    If a landlord fails to notice and deal with an overflowing drain for years (like a fountain during heavy rainfall) after acquiring a hmo license that causes the neighbouring property to be inundated with damp, would they be liable for the damage?

    So essentially what youre saying is as long as you're a decent landlord and upstanding business person you have nothing to worry about. The tone and angle in this short excerpt is made to sound as though if you so much as own a small rental property youre going to suffer under this reform bill. The only ones to worry are slumlords who make other landlords look bad.

    Won't someone think of the landlords?? Sure, hoarding surplus housing from people who just need a home and forcing rent to skyrocket is immoral in its premise....but how else are these landlords supposed to get MORE money? Get a job? Disgusting.

    This suggestion is going to have the agreement from the landlords and the disagreement from the tenants. With vice versa for a suggestion for licensing of landlords. Whilst any type of licensing is an interesting idea, who’s going to pay for the administration of it? Oh, let’s all pay to have everyone licensed - not going to happen.

How about instead, we license landlords and grade them on how well they maintain properties, charge fair rents, leave their tenants alone to live their life as they choose, and in particular, mind their own f***ing business.

    As a very small landlord of 3 properties. I would never ever want to get rid of a good tenant. Surely landlords only want to get rid of tenants who either dont look after their properties or dont pay their rent.

    when talking about student tenancies the concern is with dedicated student houses for student groups- not individual students who live at another address with family etc. This issue keeps being side tracked. Why is purpose built student accommodation going to be allowed to create 12 month tenancies and "dedicated student properties" in PRS sector not?

    Is a kitchen fire door required for a small, low risk two -storey shared hmo victorian house? It’s a shared Victorian house of no more than two storey. A house with kitchen and living room on the ground floor and bathroom on the first floor. The whole house is let to four tenants, A, B, C and D, who have exclusive possession of the whole house. The house will therefore be used as a private dwelling by A, B, C and D jointly, as domestic premises and the FSO (Fire Safety Order 2005) will not apply. It presents no additional risk factors then no high standard of fire precautions may be necessary, having regard to the fire risk assessment. In addition, there’ll be interlinked smoke alarms on each of the floor levels and in the lounge and a heat alarm in the kitchen. This will reduce the hazards or chances that may cause a fire and reduce the risk factors, then a fire door in the kitchen shouldn’t be necessary. I believe that having the kitchen door closed, • presents additional risk factors • the tenants won’t be able to react quickly to stop a burning item that may cause a fire before it spreads throughout the kitchen or leave the house quickly before fire spreads throughout the whole house But if the kitchen door’s open, then the tenants can smell the smoke or see a burning item in the kitchen, they’re more likely to be able to stop that ‘burning item ’ before fire spreads throughout the kitchen and then the whole house. Among our friends, family and including ourselves we’ve experienced first-hand that we’ve avoided ‘possible’ kitchen fires on many occasions by simply being able to smell burning food and to stop the ‘burning item’ because we’ve got distracted or we’ve forgotten cooking appliances on the cooker or in the microwave.

      Hi Yes an HMO and indeed any Buy To Let property is required to have a FD30S fire door on the kitchen. The kitchen is by far the most likely sources of a fire and the door is essential to keep the fire inside the kitchen while the alarm system wakes everyone up and allows them to get our before they are overcome by boiling black poisonous smoke. No ifs, no buts as they say. The averse fine we see for fire safety deficiencies in HMOs is around £28,000 So it’s essential to ensure that every HMO from 3 persons upwards is duly compliant with HHSRS and the HMO management regulations !

      Yes, absolutely and you must insist on doing so. The local authority could issue a statement of works, but more likely an improvement notice as that is revenue in itself, but more viable is to issue a Civil Penalty for failing to comply with Regulation 8. Some will say that is a bit harsh. In reality that is what they do in most places. It gives job security to the enforcement officers.
