The filing fee in Florida is a little over $400. That is just a file the case and then there’s the background check fee. Additionally, if you decide to retain an attorney, an attorney will quote an amount for you of how much their retainer is to help you through the process.

Great question! Yes, absolutely. They could at anytime settle outside of Court and file a full settlement agreement and it will be done. That is the best option in these types of cases so I hope that whoever is being unreasonable in the case will come to their senses and they will come to an agreement. This playing out in public is not going to be beneficial to either one of them. Thanks again!

I agree that I don’t think this was a planned filing of the divorce by Jennifer Lopez. Clearly something happened that spurred her to file yesterday without an attorney helping her. So many of the reports suggest that they have been negotiating for months trying to get this resolved… this may have been her way of saying “I’m done” and we will let a judge decide it if need be. Yes, the Courts want to make sure they are thorough and have all of the information. All of the addresses is a requirement in the Florida petition.

That's a good question. I am not really sure about the specifics of your situation, but in some cases I have seen where judges do not feel a hearing is going to be productive unless it is in person, so sometimes they will require in-person appearance for everyone. In hearings where there lots of exhibits or witnesses are good examples of where it can be complicated to not have it in-person.

I would be shocked if it turns out they don’t have a prenup. But some sources have reported that they may not have signed one this time around. Guess we will see if they end up going through with the divorce. Thanks for the comment!

I would suggest you speak to an attorney in the jurisdiction where you live. I am only a practicing family law attorney in Florida and in situations where a temporary custody situation will not end and if someone has to go to court to end it, these can be extremely contested and complex cases. I have dealt with them before and they are not easy so you should call an attorney now to discuss your specific situation, your rights and the next steps to take. Hang in there.

To file a name change case in Florida it is usually a little over $400. Depends on counties and surcharges, but that it's usually a little more than $400.00. Tricky question as many times the department of revenue gets involved in purely child support cases and they have their own set of procedures for establishing paternity for purposes of setting child support through the court or by administrative order.

@@FoleyFamilyLaw A grimy game. I’m hearing that simply signing the birth certificate does not qualify as establishing paternity for fathers. I’m in Miami. My cousin’s boyfriend just had his daughters taken away. They lived with him since I met him, and also went to school by his house where their grandma (his mother) is a school administrator. Case of baby mama drama. The kid’s mother stuff accused my cousin of abusing them, and since he had not established paternity under the new rules, she was able to take them away from him a couple months ago. I always believed signing a birth certificate was establishing paternity. They have his last name and lived with him. I watched another cousin move back to Miami all the way from Washington State with her daughter because this new law was passed. And her child’s father never agreed on her taking the girl out of Florida. She moved back last year. Got a job here and all. I’m assuming legally she had no choice but to move back.

@@ritzkola2302new laws bring new problems and new issues that come up, all of these fact patterns can be different with a couple of different facts going different directions. The way we would advise people in these unmarried custody situations a year ago is way different than the way we consult with them now… and will probably be different again next year if some new cases come out, interpreting the law. The legislature will create the law, but then the courts have to interpret it.

@@FoleyFamilyLaw Is it ever possible to get judges on one solid accord when it comes to law in a particular state? We have a standard for most other things. I think people’s lives and freedoms should have a set standard for judgement as well.

Thank you for the comment. The law changed pretty dramatically and many many cases in Florida the normal age that we are going to see retirements in the alimony modification context is 67 years old. Now this doesn't mean the courts will terminate the alimony, they can modify it downwards or they may not modify it all if there is no reason to modify it. It's very case specific, but now the law gives more of a guide map for modification of alimony when someone reaches "normal" retirement age.

It's obviously people's choice if they want to get married or not, but if they choose to get married, a prenup is the way to go so you are not having the state tell you what to do if the marriage ends badly.
