    Hi and Thank You for this very informative video. What does an Alleged Incapacitated Person have to do when the Court Evaluator/Investigator comes to interview him to prove to that Court Evaluator/Investigator that he is NOT Incapacitated? Especially what should the Alleged Incapacitated Person say and do to Prove that he is capable of managing his Finances?

    But can all your assets be taken by a nursing home, God forbid should you ever need one, if you were to put them in a trust? My concern personally is I'm working my tail off now because I want to leave assets for my daughter. I want to know how I can do this without someone coming and taking everything I worked for in life and my daughter who is my only child gets nothing. That's what I worry about.

      Thank you for your comment. In New York, if a Trust is properly drafted and appropriate planning is done, assets can be protected for long-term care purposes. It is admirable that you are thinking about these things now because the earlier you plan, the more you can protect.

    Hi Melissa... Im the cousin of your former Neighbor Lisa Fowler... I am an adult 50 year old who is classified with a physical disability since birth and have never been able to work. my dad has assets that he will be leaving me when he passes. Which i will be able to handle since my disability is not mental or developmental.. I receive government benefits because of my disability what would be the best type of special needs trust that would protect those assets and still allow me to receive my benefits i.e. disability checks, section 8 housing voucher and medicaid? Thanks. He does not have a will!

      Hi there! Thanks for reaching out. It would be a good idea for your Dad to sit down with us and discuss preparing a Will. You are on the right track asking about a Supplemental or Special Needs Trust, but it may make more sense for your father to set up a Testamentary Supplemental Needs Trust for you, in his Will. Our recommendations would depend on many different factors, including the type of assets he is leaving you and whether there are other beneficiaries. We would be happy to meet with him and discuss his planning.

    Thank you for posting this. Question- if my family member already has a trust but it’s a revocable trust- does she need to change this to irrevocable so that she can avoid any type of look back? 30 month, 60 month or otherwise? Thank you!

    what's the tax ramifications of paying income taxes for an irrevocable trust? is income reported and taxed on 1040 return, or have to file a separate trust return and pay the higher trust rate and incur additional tax preparation and reporting expenses. thks

      The Irrevocable Trust discussed in this video is a Grantor Trust. This means that all income is reported on the Grantor’s (Creator’s) individual tax return and is taxed at their rate. They do not have to file a separate return or pay the higher rates.
