    My Peruvian friend came to the US around 30 years ago without documents. He works hard and has been paying taxes every year. His wife, also undocumented, died 5 years ago, and his 2 kids are now citizens. Is it possible that my Peruvian friend becomes a US citizen after Biden takes his office?

      Maybe, if he does put an amnesty plan in place. Once his kids are 21 they can sponsor him.

      @@user-yx5uh8lb8d So have his child sponsor him. We haven't seen a written amnesty plan yet but if we do we'll be sure to post about it here. It really depends on Congress too...in the past amnesty plans have been passed by Republicans and Democrats but people are so divided now its hard to say if it will pass

      Yes, its terrible. Good thing another Judge issued an injunction on the 8th against the asylum policies Wolf was trying to get through...now at least we won't have this country end asylum as they were trying to do.

    i’m a American citizen my wife has no criminal history never been arrested i had a case over 40 years ago a pandering i got my clinical report ive been working over 30 years and i’m getting ready to retire i’ve been a single parent that has raised my son and daughter and they are both grown now i keep checking on my case and they me The processing time is two years is there anyway I can speed this process up

      Hi Joey, sorry that's taking so long. There are a couple ways. Sometimes if you call your local elected official (so senator or house rep) they can contact USCIS. Or you can hire an attorney to file a mandamus action. If they are outside the timeline allowed under the law, this will usually get things going but can be expensive.     I was convicted of aggravated felony in 2004 & got deported in 2007, my whole family lives in California, now after more then 16 years I would like to file i212 waiver so I can be able to come back to reunite with my wife & children. What r my chances, pls respond

    Hello sir. Quick question. I’ve been living in the US since I was 10 and I’m 21 now. I had the E2 visa at the beginning for 8 or so years but I changed it to F1 (student). Are we gonna have a way to get the green card, if so, how can I start with the process?

      Hi Jaime, a student visa is a non-immigrant visa. Usually you cannot change from a non-immigrant to an immigrant (unless you get married) for a number of reasons. We do not know if Biden's plan includes allowing people to do that. He has only mentioned a few groups and we have not seen anything about students. If that changes we'll let you know. thanks for your comment.

      Hi Simplest, we hope it will speed the process up and will give you a green card but we can't say yet as we have only seen outlines of Biden's plan the entire legislation. When we find out more we'll let you know. The process is very slow. You can sometimes speed it up with a mandamus action in court. If that is something you want to explore, call us 888-421-9942

      Hi Just - so sometimes there are charities like a local catholic church that might be able to help. Before COVID the libraries would have someone there on the weekends to help too. That might be an option- have you tried googling it?

      I think we do mention it in one of our other videos, if you qualify you may be able to get a waiver to the travel ban - certain doctors and such.       Come back from where? Sorry this seems to be showing up late for us. He would need a visa but if you want him to stay in the US permanently, he would need a green card. He won't get work authorization with most visas and you can't work without one. good luck.

    Thanks for this video but I am going through a situation that's not mentioned in your video. I came into the USA through f1 Visa but my studentship was terminated last year August but I got married to a US citizen in the same month. I am yet to put in my paperwork for green card I want to know if the termination of my sevis record wont affect my application for green card. Won't they ask me to leave America despite being married to a US citizen. Your response would be highly appreciated. Thank you

      Kazuki, we agree. We do think there will always be some increases in charges, that is just the natural cost of living, right? But Trump truly tried to put policies in place to stop almost all immigration except for the wealthiest and that is certainly not what the founding father intended.

My understanding, having checked a number of sources we still need to file i944. However, my lawyer from VA said that i944 form is not required. Please educate me on this one, thank you very much.

      @@zachobut5574 It's hard to say without knowing your case particulars, we would never want to contradict your attorney who *hopefully* knows the most about your case. Does your attorney think it will HURT you case if you file it? If not, and you're asking them to do it, then it seems like they should do it but every law firm determines their own protocol. good luck.

    My dad's papers are in process, work sponsor, but since donnie took over they've been backed up, hopefully my mom and dad can get their green cards, they've been paying into social security all the lives and can't get anything as of right now.

      It is blocked with the State Department. Because of some last minute finagling with Chad Wolf DHS is trying to push it through again. We need to research it further to determine how it will impact immigration but for right now there is still an injunction throughout the US.

    How long does it take to get my Green card? I came in legally as a tourist in September 2018 and got married in July 2019. I started my documentation process in October 2019. So far, I've only received my EAD & SSC in April 2020. I've written the Office asking for the reason for the delay of my Green card but they kept telling me it's still within processing time. Now, my EAD card will expire on March this year. Although, I've reapplied for a new one but I'm still concerned that I do not yet have my Green card becausemy children aren't yet in the United States here with me. What can you say on this please?

      Tina, things are taking SOOOO long. It's ridiculous. So you can hire an attorney for file a mandamus action and that helps to speed it up. their standard answer is that is it within processing times. We're sorry you're going through this.       @@tinaowoh6294 every attorney is different. because it include having a court hearing, you'd probably have to put down a deposit for $5,000 or more and then they create a bill that shows their hourly work on it and deduct out of that and when you get to a certain amount you must "replenish" it. Our office would need to look at your circumstances to give you an exact figure. Because you already have an attorney you would need to pay for a consultation, which start at $350 since we are in essence giving a 2nd opinion.

    my visa category is f2a . i got first received letter in 16 december 2016 . documentary qualified 11 march 2019 ..i faced embassy in 19 sep 2019 .due for additional document i didn't get visa. they need i864a form. i have sent additinal document in 31octobar 2019 .but still now my case status is showing refused . my case has been continue about 50 months . i don't know how much time need for solution...😴😴😴😴😴

      It depends on your contract with your employer. did they agree to apply for a green card for you? If there is something in your employment contract then possibly? How would it be exploitation, are they paying you to work? If so, and its not in your contract that they must file for you to get a green card, probably not. It would be best to talk to an immigration employment attorney and determine that. good luck,

    I'm a permanent resident green card holder and been living in the US since I was 2 years old. I was charge with a felony procession of a illegal substance in 2001 for Marijuana serve 60 days in work release in the county jail. I want to apply for my citizenship but I'm scared it might trigger something with INS and get put in custody with immigration for deportation even though Laos is not accepting deportees right now but could down the line. So your mother has asylum approved - did you she put you all on the petition or is she getting a green card and then citizenship? There's so many factors, but if you are married and over 21, for a green card parent it is at least 13 years.
