      ​@@HJKampeThe thing about a free society is we are not obligated to talk to anyone we don't want to. Once the demand for ID was made, his 4th amendment right was violated. No crime was committed, so no right to demand he turn over his papers. Every time your ID gets run through the system is not to your benefit, it's not simply for their paperwork. The fact he was released by the sergeant shows the cops overstepped their authority. You are free to obey anyone you want, and surrender your 4th amendment right to be secure in your paperwork, but that's your choice, not an obligation

      Unfortunately, they don't have to recognize the constitution. Ever since the organic act of 1871, the USA became the US corporation and is and has been anything but UNITED. Some courts will at least act like there's still a constitution but, in case you haven't noticed, most don't.

    The fact that a police department makes up that a call for service is justifiable reason to ID everybody is EXACTLY what is wrong with law enforcement and tyranny in this country. They swore an oath but their department makes and happily agrees to policies to violate our rights. Amazing.......

      Unlawful ARREST.
      Out of policy search of a male arrestee by a female, when a male cop was also present.
      Female cop admits "It's not a crime".
      A supervisor that arrived and changed the arrest to a detention.
      A supervisor that attempted to waffle, gaslight and lie his way out of the facts by presenting HIS interpretation of the law in order to deflect the inevitable court case.
      Well played. Keep calm. Gather all names and evidence. Film everything. Don't get crazy with cops at the scene. Save it and get crazy with cops when you put them in the dock of the court. A simple Letter Before Action demand for $5,000 should get a quick result. If they want to defend it, hire a lawyer and demand more money and a written apology from the cops concerned and from the PD (looks great framed and on the wall).

    *Even the sergeant got it wrong. Texas penal code 38.02 says you have to provide ID if you've been LAWFULLY ARRESTED. Not because they're investigating a possible this or that....LAWFULLY ARRESTED!!!*

    They hand cuffed him without a crime. They searched him without consent. They tried to get id without a crime. Crime, crime, crime. Those officers need to lose their jobs. Do not put them out in public till they know the law and people's rights.

    There needs to be a "national auditors union" that gets it's support from the public if you want to stop this kind of policing on a national scale. The auditors need to come together as an organization, so that they can lobby congress to put an end to qualified immunity and unconstitutional policing.

    I love how him watching first amendment audits helped this guy in this situation. It’s amazing. Watching audit videos has taught me so much.
    I wish more than anything I knew my rights like I do today 5 years ago when i was illegally detained, had cops walk in my house and take all my weapons because someone who I’ll never know that had something against me called the cops and said I threatened them with guns and these cops pulled me over at my house for “rolling a stop sign” and somehow turned that into trying to search my car, putting me in handcuffs in my driveway, saying I’m not allowed to own guns with a misdemeanor on my record from 10 years ago which is 100% false and scared me into thinking if I didn’t give them my guns, they would get a warrant based off the threat that was made and I would get 5 years for each weapon. So they gave me the option to go to jail while they get the warrant or let them take the weapons and they would let me go. So I let them go in my house, in my safe and take my Glock 19, AR15 and my 1911. I wasn’t charged with anything.
    My god if I knew then what I know now I would have bodied them cops. I would have told them write me the ticket for rolling the stop sign and I’m not answering any questions related to anything else and I’d still have my guns today because they had no legal grounds to take my weapons. Idk if I even rolled the stop sign in my neighborhood. I probably didn’t, they just used that as an excuse to have a reason to pull me over.
    $5,000 in guns sitting in friggin lockup over me getting my rights violated because I didn’t know them. The funny part is, at first when they pulled me over and kept asking me 72 times to search my vehicle that was parked in my garage and I told them no a million times, they kept asking me if i had weapons on me and I obv could tell this was way more than a traffic violation because there was 8 cops out front of my house asking me questions about guns. So the first thing that came to my mind was maybe something happened and my car matched the description and they had the wrong person because i was just so confused because I didn’t find out that someone called in and lied saying I threatened them until way after the fact. So in the moment I was mind blown. And at the time I lived in parkland FL 5 mins from where that school shooting happened a year prior so when I asked them why they keep asking me about guns the cops literally said “well I’m sure you heard about the shooting that happened at the school last year so we just wanna make sure everyone is safe.” And I literally asked the cop so what are you gonna do? Go knock on everyone’s door in parkland and ask them if they have guns? I knew that didn’t make any damn sense. It’s the same type of line they use when they say “with everything going on in today’s world blah blah blah”.
    Fuckin crooked cops man. Citizens need to know their rights. If all citizens knew their rights, we would hold the power but because we don’t, the cops are in charge and they know that. Everyone needs to get educated and that’s what these videos have done for me so if that same situation happened again, I would know exactly how to handle it and I would have either had them doing the walk of shame, or they would violate my rights and I’d have a fat lawsuit. But they wouldn’t be stepping foot in my house and taking my firearms, that’s for damn sure.

    I'm a former deputy sheriff, and he's right. When a traffic stop occurs for speeding, you can't ask for ID from passengers. Many do. This "we ID everyone" line is bogus. If the passengers give it up without complaining, so be it. If they complain, you drop it.

    In Texas we aren't REQUIRED to provide personal identifying information UNLESS we are placed under arrest.
    We Don't have to identify even if legally detained ONLY if placed under arrest for committing or reasonable suspected of committing a crime.

      ​@@Eagle8i just realized that he made a big mistake and could have been arrested for "failure to identify" by providing a false name at 12:00 mark by saying his name was good citizen so if they wanted to at that point they could have legally arrested him. In Texas you don't have to identify unless under arrest but it is a crime to give a false name if you decide to talk while being detained or investigated by police. But these cops obviously don't know thier laws at all so they probably not even aware that when he said that that they at that point (after they ran the name of course) could have legally arrested him. Best to not speak unless your required or people can get themselves in trouble with the slip of the tongue. 🤦‍♂️

But when the officer asked his name he replied "good citizen". Im not saying it wouldn't be ridiculous for them to arrest him for that because i believe it would be. Im just stating it would be completely within the legal interpretation of 38.02. Thats all. 👍

    If the handcuffs are on, you're under arrest,. They may say that you're only detained with them but you're not really. As for this case, it's open and shut. Those cops egos just cost them 10s of thousands of dollars, with no qualified immunity.

    It still amazes me that law enforcement officers are ignorant of the law concerning identification. Fourth Amendment protects citizens property, person, papers, and effects from unreasonable searches or seizures; without a probable cause warrant signed by a Magistrate. Terry v Ohio reduced the probable cause standard to reasonable articulable suspicion of a crime. Plus, law enforcement officers attempted to compelled him to testify against himself. Fourth Amendment protections are nation wide, and apparently law enforcement officers need to be educated on the law.

    Good man standing up for this rights. But I really applaud his family. They followed his lead. They immediately understood the man's wishes and they did NOT fold to the cohesion and attempted intimidation from these tyrants and traitors. They could easily have given up his info expecting that would get him out of trouble. HE KNEW BETTER. And they supported the husband/dad. LOVED THAT.

      I've seen videos where the driver (man) is tucked away in the cruiser because he won't give up his rights. He didn't do anything wrong but would not talk. Then the wife/girlfriend is next with the cops harassing her AND she gives it up. Doesn't waste a minute giving up the man's ID. SHE was SITTING right there when he refused. I swear, if my wife or girlfriend gave up my ID to the police she would be my EX. Someone you can not depend on, not count on, that would go against my wishes, will not sit next to me for the rest of my life.

    I'm an Australian living in Australia and even I know that as soon as the cop opened his car door it was a Fourth Amendment violation. Until they have to pay the lawsuit themselves they won't care about the people's rights.

    The cop literally admitted on camera that they don't ID when they have a suspicion of a crime, they do it for notes. Then she doubled down and said there was no crime. Hopefully he has money for a lawyer, and then money for a federal civil rights lawyer to sue them.

    Absent a detainment/arrest for a crime he does NOT have to ID. They said it themselves: "we just want his ID for our notes".

    The cop admitted, on camera, "It's not a crime" and then continued to lie and bully the female while the guy who was unlawfully arrested sits in the cop car in cuffs. I'm getting so tired of seeing these cops over reach like this. They need to be held accountable.

    The cops are sooooooooo use to running everyone they come into contact with. If you have a warrant, that will give them the court time to collect a minimum of 4 hours of court overtime.

    Choosing to remain silent, does not constitute impeding an investigation. It can constitute self imcrimination.
    No ID..is secondary to an arrestable crime.

    My question is how does getting ID's help with determining who is or isn't at fault? Never understood that. Get the stories, determine who is at fault then get ID(s) from who is a fault and get ID as needed if someone is pressing charges.

    Just saw your woodstock dmv vid on 'here's the deal'. Thank you for persistently fighting for my rights and even for the rights of the ignorant officers who violate your rights. Im glad to be a subscriber. We can take our country back from modern day policing. But it won't happen without awareness. Thank you for putting your work online. One day I'll live in a community where I respect and honor the police. So far after 4 decades on Earth I haven't experienced that.

    Speeds things along.
    You only have the rights you verbally invoke. The cops will get qualified immunity. Telling them you will sue is not invoking your rights and judges will have cops backs.

    They have no RAS for even a detainment. They need an OBJECTIVE FACT that would lead a reasonable officer to believe the person is involved in criminality. (Not a random person’s heresy report of something that MIGHT BE, POSSIBLY BE a crime).

      That's what people have to tell the cop's. They think they only need R.A.S. (Reasonable Articulable Suspicion) but forget they also need a S.A.F. (Single Articulable Fact) of said R.A.S. for a detainment.
