    In regards to when second marriage couples draft an estate plan together simultaneously with each spouse being present. What has crept into Probate Estate Law is FRAUD if I may be so bold. Time after Time after Time both second marriage spouses having their own sole owned assets and property even prior and throughout their second marriage keeping everything separate. Your comment stated that after the first deceased spouse dies that the first deceased spouse has no insurance as to the surviving spouse will comply with the promises made in the surviving spouses Will to the other spouse when the initial wills were drafted. Well I beg to differ, once the first DECEASED spouse dies this locks the first deceased spouse into a legal obligation to comply with the legal document to which the deceased spouse drafted. CORRECT. OK well we have to focus upon why did the first deceased spouse gift the surviving step parent spouse all of her sole owned assets and property to the step parent other than dividing it equally between their biological lineal heir children. Let's review the surviving spouse will and see what provisional promises to which the surviving spouse has promised the now first deceased spouse. Now we understand why the first deceased spouse gifted her second marriage husband all of her sole owned assets and property to the step parent. Cause the step parent promised the now first deceased spouse that upon his death he will divide the now combined assets between both children equally in fee simple. Now let's not lose sight of the Fact that we have to remember that the first deceased spouse upon their death is locked into a legal binding contractual obligation RIGHT and of course as being now deceased that spouse is unable to amend or codicile or revoke any of the provisions in their will. CORRECT Ok It's still left up to the surviving spouses final decision as to whether the surviving spouse chooses to ACCEPT the testamentary gift If the surviving spouse indeeds accepts the first deceased spouses testamentary gift which was gifted from the promises to which both spouses had drafted together simultaneously within each spouses separate will. Then the surviving spouse by accepting such gift locks the surviving spouse in the same equitable legal obligation that upon his death he must comply with the promises made in his will in the same manner as the first deceased spouse was locked into.. In plain terms it's simple if the Surviving spouse accepts the gifts then it's a Quid Pro Quo aka This for That meeting of the minds. My opinion

      Do you even know how much nursing homes cost?? They are extremely expensive. If you even have an estate, to even qualify to get the Medicaid spend down they will get your assets first. So what is your gripe about?

      @tlbryant4077 To start with, healthcare in America has traditionally been an individual responsibility, assisted by private and public insurance plans. Care for the poor has been paid through Medicaid/welfare programs. The more affluent have always complained about welfare. Initially, medical and nursing homes expenses were considered to be a family responsibility, but LBJ changed that. My objection is that the wealthy have financial and legal resources to impoverish themselves to get welfare to pay for a nursing home. Others don't and play it as it was set up to be. So the rich can make the taxpayers pay for their parents' care so they can take that money for themselves. The American Way has been for people to have their debts settled first out of their estates. I know how expensive healthcare and nursing home care can be. I am out there looking for a system to make all of this more accessible for everyone. Not just for those who can manipulate the system.

    Can you or anybody tell me: What about a family of 6 who is on Medicaid, without an elderly or disabled person in the home? Can we set up periodic payments from the inheritance to come each month as long as it does not put us over income limits set by Medicaid? If I had a percentage of my inheritance sent to me to buy a vehicle and then set up periodic payments to come out of the remainder of the inheritance.. would I be able to do that? Would the remainder left in the inheritance be considered as an asset or a resource and be counted with Medicaid eligibility? Any answers would be greatly appreciated as me and my family have been trying to figure all of this out for the past couple of months now!🙏 ty

    Hello Mr. Coulson: If you get a chance, please respond to this question. How do you disinherit a child when you create a revocable trust? Does the Testamentary Oversight statute apply also to the terms of a Revocable Trust? Should you still state in the Trust that it is your intention to not provide for a child? If you do so, does the child have a right to a copy of the Trust to see that language? How about putting that language in a Pour Over Last Will, will that be sufficient? I have heard that some people will leave $1 to a child as a way to disinherit but if you put that wording in a Trust, the child getting $ 1 might have a right to a copy of the Trust. If you get the time, I'd appreciate your thoughts. Just found your videos and now I am a subscriber.

    I know this was 4 years ago, but I still don't have clarity on the service part. My husband joined the Army and had his basic training, which was 90 days at Fort Polk, Louisiana in 1971. Then he had a honorable discharge DD214. This was during the Vietnam War. After basic training he had committed to go into the part-time Army National Guard, which was 1 weekend a month for 7 years, plus 1week summer or winter camps a year. Will my husband and I be able to get the Aid and Attendance Program? Also we are confused on if he is considered a veteran and has veteran benefits he could get. Thank

    Could you do a video on married couples when one spouse is on medicaid and the other has to delay their social security income. My state (SC) is so restrictive on income limits and we couldn't afford my spouse's medical needs without medicaid. He has Parkinson's. I will qualify for Medicare next year, but will not be able to afford it. Local attorneys (Elder Care) will not help us. They are only interested in Estate Planning. Thanks.

    Can you please make a video on odsp and non earner benefit and explain what happen if the recipient doesn't want to receive it every 2 weeks anymore and ask the injury lawyer to settle this matter in one lump sump of money instead so it is not viewed by odsp has a income and can that work if giving im 1 lump sum of money and use that money to buy a primary home or a car as a non exempt asset .     Here is a real world reason for NOT prepaying for your funeral. [Preplanning your final wishes is a great idea.] In Pennsylvania, your heirs can deduct all of funeral expenses dollar for dollar from the inheritance tax they owe. IF you prepay, that is a BEFORE death expense and CAN NOT be deducted from the heirs inheritance. I'm finding this out the expensive way!
