In 1977 my parents purchased a bungalow by making two sale agreements wherein half the land and ground floor of the bungalow premises was purchased in my mother's name and half the land and the first floor of the bungalow premises was purchased in my father's name. From the ground floor of the bungalow, my mother was running her small preschool. At that time I was a minor. In one corner of that bungalow there was a 'kuccha wodden cabin with a tin roof' in which a person used to stay with his family. That person was a 'dhobi' who used to do 'ironing' of clothes by using a charcoal-based iron (kolse ki istri). The previous owner had assured my parents that he will be giving vacant possession at the time of sale. However, as the dhobi's wife was pregnant at that time, it was verbally agreed that the dhobi will leave the premises after his wife delivers the child. After my parents took possession of the property, the dhobi refused to vacate claiming that he was a tenant of the previous owner of the property. This dhobi had also threatened my parents that he will cause hurt to me if they dared to evict him. As my father used to work in another town and only me and my mother used to stay in this bungalow, out of fear, my parents did not take any steps to file a police complaint. The dhobi had also tried to send 'rent' via money order to my parents which they never accepted. Till date, this dhobi is occupying a 10'X10' space in the corner of our bungalow's plot. A few years later, this dhobi somehow managed to get an electricity connection and thereafter started used an 'electric iron' to do 'ironing' of clothes. Every year, the Municipal Corporation sends a municipal tax bill which is in the name of my mother wherein, "XYZ Dry Cleaners" (i.e. the name of his business) is mentioned. My parents have never paid this municipal tax stating to the Municipal Corporation that he was not our tenant. The dhobi had then taken my parents to Court claiming to be a tenant of the previous owner. As I was a minor, I'm not aware what happened to that court matter. As on date this is what I know : 1. The Municipal Corporation had once come over and even demolished his 'kuccha cabin' but this dhobi built it back again the same night - I was still a minor when this incident had happened. I remember my father saying at that time that this dhobi had then taken the Municipal Corporation to Court after his wooden cabin had been demolished and that the Court had granted a 'stay'. But despite so many decades having gone by, I wonder why, this 'stay' has not yet been vacated ? 2. That this dhobi now has his own house in another area of the city since last 35-40 years and his family no longer stays in this 'kuccha shed'. 3. That this dhobinow also owns two small shops in a commercial complex which he has rented out. 4. That one of this dhobi's son, is now using this 'kuccha wooden shed with a tin roof' located in the corner of our bungalow premises and is continuing to do 'ironing' work. 5. Every night, this dhobi's son goes home and comes back in the morning to do his 'ironing' work. 6. That the municipal tax bill pertaining to this dhobi's shop is till date coming in my mother's name but we have never ever paid this bill. So, I guess, this dhobi's son must be paying it. 7. My mother out of total fear that this dhobi might cause harm to her preschool's students had chosen not to take any legal recourse herself. 8. Then, in the year 2006, my parents received a notice from the Municipal Corporation that the 80-foot road on which our bungalow was located, was going to be 'widened' to make it a 100-foot wide road. As a result every bungalow owner on either side of the 80-foot road, had to take back their boundary wall by 10 feet. As a result, since this road-widening happened, this dhobi's wodden cabin came on the road! BUT, FOR REASONS BEST KNOWN TO THE MUNICIPAL CORPORATION, THEY HAVE NOT YET DEMOLISHED THIS CABIN !!! 9. After I grew up, I moved into my own apartment. Then, in 2007, my father expired. And in 2024, even my mother expired. 10. Now, I'm running my mother's preschool from this bungalow premises. In light of the above facts, kindly let me know : (A) Whether this judgement of the Supreme Court makes him eligible to be the owner of that portion of the land on which this wooden cabin is constructed ??? (B) As this wooden cabin is now forming part of the public road, why is the Municipal Corporation not taking any steps to remove his cabin ??? (C) What recourse do I have???
