So sad and unfortunate to find religion to get such priority in 2024! When can human become rational like any another animal? Religion is just other side of education. Doesn't everyone read about evolution in school textbook? Why being rational is so rare and similar to solar eclipse? Is being rational so difficult because of religion's influence from childhood? Reform is required to simplify everything. As number of pending cases are so huge, we shall concentrate how to reduce the differences amongst human as much as possible rather than increasing if we think ourselves as civilized, modern. Who can tell that tomorrow there will not be demand from parent religion, say hindu- they need different law for different devotees based on the hindu god A/B/C he/she worships. People may find that a Judge cum devotee of A favours devotee of god A while remains unfair for devotee of god B. Every religion has few subcategories or child religions.

Secular India should have no religion based law, just the freedom of religion.

If article 25 is a constitutional right and if constitutional right are enforced in the court under article 32, then court has a constitutional duty to decide on religious matters. Why there is backlog? Because judiciary is full with false cases of dowry, maintenance, DV, rape, SC/ST Acts,and what not. Because of this genuine cases take 7-10 yrs just in lower court. There is no attempt from judiciary & government to implement punishment on filing false cases and deter influx of more false cases in backlog. And it will never happen because it will impact judiciary business of lawyers and judges.
