Hi, I was doing just over 50 mph (52/53) in a 50 limit, when I noticed a speed camera van. I’ve been told there is a 10% +3 allowance where I live in Preston, Lancashire. Have I anything to worry about? Thanks

Legislation isn't law. The government can't make laws. That's why covid legislation wasn't enforceable, and no one got done for not following it!!😮

Companies can't get points, so put the car in a companies name, then refuse to name the driver. When the summons arrives the company admits its failed to name the driver and pays the fine, but gets no points

I absolutely love all these comments from idiots. Just accept your failings and pay the fine, take the course or the points. Anyone who says they don’t speed is a complete liar, we all speed. So many pricks fail to take accountability for their actions.
Do they have to do this procedure inside the room they are taking blood?
Or can this be done before while standing at the desk? When the first form was done?
Good question just got arrested last night and they started the form on the custody front desk , an then continued the form/ or the second form in the blood test room
Can a person tell the officer you prefer a field test over a swab test?
With the MGDDA document, so let’s say I’m taken to the police station, if he doesn’t go through the small bits of the MGDDA document and straight to MGDDB, do I keep quiet, then just plead not guilty, then bring it up in court day 2 that I wasn’t taken through MGDDA? Processes not followed correctly.
Do they have to go word by word while reading this documents?what if not?
The CPS may argue that the document does not have to be read word for word. I would disagree. If the officer has not completed the document correctly I would usually invite the CPS to withdraw the case.

they will still arrest and start proceedings until your blood tests come back, they need to be more lenient instead of just arresthing because its positive, if you had a prescription in the uk they still arrest even if you are no impaired

Is it true or false that if you take the police to court to challenge the offense that you can receive a higher penalty in terms of points and a fine just because you chose to challenge them? I'm not going to sit here condoning driving like a clown, but I've always thought that the effort which the police put into chasing people for speeding offenses is disproportionate to the effort that they make chasing up other crimes. One of my colleagues was hit by an uninsured and untaxed driver with no valid UK licence and the police said that they wouldn't get involved because it was a civil matter. However, they geared up to drag a former colleague of mine through the mud over them doing 35mph in a 30mph zone. (The irony is, we worked with a part time "Special Constable" at the time who was caught doing 35mph by the same camera van, in the same place, on the same day in an actual police car and they were offered a speed awareness course instead). - Just to clarify, they changed their tune when they were asked "why did Special Constable 'Matthew J.' get a speed awareness course for the same offense". 🤦🏻
I got a question I been coughed speeding 56mph in a 50mph roadwork average speed camera The problem I have is my speedometer what is digital on my EV failed and showed a speed of 0mphh after about 10-15 min it reset it self and work without a problem I have video evidence when It done it before and there is records at the garage that the car have been in a few times because of that problem I made the decision to carry on until the next junction as I made the assessment it would be to dangerous to stop the car in the roadwork Does that qualify for extenuating circumstances?

I was pulled over for dirty reg plates and arrested for suspicion of drug driving. I was never swabbed at the roadside but was in possession of cannabis. They tried to get blood straight away at the station but the nurse refused as it was a section 5 document and they needed a swab first she asked the arresting officer if he wanted to proceed under section 4 they left the room for a 5min chat and came back with a swab and proceeded with section 5 and said if i didnt take the blood ill fail anyway. Can you help
Know what pisses me off is that there has never been a documented accident caused by cannabis. First time users and occasional users may be heavily intoxicated, but medical cannabis use is not intoxicating to the level of a recreational user.
Interesting question, I got caught speeding ages ago but when I got my letter detailing the offense committed, my vehicle was listed as green instead of grey. All information was otherwise correct such as make and model and registration etc.. But I wondered could this have damaged the case in any way?

But what if the only evidence they have is from a cctv camera that happened to be pointing at the road you were on and showed you going by? Can you ask if the CCTV had been calibrated if the police wanted to use it as evidence? Thank you
Great Video and thank you. I was caught doing 49mph on the cusp of the 50mph speed limit turning to a 40mph speed limit by a remote van. I requested information on the local traffic order as its not stated on the NIP but they come back and said that I would have to obtain this from my local council and there is no entitlement to advance disclosure of evidence under the Criminal Procedure Rules 2010? Do you know if this is true? I also requested the rationale behind having a camera on this dual carriage way and requested 12 months worth of data of accidents to back up their justification but they said I would have to request this under the freedom of information act? Surely they need to provide such detail if they intend to prosecute? Regards Steve
To some extent, they’re right-you’re only entitled to full disclosure after entering a not-guilty plea. That said, I believe you’re doing the right thing by asking tough questions, challenging the process, and requesting further evidence. This approach puts added pressure on an overloaded system that often depends on motorists pleading guilty. As many others have shared in these comments, their cases were dropped for similar reasons.

I was pulled over an had drug swap, was 2 faint lines an 2 officers said after 8 minutes i was negative. Read instructions in front of me on road side an confirmed i was negative. Then 3rd police man walks over asking whats going on, waves touch over swap an says no thats traces of cocain an cannabis. Took me back for blood sample, then searched my house. Was about 1 1/2 months ago still waiting hear back about results. Any advise about going about/forward defence

Without disclosing anything, could I ask roughly how common are cases where the client hasn't smoked after 12 hours and swabs positive? I used to be very worried about the day after. Ultimately gave the habit up in the UK, this was definitely a contributing factor.
In the early stages can the person getting charged go to the police without the solicitor and ask all of things you said in this video and see if they can drop the case and say for example they do get charged then reach out and show the solicitor the previous contact etc. Also thank you for all the information its very helpful

Bizarrely, coppers and lawyers have no idea what calibration really is. When a laboratory is testing DNA, blood, semen, textile or other materials, so that the results can be presented as credible evidence in court, that laboratory must have accreditation from the United Kingdom Accreditation Service (UKAS). When a laboratory is accredited for a measurement function then we can be sure that the measurement, in base units or derived units, is within an acceptable tolerance of the base units in the Weights and Measures Act 1985, as maintained by the National Physical Laboratory (NPL). We therefore know that to be sure that the miles per hour referred to in a speeding complaint are competently linked to the miles and hours derived from the metres and seconds in the Weights and Measures Act 1985, the speed measuring equipment must be calibrated by a UKAS accredited laboratory. Instead, it is normal for police or prosecutors to erroneously refer to the routine automatic self-test of the speed measuring equipment as a calibration, or produce calibration certification from an unaccredited laboratory. One can tell from the absence of accreditation for speed measuring equipment in the UKAS database during the last couple of decades or so, and the meagre capacity of the laboratories identified as "calibrating" such equipment, that, at best, only tiny proportion of the equipment in use during that time period has been calibrated to a standard suitable for evidence used in court and therefore millions of speeding convictions are based upon inadequate evidence.
I used MAJ law, I cannot fault them, I got seriously screwed by the magistrate judge, the barrister and I were basically thrown out of court (after insinuating I fraudulently typed up 4 character reference letters) I got 18months suspension, £1200 fine, did I mention it was my first offence meaning technically I should have gotten 12months suspended, and somewhere between £100-500 fine, I appealed, won my appeal, suspension was dropped to 12months as it should have been and £400ish fine. What MAJ needs to explain clearly is between £2500-3000 to do all the admin and sort whatever out and your first court case, if you plead not guilty (which I assume MAJ law want) to get the 2nd form, MAJ rely on 2 things to hopefully beat your case, the first one is the CPS do not provide the 2nd form in a timely manner, but even then a judge could still extend their time to provide this, lets say they do provide form 2, MAJ will then go through all that form with THE HOPE that somewhere somehow procedures were followed which could put a doubt on the accuracy of the blood results. MAJ charge you again between £2.5k-3k to investigate, chase CPS, but that’s all inbetween, court date 2, bam another £2500-3k, so say you pleaded not guilty, you 2500 in the whole, another 2500 for them to chase CPS, and another 2500 to represent you court day 2, and so on, you’ll be in the hole between £7500-£10k and could still be found guilty.
99% of the time speeders are rightfully charged, are you moving on to “how to get away with murder next?”

I've had two speeding tickets in my driving history- one for myself and one for a company vehicles that one of my staff was driving. Both failed. 1) I was driving at 70 on a dual carriageway, with 50MPH roadworks signs on display. I went past a police speed van that was obeying the 50mph and, presumably or by coincidence, he radioed for a traffic unit ahead. Bang to rights, you might say. Well no, actually. The thing is that the works was under a TTRO- Temporary Traffic Regulations Order- which stated that the hours of work would be (iirc) 20:00 to 06:00 and this was at 08:00... So even though the signs were on display they were no more legally enforceable than if I had painted them myself. 2) This one was brilliant... My driver was in fact breaking the speed limit- 60MPH on a 50MPH on a newly opened dual carriageway. But we went and had a look and even though he technically was liable, had he come along the bypass from the other end it was showing 60MPH, if he joined at one of the intermediate roundabouts then it was also 60 and another it was correctly showing 50. It was unclear from the NIP where he had joined and he had no recollection at that time, so it was also dropped. Oh and a bonus... A friend was coming down the M1 in Derbyshire area at well over a ton- not something I actually approve of- and his NIP was received after the 14 days so he wrote back telling them, quite literally, to 4k themselves (I don't approve of his rudeness either, but...) and no more was heard about it.
What about things like insurance companies not giving you the insurance you need such as delivery or business why should they be allowed to stop you from getting these Conditions when its a life requirement and a necessity? Really annoying situation.

I have no legal knowledge. I represented my self. The court was a joke. I have a video coming out abojt this. They ended up charging me with something i never went in for anyway. But this was a much lesser penalty. But at first i had everyone in that room say the minimum i will ever walk out with is 6 points and a 1000 fine. They were all adamant. Turns out i left with 3 points and 200 pound fine. And even then, i could have dug my heels in. I believe a solicitor can make things worse. If you are guilty get a solicitor. But either way the judicial system is a joke. They are a money making building. And they will never admit to any mistake

You can’t rely on everything you see on the internet and this is, unfortunately, true also of this legal professional who imparts incorrect advice. At 1m32s he says “IF YOU DON’T RECEIVE THE NIP WITHIN 14 DAYS, THE CASE MAY FAIL…”, …this is incorrect. The Police has 14 days in which to “serve” the Notice of Intended Prosecution. There are very specific rules on this. It must be sent first class (if sent by post) within 14 calendar days of the offence date. If so, it is deemed to have been properly served. There’s much more to this. The NIP may also be sent to anyone who might reasonably be able to identify the driver at the time of the offence. For example, if the insured party is different to the registered keeper. There’s more to it. Essentially, the advice given is not 100% accurate. (And speeding is NOT a Criminal Offence. It’s a Road Traffic Offence.)
