    Hi, this was very informative. I'm looking forward to transferring some money to the USA for an investment-based green card process(EB5) and for that my source of funds is the the sale of land in India. Does 15CA-15CB suffice for the capital gains tax requirement? In other words, does 15CA-15CB confirm that the person transferring the money has paid the capital gains tax on the proceeds from the property sale?

    Hello Sir, a person has NRE account in India and what's to transfer money to his overseas account in USA.. Bank demands form 15ca/cb.
    I think this transfer of money from his own account to abroad account is not chargeable to tax. Hence only part D of form 15 CA can be submitted ...??

The amount which he wants to transfer is basically the Income tax refund received on the sale of the property. Can you let me know if he will need to submit both Form 15 CA and CB? And which form in Form 15 CA - Part A/B/C/D?

    I have one doubt... Suppose mr. X went to the UK for education & has taken an education loan from the UK now he is back in India & is repaying his loan ... Here TCS u/s 206c (1G) applicable or TDS u/s 195? If no then only form 15 CA part D is to file?

    • @AKTAssociatesOfficial
      @AKTAssociatesOfficial  5 месяцев назад

      1-You don’t have to pay any TCS if the amount you are transferring is below INR 7 lakh remitted for educational purposes.
      2-If you are sending more money than INR 7 lakh, funded through a loan, the TCS rate is 0.5%.
      3-If you are sending more money than INR 7 lakh without the support of a loan, the TCS rate is 5%.

      Listen Any remittance by ur sister in law to u would not attract any tax implication . since ur sister in law is also considered as ur relatives as per income tax act. further any remittance by relatives does not attract tax implications.
