      Has anyone looked at what the words "officer" and "official" meant or how they were used at the time the 14th Amendment was written? Subsequent usage may have obscured the language that the orange minions are claiming doesn't apply to the POTUS.

    14th Amendment Section 3 abridged:
    "No person shall hold ANY OFFICE under the United States (who had also) have engaged in insurrection".
    It's right there in writing--enforce it.

      for the e jean carroll thing . the plaintiff tried to get tfg's DNA through the courts. there was a huge legal fray about whether tfg was an officer of the government. that situation used a law which gives employees of the government immunity from prosecution as they do thier jobs. the federal bureaucracy civil service folks we think. tfg claimed he was immune. lost track of that one.

      This is the entire point of the oath! To defend/ support/ protect and preserve the constitution. The constitution is the authority for our government. So I don’t see how you could seek to disrupt the function of the constitution which WOULD violate trumps oath to defend, preserve and protect the constitution. They can play all these little word games all they want but no matter what angle you come from he violated his oath of office

      Even if they didn't like the Democratic candidate or the Republican candidate, if they all got behind another candidate, that person win in a massive landslide.
      Republicans know that the more people vote, the less they win. So they are desperately trying to suppress voting. The harder it is to vote, the better their chances. They also know that they can't win a free and fair election, so they game the system with gerrymandering.
      The cure for MAGAism is to get everyone voting.

      that's the other aspect of this. CO has been trending blue for a while. Even if Trump is on the ballot..it may not matter. It would be wasted effort to try and remove Trump from the ballot in New York or California for example. He would never win those states anyway so why bother? If someone put forth the same lawsuit in Texas or Florida? now that would be something to watch.

    An oath to "protect and defend" the Constitution is a higher standard that just to "support" the Constitution. It makes zero sense that a person taking such an oath wouldn't be held to AT LEAST the same standard as those pledging to "support" the Constitution.

You have to ask yourself why these people are relinquishing themselves of any responsibility for his fate if it was supposed to be a nice fate?
      They were not expecting this saga to be played out in the public arena. So they have to wash their hands of it all now. They were not expecting to be exposed so openly and cannot accept being left in a position of utter humiliation.
      They’ve ran out of words to label him (having already over used: toxic, nasty, hate and dangerous). The latest one they’ve come up with is ‘rude’, simply for having natural desires to win an election.       These people obviously underestimated him as he is still standing years longer they had envisaged.     It is with great humility I opine that the US Supreme Court most strenuously will not want to make a decision about disqualification per the 14th Amendment. But they got their tails in this crick and they'll have to find a way out. As for the Colorado Supreme Court, I hope they have granite guts and make a sensible ruling, which will be to disqualify tfg for having been an office holder who who tried to overthrow the government. It may make things messy to have tfg on the ballot in some states and not in others but so be it. We have to use the justice system every chance we get to kick the fascists in the teeth. This is not a t.v. show. This is not fun and games. This is cold, hard reality.

      SCOTUS already has in another case. Presidents are Officers. Someone should send the following I found in my research; to the Colorado Judge ASAP before they make their final decision. I'm Canadian hard for me to do it. Quote from SCOTUS; The U.S. Supreme Court wrote in Nixon v. Fitzgerald, 457 U.S. 731 (1982): “Article II, § 1, of the Constitution provides that "[t]he executive Power shall be vested in a President of the United States. . . ."       Problem is that earlier versions of the amendment named the president but it was changed before being passed. No one complained about that removal. It seems that at the time they understood it to be EVERY governmental office and removed it to keep from being redundant.

      For primary elections it’s not uncommon for a candidate to drop out while still on the ballot. People just have to pay attention to make sure their vote goes to a valid candidate. Ideally he would not be on it, but not a disaster if ballots get made with him disqualified.

      The duty of the judges is to interpret and apply the law as best as they possibly can. Sometimes the law is unclear and multiple interpretations are possible. While this blog attracts people who interpret the 14th one way, there are other blogs where it is interpreted another way. The judges in this case need to understand all the possible interpretations in order to pick the right one

      It doesn't say president. The amendments were not written by the original writers. The 14th one was for civil war considerations, and the president was in the north, so it wasn't included.       Whether he is the best or not doesnt matter. If the best person I know kills someone they should be charged and convicted for it. The law applies even to people you are a fan of. If the 14th amendment applies to him and his actions meet the legal definition of aiding, inciting, or participating in an insurrection then he should be liable. Thats all there is to it.       He's never too young to corrupt (I mean introduce) him to politics. I started getting interested at about his age. By the time I was 16-17 had a good idea how I felt on most issues. My parents never influenced me at all. I found out later in life what party my dad belonged to and already was aware which one my mom was in. I live out of the country and read the voter's guide if I'm unclear about ballot measures or candidates I don't know about.

      I suggest you read Judge Wallace's 102-page rulings. She has made a plausible interpretation of the 14th Amendment, although I don't think it is the best interpretation, and I hope it will be overturned. Another possibility is that some court will say the Amendment is ambiguous, in which case the decision will go to the defendant.

    The president is Commander In Chief of the United States military and can be held to the exact same oath standards as any other military personnel.
    For the question of whether or not their behavior should disqualify them from service in political power, just swap trump with any soldier.
    Would a soldier who engaged in an armed and violent insurrection, disrupting the election process, and threatening sitting Congresspeople be disqualified? YES

    Collectively, from beginning to end, how much money have taxpayers paid for all of these lawsuits, and re-counts of votes and challenging decisions and sending him up to higher court it’s got to be staggering, and the fact that we are still paying for Secret Service to protect him is ludicrous it is absolutely outrageous the amount of tax dollars wasted, but I guess if we defeat him then it’s all worth every penny

      Has to be a think tank that would take on the money wasted from Big Lie alone.🤮 Guaranteed every County in 50 states had to raise their budget. Many didn't have electronic machines before Trump.
      I have run polling locations with only one other person (2 required for security reasons, transport also. The goal was one Democrat One Republican).
      Since 2020 I haven't seen a polling location with under 6 payed County contractors PLUS the observers/watchers taking up more space.
      Day of election I counted 12 workers. Large counties have dozens of locations. All procedures have changed because of ONE👻 Man🤕🤥

    I've served in the federal government as military and civilian personnel. The POTUS was my boss in both situations. How in the HELL was Donald, NOT a federal employee? His cabinet is full of people he hired to be secretary of various agencies. That judges' decision makes absolutely no sense. 🤨

      Trump's AG Bill Barr made the decision that Mueller couldn't go forward with the case. There's Trump's politicization of the DOJ he keeps screaming about. It was his guy that let him slide on by like the slime balls they all are. Funny how MAGAs forget about these things.

      What did Mueller know? Did you read his report or did you allow the co-conspiritors to tell you what he said? Trump and his co-conspirators all refused to talk to Mueller. He never said no collusion, only trump, GOP and right-wing media told you that. Mueller said he didn't have enough to say for sure, Because trump and his gang got to act like they were immune from investigation into treason and refused to speak about Russia to Mueller. I wonder why? Since then, his campaign helped them and was found GUILTY of sharing internal polling data with Russia so they knew who to target on social media with disinformation and lies about emails. That's called a COORDINATED social media disinformation campaign. Since Mueller, trump defended Russia personally and in front of the world in Helsinki 2018, and took his side over every intelligence agency we have and trumps own National security adviser. Why would he do that? That's aid and comfort to an enemy that attacked us and our election at trump's personal and public request. Cyberattacks are a hybrid warfare tactic. A warfare tactic......a warfare tactic....
      Doss it Sound like collusion yet? Does it sound like Treason yet? I wonder why trump HAD to say "no collusion" Every 5 minutes when cameras were around? Why did Trump have to pardon so many of his co-conspirators that he'd previously appointed to high ranking positions in our government only to find out they were Convicted of felonies. Many of them with Russian connections they refused to disclose under oath.
      Mueller DID however have more than enough evidence for 10 counts of obstruction which were laid out in detail. You should read it. 45 obstructed every day by lying to Americans about it in front of cameras and Republicans who also stood in front of cameras and helped Donald spread those lies should all be very nervous if their extremely obvious and slow-moving coup doesn't work. GOP corruptly refused and failed to uphold their oaths to protect and defend our constitution from a clear domestic enemy twice. Why? Why can't they hold him accountable? Conspiracy? Complicity? Absolutely....
      HOLD them accountable.

    The basic principle is simple. Having taken an oath and then demonstrating a complete disregard for it, one should not be permitted to pretend taking that same oath again. They have rendered all oaths meaningless, and if they cannot bind themselves to an oath they can’t assume the office that requires it.

    The House back in 2021 voted that trump aided in an insurrection. A Colorado judge reinforced that ruling by herself ruling Trump engaged and aided in insurrection. I bet courts in other states will rule the same. If the SCOTUS has eyes and ears, they too should vote in the affirmative.
