On June 21, 2022, the Supreme Court struck down a court order sanctioning transport of a prisoner for neurological testing in a search for new evidence that might mitigate his sentence. Because petitioner Raymond Twyford did not prove that the medical evidence would be admissible in court, the order did not qualify under the All Writs Act. Shurtleff v. Boston | Supreme Court Cases for Students
Просмотров 4352 года назад
On May 2nd, the Supreme Court unanimously held that Boston could not deny a petition to fly a Christian flag outside its city hall. As the flag represented private, and not government speech, Boston's flag-raising program could not deny the petition based solely on the flag's religious viewpoint. Doing so would violate the Free Exercise Clause. I'm a high schooler who regularly follows Supreme ...

Court Packing and Other Reforms

Court-packing became a hot-button issue during the 2020 presidential elections. But while it's received the most media coverage, it's not the only reform that's been proposed. I had a lot of fun making this video, and shared many laughs with my sister (who I collaborated with) over bloopers while we recorded. Hope you enjoy watching!
Employment Division v. Smith -- The Case Fulton Didn't Overturn

The 2021 blockbuster Fulton v. City of Philadelphia held that Philadelphia violated the Free Exercise Clause when it required a Catholic foster agency to certify same-sex couples. While significant, perhaps of equal note is what Fulton (and Masterpiece Cakeshop) didn't address the 1990 decision in Employment Division v. Smith. As a high schooler who follows SCOTUS cases, I created this video to...

Restrictions are both infringements and abridgements; therefore, unconstitutional!!! BG Checks represent the "imposition of a prior restraint," on the right to keep and bear arms, and are, therefore, also unconstitutional. There's no founding era analogous law to support licensing schemes nor background checks!!! But, that was a good report, young lady!

Glad I ran into this video. One thing that I find missing in your summary of the case is the constitution clauses the majority of the Court used to substantiate their decision. Which part of the US Constitution is the Court concern about when they raised "abridges political speech" problem?

Sorry for the late response -- I believe it's the free speech clause of the First Amendment. For a more in-depth answer that includes some case law, however, I'd recommend reading through pages 10 - 13 of the Court's opinion, attached below. Hope this helps! www.supremecourt.gov/opinions/21pdf/21-12_new_k5fm.pdf

The court was narrow in the case. Since the actions weren't purely retaliatory then it is OK. But it could have extended to the legality of the other punishments with respect to his elected post.

Audry... I applaud your effort, but I had a hard time understanding 1) the way you pronounce words and also the speed. I couldn't have gotten a clear sense of your words without closed captioning and 2. the complexity of the content. Fleshing it out to simplify the content would make it more accessible to a dummy like me. I sort of understand what you've pointed out, but it was a struggle. I'm deeply grateful to know there are young people like you. People like you restore my faith in humanity. Thanks.
