    If suspended durring an investigation and employer completes investigation and collective agreement says 6mths is allowed pending investigation but employer has now exceeded 6mtnhs, what can the employee do? The employer is also not communicating with accused employee even though investigation is complete and now the employee is 9mths suspended without a hearing or knowing whats going on.

    What if you are dismiised and your colleague with the same disease is not dismissed he's boarded, medically boarded .second thing is that you go to dept of labour for your uif.they tell you they can't help you because according their records you are ill not dismissed while on the other hand you have dismissal letter from employer in this situation what to do.lastly the final report is not yet out from the treating doctor.thank you

    Thanks for this, what if there is no psychologist of counselor provided inside the workplace or even via third party? Does the company just get one if an incident happens or are they supposed to have one (psychologist or counselor) by law?

      escape the situation. if this a 1on1 situation - it shouldnt be. then you just politely state that you will not partake in such an unprofessional conversation, and leave and SEE YOUR NEXT HIGHER UP MANAGER (your bosses boss) IMMEDIATELY or go to a lawyer. same goes for a hearing with multiple people, although i guess, in such a hearing with multiple parties involved there will be SOME level of professionalism and politeness upheld. if that does not apply and EVERYONE in the room bullies you? well. leave any way you want and dont come back, youre in the wrong company and you dont need the money from such people anyhow.

    Thanks Rich Aunty for enlightening us. I got 2 questions: 1. Where do we get vicarious liability insurance & what's the monthly premium range for say R1m cover? 2. Is there a liability cover that encompasses all other liabilities, esp. for start-ups or SMMEs? If not, then how many or rather what are all other liability insurances a company requires for it to be 100% fully covered?

However, I know that there is something called Professional Liability Insurance and this covers for vicarious liability. Perhaps you can contact our insurance brokers for more information and a quote. Hope you will find the right package to suit your business!
