Companies need to honor the commitment they make to their employees. If you hire someone to be remote and they are a productive in their work, companies need to honor the manner in which they hired the employee.

Democrats brought back Affirmative Action under a brand new name....DEI. It is really DISCRIMINATION against qualified whites in favor of less qualified blacks and other minorities. DEI IS REALLY ILLEGAL. IT IS DISCRIMINATION BY ANY OTHER NAME. DEI punishes a qualified white person for a less qualified person because of race, color, heritage and, sex. DEI (Diversity, Equity, and Inclusion) should be illegal because certain implementations of DEI programs can be considered discriminatory, potentially violating civil rights laws by giving preferential treatment to individuals based on race, gender, or other protected characteristics, essentially creating a form of "reverse discrimination" where certain groups are favored over others in hiring, promotions, or other workplace decisions; this is particularly concerning when implemented through explicit quotas or biased selection processes. Democrats keep destroying our beautiful America, our precious freedom and our beloved Constitution. DEI must be stopped immediately.
I live in CT. My severance is based on two months of my salary plus a prorated amount of my annual bonus. I was let go on 11/21/24. I received one half of my severance payout on 12/10/24 and will receive the other half in January probably around the same time. 1/10/25 give or take a day or two. Should I wait until after the second payment to apply for unemployment or should I go ahead and apply now?

QUESTION - If i have 4 weeks vacation and get approved for FMLA (12 weeks) to care for a needing parent, can I be away from work for 16 weeks (4 PTO + 12 FMLA)? Or….does my 4 weeks of PTO count ‘against’ the 12 weeks of FMLA?

I don't have an opinion on this, but I'd say that's the majority of positions that I have held, ones where the business could not continue to operate if I took a long period of leave. Aside from low level commoditized positions (say, in operations in a service business) where employees are interchangeable, a lot of companies have many positions in headquarters where they would have difficulty operating without someone there. For example, you can't just delay an SEC filing because your director of accounting or a controller took off, or your director of operations, or if you are an acquisition company and your lead mergers and acquisition person took FMLA in the middle of the year while deals were going through. The SEC will severely reprimand you with a fine and potentially there will be lawsuits. That's a lot of the back office, where they would need to hire a replacement immediately and retrain them. That said, the back office is only a small percentage of the company. Now say you have a job at the checkout counter, or in a warehouse, or you a manager of some sort of retail related chain... that's a totally different scenario.
I'll make my point another way. Is your company hiring people who aren't critical? Do most companies hire people who are salaried who are non-critical? For a lot of companies, especially ones that are scaling -- they are trying to avoid hiring non-critical people.
@@iKicker most companies have redundancy and shouldn't completely collapse if they don't have a position filled for 3 months. Heck, most positions at a lot of companies take longer than that to backfill when someone quits.

I would love to know the answer to this question. For Federal government positions covered by union agreements, if you were hired for a "Remote position" and your home is designated as your post of duty and the Agency headquarters is hundreds or thousands of miles from your home, can the Federal government pull the rug out from under you and force you to return to office and that would mean relocate or terminate your employment? Or would you be grandfathered in. [This is especially relevant with a new incoming administration]

Employers wont give you days, weeks or other when they plan to let you go - if and when they decide to do so. No such thing as loyalty.

Good advice. I live in a strong right to work state and non-competes are difficult to enforce here if the terms are at all harsh. But I'd not want to sign one just the same. I asked the VP of development at a ~2000 person company once why they didn't do non-competes like some other companies in the area did. His answer: "would you have signed on here if you had to sign a non-compete? We get the best and the brightest because we don't play silly games".

I know people in product engineering whose jobs were made into work from home and moved to a location too far to commute. The employer is now telling them to get back in the office for 3 days a week. This video completely ignores unemployment benefits. A return to the office mandate may very likely qualify as constructive dismissal, entitling you to unemployment benefits (pay) while you search for a new (potentially remote) job. Laws vary by state.

@@Milesco Unemployment is a cause of action against the employer. The employer pays the unemployement insurance premiums. Yes it is administered by the state. And yes, it is an integral part termination considerations.

A cause of action is part of a lawsuit filed in court, and it would be for something like fraud, breach of contract, wrongful termination, etc. An unemployment insurance claim is just that -- a claim for benefits under a system administered by a government agency.

It's funny how FMLA does not prohibit employers from forcing.employees with approved intermittent FMLA out of state work travel. A stupid loophole that keeps me from being a caregiver to my daughter with type 1 diabetes when my breast cancer surviving wife has various appointments for the 30 days that I will be unwilling away. Someday, a congress person with guts will correct this issue with a no brainer amendment. But until then, I will pray for that miracle.

My former employer played some dirty tricks...and with dirty people. New manager, with no managerial background, whose last position was terminated...due to a physical altercation with a fellow employee, wrought with legalities...are you catching my drift? New manager aka street thug, was initially nice enough but soon went on his reign of terror...with me. I was constantly singled out, yelled at nonsensically, and one day...found myself in his office....with FIVE Write-ups....in One Day!!! In conjunction with that bit of fun...I noticed that my position...was being offered on a national work website...for much less per hour...and this...after having just received an annual...and a cost of living raise. I was so confused...and horrified...and saddened. I had never experienced anything quite like this before. At one point, I confided in a friend with an HR Background. I was instructed...to brush up my resume, but to stay put...until they let me go. See, she was familiar...with employment dirty tricks... I was not. To top it all off...I was hit with the nastiest of accusations...one could imagine, and even more so, as a female. At first I thought, how absurd, of course HR will see what a decent human I am, and that that allegation is beneath someone like me. To my SURPRISE...and my dismay...they decided to embrace the allegation, though no formal charge, they kind of smirked when I addressed that at my exit interview, but officially, let me go, citing, that I was a 'poor fit' for the organization. I told them that, Yes...I was a poor fit, and that I was too good to work there, and that I had NEVER been treated so poorly on a job, period! It was ludicrous! I was forced, of course, to apply for Unemployment Benefits. Wouldn't you know, that after I told the truth, my side, to the UB Office, I was believed, 100 percent, and when the company was asked to provide the reason for letting me go?? They sent back a BLANK Page...Indicating to UB...no reasoning! Shoddy people, shoddy business, I tell you. No longer than 3 months after they terrorized, then dumped me.... that location of the shady business....Closed Down. I honestly felt severely traumatized after being fired, and after having some time to process...and reflect on what had just happened to me. My mind was blown. My precious reputation had been smeared, and in all honesty...in the company of my peers, I was the most honorable employee they had. You ask ....if I were so honorable...why not get out of dodge...as soon as I was able? Well, I had intended...to seek employment elsewhere in time, but I had a very important event that had been planned for a year, as well as an immediate health issue that needed to be addressed. There's no doubt, I would have left down the road, but was steadfast, still....in my loyalty, my work ethic, and fulfilling my duties, although having been harrassed for quite some time. What some of us have to endure, just to keep a paycheck coming in, is pretty unfathomable. I wish for that company, and all those involved....Nothing Good!!!
