So it's the mistake of the witnesses and not of the validity of the will when genuinely singed under the presence of registrar. God save this country and it's people from this supreme court who interprets laws according to it's will.

      @@PardeepKumar-vb2bu yes I have read Hindu succession act. Yes even an unborn child ithe n the womb is a beneficiary. But here the case is different. When a couple have no children and the husband died then the sole right goes to wife and moreover it's not ancestry property that the husband side of family are eligible for the share. So the wife has all the right to give the assets to anyone she likes.

    This judgement is very surprising. What happens if the witnesses turn hostile or are no longer living nor can them remeber and neither is the registration authority or person alive or able to recall. Indian law and jurisdiction unnecessarily introduces uncertainty in this process. This goes against the spirit of making will. This judgement should be scrutinised very carefully

    To my knowledge, a will remains valid as long as the will was signed by the property owner in front of two witnesses of sound mind and the property owner is of sound mind. Registration of a will is not mandatory.
    I don't want to comment on the Supreme court's judgement, but it seems strange that after all this juggling, the original intention of the property owner got lost. What kind of judgement is this?
    Interestingly, when a court case takes 40 years, the original witnesses may have died.b

      Property owners' wishes should be respected and maintained and not left to court to interpret. Witness should not have any interest in the contents of the will. They are simply the witness of the owner signing the will. In UP, witnesses are confirmed by the biometrics and photographed.

    What Standing do Witnesses have in the Execution of the Will. Witnesses do not have any Right to be contesting the Contents of the Final Wishes of the Executant. All they do is Certify/Verify with Knowledge that they know the Executant on a personal level & that He/They confirm that the Executant has signed the Will by the said Executant in his Presence.

    I think the Hon'ble Supreme Court order is erroneous, The Registrar examines the witness before the registration, The Hon’ble SC opens door for the witness to become hostile after receiving quid pro quo from the new beneficiary. The role of the Registrar need to be underscored. The witness cannot be permitted to become hostile after a limitation period. NOT HAPPY WITH THE SC ORDER.

    The willfor registration is generally submitted to Registration dept. personally. The sub-registrar certifies itand generally witnesses sign in presence of him. Hence such problem should not occur. Even if the witness doesn't retify it, as the person submitting will has signed the same in presence of the sub-registrar, it should be considered valid. In fact witnesses are necessary if it is not registered. Sir, Pl clarify.

    Agar witness ko baad me dusra paiso ka lalach de kar kharid le tab kya.
    Aisi vyavastha honi chahiye ki sahi se will ka registration ho aur baad me fir koi change na kar sake, chahe witness palat jaye ya witness ki death ho jaye. Will banane ke samay jo faisla hua wahi full and final hona chahiye

    In many states now, will registration is done via biometric Aadhaar authentication of the witnesses as well as the property owner making the will in front of the registrar at the same time. Which means section 71 of the evidence act is fully satisfied.
    In fact, it could also be argued that the biometric record is sufficient proof of witnesses being valid under section 63 of Succession Act.
    Does this mean that a modern will duly registered with aadhaar biometrics will not face this problem? It will be good to confirm that such modern registered wills are indeed 'pucca'

      Bhai after seeing all these chutiya judgements, especially against Hindus(succession law) , do you think still think there is anything that is pucca? The best solution for the property owner is to transfer the property to the beneficiary via gift deed. So that chutiya courts can be kept away from interfering in our property transfer.

    I thought the witness only witnesses the signature and not the contents as that can require legal advice. A winess can not turn hostile in these situations as they can not deny that they witnessed the signature. If the law is too prorous about this, then it is a bad law that allows manipulations and abuse.

    बहुत ही अच्छे से आपने सारी जानकारी दी hai.
    कानूनी कार्यवाही में किसी छोटे से case में भी कितना समय और धन लगता है, इसे साफ होता है,
    पर निचली अदालते पहले हो क्यों नहीं, सभी लागल कोडस को फॉलो कर निर्णय कर पाती, उनके गलत या अधूरे निर्णय पर आम और खास लोग भी बहुत हैरान होते है और अपना बहुत सा कजसिन चैन, धन समय खोटे हैँ.
    क्या ऐसे इनकम्पलीट आर्डर करने वालो के विरुद्ध कार्यवाही, और कोर्ट के खर्च को वसूलने हेतु कोई कानूनी भी हैँ. जिनसे इन जजों को भी नासियत मिल सके.
    कानूनों में भी बहुत सी धाराएं बनी हैँ, हार धारा कि अलग परिभाषाये हैँ, कानूनी ऐसा होना चाहिए कि हर एक सामान्य आदमी समाज में आये,. यहाँ तो न्याय कि कुर्सी पर बैठे भी, इनका पूरा ध्या नहीं रख पर रहे रहे. वकील अपने क्लाइंट के लिए उसके फायदे वाली धाराव ओ पर जीराह करते हैँ जो संभवताये जजों को मालूम ही तभी होती हैँ.

    The judiciary has always complicated issues. They don’t understand their own judgements after some time.

    Sir Will is the intention of the individual and registration is done to buy peace and the question in this case was involved that the property was bequeathed by the teastor to the person of her choice whereas she also inherited the property of het husband.
    So she was required to detail the reason of denying class II legal heirs and giving the same to her close person.

    Ager couple expired hota hai aur unko koi child nahi hai .fir is case m jis ko jati hai property. 1st benefishery nahi hai toh 2nd kaun hoga ..pahle husband jata hai baad m wife jati hai ..sb wife k naam hota hai to wife k side se hote hai ya husband k side se .

    SC judgement is totally wrong, This means witness can turn hostile any time in future and can invalidate a valid will. 2. The witness signs under the line- signed by the testator in my presence. The Will is also usually notarized and at that time, the testator as well as witnesses sign in the presence of notary.

    सर नमस्कार सर एक प्लाट खरीदा पेपर मे रजिस्टर वसियत, और फुल पेमेंट रजिस्टर अग्रीमेंट रजिस्टर पावरटोनी के बाद रजिस्ट्री या मुटेशन हो सकती है। बेचने वाले के पुत्र प्लाट देने से मना कर रहे हैं। जिसने प्लाट बेचा है उसके ले लो।ऐसा कह रहे है । गवाही मे उसका एक लड़का है।

    सर सम्पति लीलावती के मृतक पति के बाद, उनकी सारी संपति लीलावती के नाम हो गयी थी। तो लीलावती के मृत्यु के बाद यह सम्पति लीलावती के भाईओ के पास जानी चाहिये थी
    तो फिर लीलावती के पति के भाई या उनके बेटे के पास कैसे वापस जा सकती है?

    सर यही कहानी हमारे साथ है विपक्ष के पास भी एक झूठी वसीयत है लेकिन जब हमरा केस तहसीलदार के यहां तो विपक्ष ने वसीयत का कोई जिक्र नहीं किया और तहसीलदार के यहां से केस हार गया लेकिन कुछ समय बाद अपील सिविल में लगाकर और झूठी वसीयत तैयार कर लिया और केस जित गया अब हमने भी अपील किया है क्या हमारे साथ भी ऐसा ही होगा क्या। सलाह बताओ

    Validity of a registered will should not be diluted on frivolous grounds because the registering authority, having collected the prescribed fee and charges, is deemed to satisfy itself about essential legal requirements in the matter. Any person who comes up to challenge a registered will must be required to prove that the registration authority had failed to do its duty.

    The moot point in the case is witness. Since the witness failed to validate the document, the issue had arisen. Had the document met validity in all respects, the Registration would not have been challenged.
