    Damn I just noticed I’ve been screwed!!!! I was just granted 70% PTSD & 50% sleep apnea combined rating of 90% starting from my intent to file date of Aug 11 2023 and the decision was made July 11 2024. That’s 11 months of back pay I should receive at 90% it already says 19k is going to get deposited. I did the math it should be more like 24k. That is messed up

    If you have the three things, Nexus, diagnosis and symptoms for a claim of these three, does a secondary claim to an approved claim mean you don’t need a nexus for the secondary claim?

    I logged in several times this year and can't find my decision letters. I found my medical appointment history back to 1979 but no decision letters.

      Yes! The backpay fairy tends to show up randomly. Your decision letter usually arrives after everything has happened as it is snail mail. Normally a decision can be seen on VA.gov weeks before a a decision letter arrives in your mailbox. A check or deposit to your account will happen somewhere in between those two events.

    i did research for a month then submitted intent on sept 3, 2023, continued studying and submitted new claim first time ever online Oct 7, 2023. So now if I win I should get paid back to Sept 3 2023 if i lose i will likely get attorney for appeal.

      Continue educating yourself Jules! In my personal journey I spent so many hours in forums and watching videos just to get to a baseline level of competence. I think using a 3rd party is a good idea if you don’t want to fight for a prolonged period of time. Give us a ring if you need any help, otherwise a good attorney is a great option especially if you have a complex situation. Best of luck!

    PACT changed to game. Did my own claims to earn 80% in 5 months. No service helps you form Dr visits with the right ICD10 codes and appropriate DBQ notes.

    Had 90% out of AD due to the BDD program at Fort Cavazos in 2014. Didn't think about submitting for anything else until 2021. One of my VA doctors wrote a Nexus letter for me, and I used WWP VSO, who is a former VA rater, received 40% SCD additional. 2023, submitted a claim for three increases, one was maintained, one was increased 10% and have a C&P exam for the other in the future, but am now 100% without paying a company or "coach". All the information is out there, the veteran simply needs to access it.

    Here's a tip: If you have all your healthcare in the VA system and you are filing for a condition that you are being treated for at your VA, ask your doctor to write you a Nexus letter tying your condition to military service, especially if you didn't go to sick call/Hospital for the condition. The VA provider's word (Nexus letter) can give you a slam dunk, depending on how they word it (highly likely, more than likely, as likely as not) etc. Also, if you are scheduled for a C&P exam, bring the Nexus letter for them to read.

    I have a question. I was discharged honorably for a MH condition that I never had and didn’t fit the criteria for.Now finally a HLR rater recognized the error and stated that I never fit the criteria and sent the claim to wherever they go to be corrected and rated.my question is when it gets rated will backpay go back to the date of discharge.The 365 day rule doesn’t apply because the anti-social personality disorder mis diagnosis that I was discharged for was not able to be service connected.The actual diagnosis of PTSD that I am currently diagnosed with should have been made then.how will this most likely play out.

      You will have to submit for PTSD related to trauma in AD. How it plays out will be determined by whether you have a Nexus letter and what your treatment history for PTSD is in the VA system or if you were treated by a private mental health provider. Would help if your current VA Counselor or Psychologist wrote you a Nexus letter.

    There’s one question I desperately need an answer to: My BVA appeal was recently approved. It had multiple issues. One that was granted was sinusitis (10%) and rhinitis (0%). Both are up for reconsideration at higher rates, depending on the results of a C&P exam last week. My question is that these were approved under the PACT Act, due to presumptive conditions of burn pits in SW Asia. The problem is that I never served in SWA and never claimed that I did. My Nexus was multiple sinus and rhinitis emergencies when descending from altitude in F-4 phantoms, well-documented by flight surgeon treatments in my medical records. Am I responsible to tell them that they got this wrong? Nothing I sent them said anything about burn pits or serving in SWA. If so, how would I report it to them VA Form 21-4597b? 4138? Something else? My VSO does not return phone calls so I’m on my own on this. Thanks for all you do.

      Frank, none of this is legal advice just my opinion: I would take a look at your decision letter and see if they approved your claim because of “in service medical records.” A lot of times the VA will just blanket state that you submitted your claim under the PACT act, or TERA or whatever else they decide to lump your claim into. If you won the claim because they found active duty medical records for those conditions, I would say you are covered as they are not actually stating you are service connected due to burn pits, its likely they just copied and pasted something onto your decision letter. I would leave it alone in that case. If they are stating you served in SW Asia and won based off of that alone, then it’s a judgement call on your end. I will say from painful experience that the Uncle Sam never forgets and never forgives when it comes to collecting money lol. If you need to tell a VSO, simply find a better one (you may have to go through several unfortunately) and ask them for help.

    if you have a claim in and you check the status online and you see an entry and a date under type of evidence that says CAPRI , that is the gateway from DBA to VHA for DBA to get a PDF of all your med records so yes hopefully that happens quickly. after one month of a new claim my the DBA fot a dump of my med records form the VHA and I should know if i win or lose in 30-60 days. I have not had a request for additional info from me and the letter I received on Oct 7 said a C&P examination may not be necessary in all claim. fingers crossed.

    i have an account with myhealthevet blue button premium and have downloaded all my records to a pdf file.. it is the same thing the VDA does to get info from the VHA. the software that speaks from dis office to health care is called CAPRI.. if yu see a CAPRI entry when your status list it means the the raters are getting your med records over to their side...

    Great advice if only can see your health care provider. Usually you see a nurse who tells you that they will inform your provider nurse about your concerns. Brought up the subject with the provider only to be told that there is no mention of any kind on my records. Basically it went to no where as the first nurse just let it die. DOA as they say..

    In 2000, the VA spent about $2,700 annually per veteran. In 2019, the VA spent $11,800 annually per veteran. Post 911 Vets have blown the budget wide open!

    Example for one of my claims based on your video - evidence i submitted str 5 in-service headaches events i had surgery to stop my headaches the headaches continued i was diagnosed with the headaches in-service - my VA records show headaches complains with medication given at the VA - veteran private records states headaches complains - veteran evidence is a royal flush - VA denied this claim for 11 years claim was filed in 2012 - after a remand was done veteran went a Qtc examiner doctor asked the veteran 4 questions and measured the scar from the surgery took 3 minutes - i did a foia to get a copy of the IMO it matched my medical records to a tee a strong positive IMO opinion claims granted with 11 years of retro backpay in my case evidence a diagnosis my person statements mint nother to the VA examiners and the raters or the dro officer all wrote the same false statements they were in-sync together they made one hell of a team against the veteran and they still doing the same thing now in 2022 and 2023 veteran did everything right still get denied by VA examiners and raters - gets approved when he goes to VES AND QTC EXAMINERS - QUESTION IS WHY ???

    What really sucks with the VA System is that they don't seem to realize that some veterans aren't really al l there. I tried to apply for VA disability benefits back in 1991-1992 when I first started going to the VA Hospital. Was told by the BVA personal that I didn't qualify as my injuries didn't happen in a war zone. I'm a Viet Nam Era Veteran age 71 who was never sent to Nam. I have PTSD, MST, anxiety issues ,anger issues hearing lose, ringing in the ears tinnitus and a host of other medical conditions all military related. Oh yeah I forgot TBI as in Traumatic Brain Injury possible military related. My brain doesn't work like a normal person who doesn't have these issues. I'm homeless and living on the streets of Sunny Southern California. I been seeing a therapist for over a year maybe two. My therapist informed me that I was entitled to receive VA disability as a veteran. When I applied with the help of a VSO that I was finally able to locate I was denied on all of my claims. This was during the COVID-19 period so I wasn't able to keep in contact with my VSO and I was having a lot of issues with my PTSD brain . One of reason I was denied was I wasn't following up with my appointments. Bullshit I never missed one appointment with my therapist and as far as being able to get to see my doctor I tried countless times to see my doctor only to be told that my doctor wasn't able. Was referred to the ER were I was told to go see my doctor. Going back to the appointment desk I was instructed to talk with a nurse who told me that they would inform my doctor nurse. Was also told that if I made a televideo appointment I might be able to talk with my doctor.🤔🤯 I think that my doctor was just afraid to see any patient in person. Can't prove it but the whole time I would never get to see my doctor. Once they sent me to a different clinic to see a different doctor Turn out that person was only a nurse. Was told this the next time I was at the VA Hospital that it was a nurse that attended to me. Was referred to other doctor s and clinics but I was the one who was supposed make those appointments. I asked how was I supposed to make this appointments as I was just the patient. Was never given a answer back. So much for care of the veterans. Many times I would have to just walk away as my PTSD would start ( anger / anxiety ) . If I didn't walk away I sure I would have been arrested by the VA police for who knows what. Used to sign off A Proud Viet Nam Era Veteran age 71 homeless and living on the streets of Sunny Southern California. Not no more as I am no longer a Proud Viet Nam Era Veteran. I'm just to old to try fighting the VA System as time is on their side. Forgot they expect me to do my research and who knows what else on line. Sorry but I'm not a tech/internet person. They don't realize that there are a lot of veterans just like me. Maybe they do realize it but figure that most will just give up than fighting the VA. When bonus time comes around they will receive nice fat bonus 💰💰💰💰💰💰💰💰💰at the expense of the veterans. After all we are only a four digit number to them.

    Its true. I'm a veteran and used to work for VBA processing claims. There is a point system and if employees didn't have a certain amount of points per month, you would get in trouble. I hated that because I'm a quality, not quantity worker. We had to do mandatory overtime because of the backlog. There is a high turnover rate with employees because it's a stressful environment and i only lasted a little over one year. Working for the VBA caused my stress/PTSD levels to be at an all time high. I would never ever go back and do that type of work again.

    I have a question. I was diagnosed and then I was given medication and my symtpons went away or slowed down alot, I have a CMP appointment soon, when I talk about what bothers me about my conditions, do I tell them how it used to be without medication or how the symptons with medication?

      Nothing you hear on this channel is legal advice. That said, I am going to agree and lean in with what egman5225 is saying. If your disability is permanent you are “safer” from a reduction as the VA has conceded that there is no chance your disability gets better. I am paranoid though and would always go and complain accurately to how bad your disability is so you have a paper trail. Be careful what you say on your C&P exam, you don’t get to choose when they examine you. Many a veteran showed up to their exam saying they were fine and regretted it (myself included) later that night when their conditions flared up.

      Doesn't matter. VA will still fu%$ it up. Less than 20 page claim, IMO/nexus with DBQ, medical evidence, what did they do? Sent out to Optum for paper review, denied, no mention of my docs or in the decision, why imo/dbq weren't adequate. Took more work to deny than grant.

    Easiest way is to submit a simple claim and get the CFile. Bases don't keep very old records and Natl. Archives only had a few records. I got records back to 1998.
