    Why is it that the STSM Act states that trustees should not be remunerated although it could be done by special resolution.? Considering the complexities of trustee responsibilities, workload, and execution of their fiduciary duties, should it not be compulsory to remunerate trustees, especially in large complexes?

    All successful companies worldwide have a CEO. Chairmen in ST do not have any more power than any other trustee. That in my view is one of the reasons ST complexes have problems. Nobody is actually in charge. After board meetings, the CEO must be able to execute the decisions taken at the board level. At the moment nobody takes that responsibility.

    Yet again the complexity highlights the weakness of Sectional Title schemes. This prevents/ hinders progress as centralised electricity distribution fails. And a select few specialist attorneys etc get richer on it.

    What if the Complex is 7 years old and now some the units have major leaking problems? This might be due to settling cracks? This was all due to heavy rains this year.

    What about a body corporate that charges ridiculous high levy and yet not getting involved in a theft inside a unit not even doing inspections after this type of theft as well as not assisting financially when geyser is faulty. How to deal with these challenges….and I have been asking the body corporate to give me break down of monthly expenditures towards my unit seeing that my monthly levy is tooo high ….looks like a money which I just give away every month. Any advice out there as i don’t know what I am actually paying for regarding this huge monthly levy? Any advice?

    The erection of a wooden pergola (nice one proper workmanship) on 4 legs fixed to the wooden deckfloor adjacent to a wall on the patio , not fixed to the wall structure, is there any justification to refuse permission?

      There can be a few reasons why permission can be refused. This can include but not be limited to : The esthetics does not fit in with the complex , the structure will be on common property , the structure may be unsafe in bad weather, Council would not approve building plans for such a structure, there may be a Restrictive Title condition preventing wooden or steel structures, the maintenance of the structure may be problematic ( if on common property it will become a the BC's problem , other owners will object to such a structure, it may interfere with landscape plan of complex ... to name a few.

    Are we owners in sectional title covered inside the units or is it just common property

      Good morning Donella, the inside of the unit will also be covered like the walls, carpets, tiles, fixtures and fittings such as cabinets, toilets and kitchen counters (basically anything that is still attached to the building when you turn it upside down) but the household contents and moveable items must be insured under the unit owners person policy.
