    This podcast has really fallen from what it was. If anyone is listening to this with the first seasons in mind, just skip it. It's comical this episode exists after the blatant corruption in which Thomas has engaged. This episode is basically a retreading of his autobiography. Every bit of this episode rings hollow with outright misrepresentations of a corrupt, money chasing cheater that has destroyed any respect SCOTUS had. Thomas has played a major part in ruining this country, but this podcast would have you believe he's just done misunderstood guy that's intellect and ideals are simply above anyone's understanding.

    I have been so on board with More Perfect from the very start. Then this popped up in my feed. I thought, "OK, I'm willing to listen." But then the apologies and justifications started. Then, the Anita Hill situation is glossed over with a "Oh, everyone knows, we don't need to go into that." NO, absolutely not. If you want to give me a different perspective of this man and his fitness for service, you can't just gloss over and dismiss that. It is very likely that there is a sexual predator sitting on the US Supreme Court bench, you want me to consider a new view of him, you don't just skip over that. And where are the sources to give me a balanced view? Trust me, Juan Williams carries no credibility. Neither does professors from schools that churn out lawyers determined to align US law with Vatican dictates. I don't have to agree with what I'm hearing to learn or enjoy a podcast. I am, however, very aware when I'm being blatantly manipulated as a listener. More Perfect's credibility was trashed with this episode. Months after I shut it down at 39:24, the offensive approach of this episode is still taking up space in my mind. I'm in mourning because I've lost a trusted friend. I do not trust More Perfect without Jad Abumrad.

    This is a totally braindead recap. The Supreme Court didn't just "change their own rules" based on "their own preferences, their own biases, their own interests". To frame this case in such a way is completely dishonest. They directly applied The Four Factor test that has been well-established and was explicitly outlined in the 1994 case Campbell v. Acuff-Rose Music. In this case, the U.S. Supreme Court highlighted these 4 factors as guidelines for assessing fair use. 1. Purpose and Character of the Use 2. Nature of the Copyrighted Work 3. Amount and Substantiality of the Portion Used 4. Effect on the Market or Value of the Original Work The origins of these factors can be traced back to earlier case law and legal scholarship. It's also hilarious that you conveniently gloss over the fact that it was the Andy Warhol Foundation that actually sued the photographer. You characterized the genesis of the lawsuit as "one thing led to another..." as if the parties just stumbled into a legal battle. Who sued who? Say it. Your failure to define which was the plaintiff and which was the defendant is not even an oversight, it's deception.

    I appreciated the mention of how Jacobson set the precedent for the appalling decision to allow forced sterilization as well as the question of who gets to decide what public safety is. However, this episode operates on a number of false premises: 1. the propaganda that vaccine mandates further public health, 2. the idea that those who oppose mandates are "anti-vaxxers", 3. the assumption that getting vaccinated prevents us from infecting others, and 4. the belief that the smallpox vaccine was what ended smallpox (Find the date that the smallpox vaccine became mandated then look at the smallpox death rates for the years before and after this date). Julia Longoria, consider delving deeper into this issue and covering it from a fairer angle.

      Vaccine mandates are effective at reducine vaccine-preventable outbreaks, especially when the mandates were actually enforced and exemptions weren't allowed. Then actual scientific evidence won't sway you and you'll go back to finding some obscure blog or koch-funded idiocy using long-debunked talking points to confirm your own worldview.
