Assuming the company involved is claiming a patent on the variety. Cannabis as far as I know doesn't come true to seed, so your actually getting a slightly different strain every year and the plants you grow from seed will be different again so no patent could be enforced. What they would do if it was 'their' variety, is sell you cutting grown plants or charge you a royalty fee for every cutting you took, wether it grew or not

They can’t keep the seeds because there’s a possibility of THC plants pollinating the CBD plants, so those seeds would become THC plant seeds. If anyone happened to have THC growing within a couple miles even.

Indica literally means "India" translated into English from Latin AND Cannabis being shorter and squatter tends to originate ancestral from higher elevation areas and taller plants from valleys and other low lands where the rain and snow collects at and the soil is deeper. The whole thing with Afghan "Indica" from the late 70s pertains to Richard Evans Schultes misidentified a Cannabis Afghanica. All there really are, are the types derived from Hindu Kush stock and (sub)Equatorial.

Since the farm bill changed the definition of hemp what growets are growing now are cannabis chemotypes 1-2 (type1 thca dominant/type2 mixed ratio thca & cbda)mostly, with some type 3(cbda dominant). The old school definition of hemp & what most people think of as hemp is cannabis chemotype 4&5, type4 is cbga rich and type 5 has almost no cannabinoids. Type 4 & 5 are basically specific cultivars of sativa that were need for fiber, seed, oil. Sativa was chosen for the way it grows, tall & lanky, ideal for fiber producers. Hemp is cannabis & cannabis is hemp if 0.3%D9THC or less by dry weight. It's just a legal definition that seperates the two.
