State recognition: a must-have? | LexIcon
In this video, we examine the two theories of state recognition: constitutive and declaratory. According to the former, recognition of a new state entity by the existing states is a prerequisite for statehood. The latter theory, on the other hand, provides that state recognition is merely a declaration (as follows from its title) and thus is optional.

International Law is fake even if it exists. Its merely a Perceived Law . Its not possible because of the concept of Country within which the Jurisdication lies. Laws cannot cross boundaries: International "Law" exist but its Not Enforceable. How so? If International Law is enforceable, do you not think the world would have come up an Anti-Invasion law preventing any Invasion? So what if Russia Invade? There is no farking International Law that is enforceable to block a war from happening. I hope I have woken up the 99% blind. When a country vote to not be under China, that's that! Do the China People all say they want TW dead if they do not bend over for penetration? NO! It's MERELY 1 man's desire. Why is China State resources abused by 1 man? Dictatorship cannot exist when the world learns how to think from First Principles. No matter what, no matter how flawed Democracy is, Dictatorship is Always the greater Evil

what is the relation between convention and judicial Decisions , and also the relation between judicial decision and general principles?
Conventions (treaties) are primary sources, judicial sources are used as a supplement (thus they are secondary). The position of general principles of law is unclear: some say they stand together with treaties and custom; some say that they have a separate standing in-between primary and secondary sources.

Thank you! Treaties and custom have equal standing, meaning that one does not dominate the other. However, many treaties represent codified custom - the way things are "traditionally done" is written down.
