Is there any guidance on what constitutes the terms “mild, moderate, severe” for Radiculopathy? I know the OIG determined in 2019 the regs are too vague. The DBQ is also. Just wondering if you have any guidance or experience on this topic in terms of what evidence determines which category. Lastly, am I correct there is no 0% rating for Radiculopathy and Sciatica? Minimum is 10% each limb?

Just because a DBQ is not “required” for a FDC doesn’t mean that the VA is prohibited from requesting one. I think even suggesting not to go is poor advice.

It doesn't do any good when you have your HLR, and you're not even being allowed to give page numbers. I'm your CFile. You submit fully developed claims with DBQ and Nexus statments denied with no explanation

My one question would be "When" is it a good time to ask for the C File? I've been retired for over 20 years now. Filed after retirement and got 40%. Fast forward to PACT Act passing and now have applied and currently 100% for prostate cancer, which will more than likely end months from now. But I also need to apply for one or two more things, coming up. Plus reattack my initial PACT Act claim for a few tweaks/corrections for Diabetes. DAV is my VSO...for now. Looking at adding issue with Thyroid now. All Agent Orange related.

For me, it’s staying focused and motivated on filing my initial claim. It’s overwhelming for me and now I have only 6 weeks before my ITF expires.

I FOIA’d my C-file in January, the VA says it’s complete in the app and available for download. However, it’s just the last claim decision. I’d be interested in others experiences. Do they mail it, and the 2-6 months starts after it’s showing complete?

The Wounded Warrior's Access Act was passed several months ago. It is supposed to allow a Vet full access online to their C file, just like an accredited rep can do. I read the full law online and it states the VA has a year to implement it. Let's see how long it takes the VA bureaucracy to implement this. Why aren't any of the videos about VA disability compensation talking about this?

I'm still not clear on how to request my claims file online through va.gov. I don't have an 'accredited rep' and don't want one. I have a simple FOIA for my C&P from my hearing test, and it's been pending for a year. Aggravating.

Nowhere in any of my decision letters does it state RFE or Static. Nor does it notate anything on the code sheet from the VA.

How can a back pay be so much? I thought you could only get the ammount dating back to an intent to file, of you have been out for a long time. If this is the case, I am going to hire a lawyer asap. I denied migraines when I got out back in 06 and finally got a 50% 4 years ago.

Great work, Jason and Clay! Thanks for keeping us educated. After reading Chris Attig's, veteran (Army Capt), and VA attorney website in 2012 he encouraged me to get a copy of my C-File. Chris said he was responsible for the delay in getting a copy of the C-File because he had notified so many veterans on the importance of having it. During that time, it took less than two weeks to receive a copy. My fastest time in getting a copy was less than a week when I requested one by phone when I assisted a homeless vet in 2014. Unbelievable! Also, in the past, veterans were getting a copy from their local regional office. Again, thank you guys for all what you do! Retired USAF Veteran and VA Benefits Volunteer

I originally had 100% temporary with future exams. The VA only looked at my prostate cancer, which may improve over time. My cancer spread to lymph nodes and bones, which my private oncologist said was not curable and have approximately 5 or so years remaining. My doctor wrote a summary of my situation and I sent it to the VA with a request to make my rating 100% P&T. They approved it within 2 weeks.

OSC is the only entity providing transparency. VA OIG is under the thumb of VA and all they do is make suggestions about what V.A. should do. They have no power and this is why nothing ever changes. The laws need to change to force legal accountability upon these SES and managers who lie, cheat and steal money from the veterans and hard working civil servants trying to serve them. It is despicable what these people get away with and the continue to lie with impunity.

Happens all the time at V.A. and it’s covered up, none of them are held accountable and until they are thrown in prison it will never stop

Now, Service Treatment Records from active duty are extremely important.

C-Files are important but we and our accredited attorneys can also look at your online C-Files at Va. gov

There is a FAKE VETERAN named "Huckleberry3447" on RUclips that obtained a FREE Veteran's National Parks Pass. She is NOT a Veteran. She quit the Minnesota National Guard delayed entry program in the 1990s but claims she's a Veteran. She used her unconditional separation NGB-22 to get a free pass. She NEVER went to basic training, NEVER served, NEVER issued a uniform. She's a LIAR and a FRAUD.

When I moved to Virginia, it was a conservative state. I slowly watched it. Turn into a Democrat hellhole Virginia has fallen so far.

I was able to get mine from VSO.

I just had an epiphany from the supplemental claim strategy you mentioned because I have lots of evidence, but will still be talking to a VA attorney if they can find the time to talk to me. I know they only spend time on winning cases.

@Michael 0 seconds ago I have 90 % rated. I went for C&P exam for lower back pain, that I say is Vietnam service connected. I was told by the C&P exam. that I met the rating Qualification for lower back pain. I forgot to ask what the rating percentage was or for a copy of my test. I was thinking about what he said he needed to do before completing my C&P Exam. The question was he needed make a decision if my injury was during my Vietnam stay or after. Is he able make Opinion on my exam.?

Is the C file on a disc or can they electronically send it to me? I requested mine in April.

If I would have filed earlier for my PACT Act claim I would be getting 18-20 months back pay at 100%. I filed in June of this year so now only getting back to June 2023.

Im working on a supplemental now, is that considered an appeal? Most of my denials were due to service connection, and I feel confident I have enough evidence to prove direct. Still requesting C-file as recommended, I just don’t think I’ll get it in time.

Why is this C file such a hot item all the sudden, seems like everyone on RUclips is talking about it. Would have been nice to know this stuff 10 months ago not that I don't appreciate you covering it. I'm in the middle of a claim that appears to have been torpedoed by multiple VA employees and VFW representatives. I was applying for depression secondary to tinnitus and the the VFW rep. I wanted a secondary to tinnitus 4 times he still submitted as a stand alone claim. After it got rejected he filed for a Higher Level Review and within days sent a supplemental claim. Now I'm fighting for my life to save this claim and no time to get C File. Thanks you for all do, I enjoy the videos.
