Fucking assholes at the port. Street musicians should not be limited.
That reporter seems quite biased. His whole tone seemed to support the port.
you have to see how he talks. he's an outside guy and the news made him sit inside all day listening to us... He pointed out the musician in the background, but didn't mention how that musician would get a ticket because he was outside the box... He also made the most poignant points for us simple and clear for his audience. Free speech doesn't belong in a little box, this is America. He's done a few stories with me and usually has better edits than a lot of the others who have covered busking in San Diego... I will be uploading the port meeting when it comes online.
I see the Port Commission as a form of tyranny per Black's Law Dictionary.
You have to file lawsuits against the individual violating your rights also. By the way, code enforcement has no authority to issue citations

Well the courts have given a long list of things that are considered rights violations. for example, police aren't to make contact if there is no crime. (that is harassment.) 2 Police can't interview two 1st amendment rights, and skip one, because "they are obviously ok." that is selective enforcement. It steps over the 1st amendment and heavily violates the 14th amendment. Finnaly as a local judge has stated in a court case caselaw.findlaw.com/court/apl-div-sup-crt-cal-san-die-cou/116454075.html
as I was saying in the local courts the judge stated this about local ordinances, "Municipalities’ authority to make ordinances and regulations is governed under the California Constitution. “A county or city may make and enforce within its limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws.” (Cal. Const., art. XI, § 7.) “A conflict exists if the local legislation ‘ “duplicates, contradicts, or enters an area fully occupied by general law, either expressly or by legislative implication.” ’ ” (Sherwin-Williams Co. v. City of Los Angeles (1993) 4 Cal.4th 893, 897, 16 Cal.Rptr.2d 215, 844 P.2d 534.) If an ordinance “purport[s] to prohibit acts which already are made criminal by the Penal Code, it is clear that they exceed the proper limits of supplementary regulation and must be held invalid because in conflict with the statutes which they duplicate.” (In re Portnoy (1942) 21 Cal.2d 237, 240, 131 P.2d 1.)
also if you are well versed in these kinds of court cases for busking/ art and other self expression, its pretty easy to see a pattern of rights violations... Lookup depravation of rights under color of law.
@@merlinawakend the police can make contact without a crime. it is called consensual contact. you are not required to listen or cooperate, but they can talk to you. they can ask you questions, you are free to ignore them.

Update: the conviction for disorderly conduct was overturned and sent back to the trial court with orders to dismiss the charge because my conduct was entirely protected by the first amendment. I will be doing an recap video soon with a reading of the judges opinion as stated in the casefile.
I believe if you look hard within the Declaration of Independence, you'll find your answers that will stop these Park Rangers from violating our citizens rights of San Diego.
Thanks for posting this. I busk at Balboa Park all the time, doing music. The new zones are ridiculous. Literally a third are in dead zones that no one would normally set up at: six are facing the parking lot in front of the aerospace museum, which is an absolute joke. Another is near the museum of us, again where no one would voluntarily set up. Another is facing the botanical garden, which is currently under construction, meaning there is too much noise and commotion for anyone to do anything there. Four smaller spots are piled on top of each other near the east end of the prado, which means only one musician at a time can set up in that area or else they're playing over each other. And to make matters worse, during the time of the permit system, only entertainers had to compete for the designated spots, of which there were 25. People doing political, nonprofit, or religious stuff didn't have to use the permit system and use those spots. Now, the 26 available spots have to be shared not only by entertainers, but also the politicals, nonprofitis, and religious. So there is effectively more competition for almost the same number of spots. But because a large proportion of the new spots are actually unusable, stuck in deadzones, there is actually a lot more competition for much fewer (usable) spots. And on top of all this, the actual prado is off limits, even though for years musicians played along the edges without issue. Now, supposedly, it's a fire safety zone that has to be completely clear. And if that still weren't enough... the code is discriminatory against anyone using "equipment" because the zones apply only to people using equipment. That means if you want to stand and sing opera at the top of your lungs someplace, they can't really do anything. But if you wan't to play a harmonica quietly sitting in your own chair, you have to use one of the expressive activity zones because you are using a chair, and a chair qualifies as equipment. It doesn't matter if you are not blocking traffic or how little noise you are making, they can give you a fine if you don't move, because you are using your own chair. A violinist can do what they want because they can play standing and not use equipment, but a cellist who has to use a chair to sit has to use one of the zones even though they make the same amount of noise and use about the same amount of space. It's discrimination on the basis of type of instrument and the requirements of using the instrument, which I'm pretty sure means it's not content neutral anymore.

Be sure to write Venus Molina through her email at vmmolina@sandiego.gov as she has reached out to some of the artists that went with me to a meeting a few months before they passed the law to try and get our rights protected in the code, and they didn't really tell us about the expressive activity zones, then snuck the law in telling everyone a day in advance so no one could come in opposition. I have been trying to get them to just let buskers busk but instead they put buskers in a corner to hide them away. It's not for health and safety, it's to chill our speech, but really its to keep us from making money because if we do not make money, we all will just go somewhere else. Starve the Cat, and the cat will find food elsewhere. I tried for years to solve all of this, and thought we finally had it, till they made these spaces. They are an abomination. If they think they can ignore the 1st Amendment they're going to lose that round. But I am more than okay with the vending ordinance finally being enforced, at least intermittently. And by that I mean the bazaar-like set ups selling souvenirs by Children's Pool, not artists or street performers---I consider that to be falling under free speech.

@@merlinawakend Right. I think there are already things in place in terms of permits and so forth, and especially for a place like La Jolla Village those limits just make common sense.. And I speak as a former business owner myself, who had to do all the stupid licensing.

So far the district rangers have not said anything to me. Except, "hello." I have heard they did a walk around in balboa park and Ranger Habis told Magician Roberto that the district rangers would begin enforcing the new code may 15th which is coincidentally one day before the LA Vending trial starts. Several people have said they will refuse to comply with these draconian laws, and realistically there is not much they can do to artists. cite us with a ticket we can get reduced to 20 percent of the original citation, so get a 100 dollar fine, pay 20. get a 500 dollar fine pay 100. if you even bother to pay... Can't get blood from a stone when there is no threat of jail.
Fully watched the video. I will never, ever use one of those unconstitutional boxes for my table. The San Diego city government may need to learn the hard way what is and is not a qualifying, manner restriction that can be imposed on free-speech activities in parks.

#ThereIsNoLaw This is about control. If we had the $ this would not be an issue. The constantly consuming goons in government will do anything they can to make sure they get the free money first and those who actually contribute (their biggest threat) get the $ last.
As individuals we are all screwed, but as a community, we have the creativity, the resources, the knowledge and the power to change it... We can stand alone and break, or together and break it. I alone can do so much more if I had resources. But all my resources come from creating in the street and from a few buskers/artists that toss some money my way for this fight. All of us together, pitching in our skills, our resources, our ability to do the reserarch, do outreach, reach out higher up the ladder to someone who cares who can change it, reaching out to lawyers till we find one willing to do a big class action on pro bono... So many things that we can do to change it, but we all got to set aside time to meet, work on tasks together, discuss plans and ideas. And put those plans, ideas and tasks together to create the change we want to see. I have two lawyers on the issues from last year, one of which may or may not challenge this code. Depending on how it all goes before they file the complaint. So far though no one has been cited, so there is nothing to challenge.

If you catch government persons exercising authority under the constitutional oath, then put them on notice they lack authority outside a Free Speech Zone.

The people charged with upholding the law tend to know the least about the law. I’m far more knowledgeable in my career than I was when I started. This doesn’t seem to be the case with law enforcement. Far too many of them do not understand basic rights.
I do not get why people in law enforcement refuse to self educate and grow.... its a privilege to do so, and we now live in a time when self education is easy.

Dude, print-out several copys of relevent state and federal statute, and case law, next time those thugs confront you, hand them the printout, if they refuse, ask them why they refuse to do due dillegence, piont out that by refusing to look at, and comprihend the law, youbhane no qualified immunity, im dropping this on your jacket, and suing you personally for official oppression.
I have shown all of them the relevant documents, they still choose to ignore the law.. The rangers and the city are already creating the potential for a multitude of lawsuits.

I am pretty sure free speech zones are the rights violation, considering all public space, is a free speech zone. creating prior restraint on free speech. Making contact without a crime, is also a rights violation. 4th amendment.

What the guy actually do what are they telling him
so this was ranger outreach and education to all expressive activities that the following week enforcement of the new law takes effect and they want us all in "designated" Free Speech zones. That are all 8 x 4, which greatly reduces our ability to reach our intended audiences, one because it effects our displays and work zones, 2 because many of these spaces are kind of out of side of the main view of tourists. 3 these spaces will actually create issues between buskers because of how limited they are and there are few within decent foot traffic locations... The ranger was also inhibiting the person from doing his expressive activities going back and forth over this stuff instead of reading the code to see if everything in it was legit. ITs full of issues.
I think the Ranger handled that as best he could. His superiors need to retrain the rangers on the actual law, because I don't think they know what the law is. Uninformed as to what is public and where people can express their rights.
This ranger has been the most courteous of the majority of them that handles enforcement of these laws. Others completely ignore this stuff, because they know that this law is tricky and might step on some legal precedent. But yeah this ranger was nice, but clearly based on what each ranger says, they are not training them properly.
This is my own opinion but I think you will perhaps embrace my rational. The Qualified Immunity doctrine is a good one for the age in which it came into being, because 50 years ago, it would be virtually impossible to quickly and easily determine the legality or illegality of their thoughts on whether a crime had occurred. Today though, a reasonably smart teenager with a cell phone can quickly and easily determine the law. I believe that if a cop is unsure if a behavior is unlawful, before detention, they should be required to do a web search before detaining someone. I saw youtube video from a street artist in San Antonio using chalk on the sidewalk a while back being arrested and before they put the cuffs on him, I was able to look up the graffiti law for Texas and read that to be graffiti, it had to be indelible, or an etching, and anything that could be easily washed off was legal. Qualified Immunity should be modified to require a good faith attempt to look up the law they think is in play before demanding ID or making an arrest. Worst case, they could have someone at a desk that they could radio. My hope is that in 10 years, there will be an AI that cops can radio and ask simple questions like "Is using chalk to draw on the sidewalk a crime?" When that happens and cops are compelled to use it as they are with body cameras today, perhaps a lot of the abusive policing will be reined in.

Hey! I'm that random person who butted in at the end there 😁 They say they want to "work together" with the public, but what they mean is do as they say and dont argue with their fascism. WE the people make the laws. The Constitution guarantees rights, regardless of local law. I for one love to see the venders and performers there. One of my favorite parts of Balboa! I am going on Saturday to do a little light chalk protest.. thinking around 10 am. I'll also have my art with me and be attempting to get public awareness, while displaying my art and attempting to make a little money because this stuff has eaten all my revenue... I also did a little chalk protest in La Jolla yesterday! Might go back for more today!

@@josephcross9684if you do a search on my name William J Dorsett, a plethora of examples come up. it might take you a while. But i had two permits removed, I got the police to mostly stop bothering buskers and artists. I have had laws changed in the port for their expressive activities and continue to try and get more changes done. I have done a ton of outreach to the city of san diego and had them write in protections, but they wrote them in vague last time. this time they are clear but they regulated us out of the better areas and of any decent size, so I am seeking outside help. I already have two lawyers handling issues that were caused by the city last year.

This cop was. He was very friendly and helpful and OP is breaking a city ordnance that prevents random selling of crap on the sidewalk.
did you read the city ordinance? this is not selling of random crap on the sidewalk it is expressive activities, which even the city admits are protected speech. Let me ask you this do you think you should have to sit in a 8 x 4 space to engage in your first amendment rights or do you understand that these rights are allowed where ever there is open public space? If you think your rights can be restricted to a 8 x 4 space, then I suggest you try busking and see how well you do in those constraints.@@ericw7754

Cops biggest issue today is pride and ego. Let go of pride and ego, admit they are wrong or could be wrong, pick your battles. Some cops get upset when people challenge anything they say and then escalate it. And they say ignorant things like “oh you’re a lawyer?” “Oh your one of those people?” As if knowing your rights and excercise your rights is crazy. It’s sad. People have let cops have free rein without challenge, so when someone does challenge them, cops get stunned and then get upset. Why it’s so important to video and stand up for your rights, what cops can and can’t do, or lose your rights. I print of my state/supreme rulings on what they can can’t do as far as stopping trying to id, etc. highlight what cops can do and keep in glove box and on me so IF a cop starts to violate, I hand to them, and they can’t play ignorant. Which ignorance of the law is no excuse for cops. And if they proceed to violate my rights well they then knowingly violated them. Video video video (body cams to hard to get footage) and lawyer lawyer lawyer. Unless you’re good with dialogue then just don’t answer questions and lawyer up.
I have print outs, I am pretty articulate until my brain glitches... And I am lawyered up, double time. :) Literally I have two lawyers working on cases for me, one of them, is a supporter of my activism.. So I am doing pretty good, and all the crap these guys keep doing is making my lawyers jobs easier. :)

@@ericw7754 nobody said they weren’t polite. Professional can mean 2 things, you belong to a profession or a person who’s qualified in a profession. Meaning I can work somewhere but not have the skills, not do the job as well to be a professional yet. I can be polite and not be a professional. I can be polite and be wrong. Why do you think most people when debating with officers and the citizen asks for a sergeant? Because in most cases he or she has more years at the “profession”, have more knowledge and are “professionals” at there job. So in most cases when a sergeant is called and arrives, they educate the unprofessional “polite” officers on what the laws and ordinances are and mean, and either reinforce what the citizen says, or will just have the officers back down and leave (picking the battle) because the officers were wrong or too gray of an area to pursue and escalate. Sure the officers were polite but professionals….debatable

at 9:16 in the video a young woman comes in and starts asking all the right questions of the ranger. About if the area is public space or not, and if people are allowed to express themselves publicly anywhere they want in the public. This is why it is important to know your rights.
Didn't they close the Cove to people, as a 'natural habitat' for seals, etc. Even though it was man made for children to play in somewhat protected from the waves, or something like that, it's been a long time. It was also funded in perpetuity to provide safe ocean access for children, and people that just wanted to lay on the sand. We were going there as kids in the seventies. Scuba in the eighties. Didn't look anything like it does now.
